Section 123 of US Atomic Energy Act (1954) allows US to enter into civilian nuclear deals with other
countries and all such agreements are called 123 Agreements.
India is not a recognized Nuclear weapon state and hence conditions prescribed for non-nuclear states
will apply to India.
After Pokhran I, US passed the nuclear non-Proliferation Act in 1978 which makes it mandatory to enter
into such agreements with countries which have carried out nuclear tests only after US Congress has
given authority to waive some of the provisions. This is the US India Peaceful Atomic Energy
Cooperation Act 2006, named after the member who introduced this bill, Mr Henry Hyde.
Thereafter India had to conclude a safeguard agreement with IAEA wherein all facilities are subjected to
inspections as and when needed. These safeguards are applicable in perpetuity (section 104b 2 of Hyde
Act).
Then US and India approached and reached an agreement with 45 Nations which form a Nuclear
Supplier Group. Then, the 123 went back to US congress for final approval.
NDA'S CONCERNS:
Indian civil facilities to be put under IAEA safeguards
Clause 34 and 39-42: India to submit design as soon as it decides to build or modify a facility.
Clauses 117 and 127: Not only 14 reactors but additionally 21 places too will be in the net.
These include 3 Heavy water plants,6 installations at Nuclear fuel complex,PREFRE reprocessing
plant at Tarapur,Tata Institute of Fundamental Research, Board of Radiation and Isotope Technology
and Saha Institute of Nuclear Physics.
Since research in civil facilities paves way for military development, our military technology too is
bound to be affected. If Indian defense needs more plutonium in future, it will not be able to divert
from civilian reactors and hence more military reactors will have to be built which will take about 8
years.
In the P5 countries, there are 217 reactors and only 11 are under safeguards.
In US there are 104 out of which only 5 are under safeguards and this is a voluntary offer.
Clause 32: India can withdraw a facility from safeguards with prior consent of IAEA only after it is
no longer usable, meaning it is dismantled.
Clause 104-106: No arbitration in case of dispute. We can only appeal to the board whose decision
will be binding and if we do not adhere to it, it will be reported to UN General Assembly.
Have we ever received justice there? History is witness to this.

Additional Protocol s demanded by Hyde Act to be based on IAEA protocol applicable to non nuclear
states. We cannot transfer equipment, personnel, design and operating manuals from Civil to military
programme.
Under Para 23d and 26 d, indigenous stocks of Thorium (exceeding 20 Tonnes) will be open to
perpetual inspections
Inspection cost which will be borne by India will be Euro 1.2 Million per site per year. Why do
we pay for this?
India agreed to separate civilian and military facilities and programmes.Why throw down the drain
what our scientists have achieved? The cost of separation will be huge and this was never mentioned
in the house even though NDA is asking about this since 2005. This separation plan is not applicable
to recognized nuclear states.
US has trapped India into an agreement whose provisions are more stringent than those of CTBT or
NPT which we have not signed.
The Objective of the Hyde Act is to cap, reduce and eliminate India's nuclear weapon programme
and thus restricts our nuclear sovereignty. China has supplied 6 reactors to Pakistan without
asking for separation plan.
US will secure India's participation to contain Iran. This agreement wants India's foreign policy to be
same as that of the USA.We will not deal with Iran as per the wishes of USA.India can not become
the camp follower of any country.
The bill will ask US President to certify every year that India is adhering to the laws of the deal &
keep them informed of any nuclear activities of India.

India did Pokhran I, they terminated the deal citing its domestic laws. Shouldn't we be more careful

NPT is coming up for a review in 2010. Shouldn't we have waited to negotiate a deal which will
enable us to be recognized as a nuclear weapon state. What was the hurry?
Draft not shown to allies/left and PM refused a JPC to investigate. Why? Other countries saw
it, it was on the net and to the entire world but Indian Parliament was not shown. Isn't this a
mockery of democracy? Leave alone the Parliament, Dr Singh did not consult his cabinet, the
cabinet committee on political affairs, his senior colleagues or allies.
Contrasting statements: Govt says, Hyde Act is not applicable but all US congressmen say it fully

Even a 20 fold increase in nuclear capacity by 2030 will lead nuclear energy to fulfil only 5% of our
total needs. So what was the need or the hurry on this deal?
Why didn't the government sign an agreement, presumably on par with 123 agreements with Russia?
The Indian side backed out at the last moment. What was the proposal? Why did you back out if you
had agreed earlier?
Left supported China's nuclear test in 1964 and opposed India's test in 1998! Why?

In short, Sonia Gandhi and Manmohan Singh are virtually handing over the control of the
bomb that Atalji made for our security to the USA through this agreement. Pakistan and China

StageI- Set up Pressurized Heavy Water Reactors using Uranium to produce power.The fuel which
was used is called spent fuel and elements in it like plutonium can be re-used after reprocessing.
Stage II- Set up Fast Breeded reactors using plutonium recovered from stage I. The special feature
was that it actually gives us more fuel than it uses even after producing electricity, so it overcomes the
uranium shortage in our country.
Stage III- Use our vast Thorium resources and produce electricity using plutonium and thorium.
Stage I is completed. For second stage, a Fast Breed Test reactor is operational since 20 years, a
prototype fast breed reactor of 500MW is under construction and should be over by 2011.
This will make us self reliant, both in fuel and technology. India has achieved this despite the
isolation
It is a wrong statement that India is short on Uranium. We have large reserves in Jharkhand, Meghalaya,
A.P,Rajesthan and Laddakh.AS per Govt, only the mines of A.P can give us 1200MW for 50 years, so
imagine what is there from the other places!
A Uranium mine can be developed in 3 years and the reactor in 5 years.

P. Chidambaram reduced allocation for nuclear power schemes from 2333 crores to Rs 889
crores in 2008-09.
Nuclear energy is more expensive than coal, gas or Hydro. Coal based plants cost 4.5 crores,Gas turbines,
3 crores,indegineously built nuclear reactors 7-8 crore and imported reactor 10 crores!
For 20000MW by 2020, Rs two Lakh Crores would be needed in next 10 years!!!
By the way, Uranium prices have shot up by 300% in last two years!What about future escalations?
If the costs of reprocessing are considered, then nuclear power becomes 27% more costly than coal based
system of which we have reserve of 90 million tones!
Australia which has the largest reserves of uranium does not have a single plant and US has not
constructed any after 1979!!!
A country becomes great on its strength and achievements and not on basis of help from others.
Right to reprocess has been postponed to future date subject that India sets a separate facility for
such reprocessing and only if arrangements are worked out between the two countries. This too
will have to be passed by the US congress.
The issue of transfer of superior and sensitive technology too has been put off to a future date and
is subject to an amendment of present agreement.
So we are talking of amendments and on none of the three issues has the US made any
commitments, except push it to a distant future.

The left and the Congress is not only turning a Nelson's eye to this issue but its local leaders with the
covert support and backing of the party are in fact encouraging this trend, undermining India's Security
and that of its citizens, only to create a Vote Bank for their parties. The Brothers in Arms at the centre are
Brothers in affected states, when it comes to this issue.
The Bharatiya Janata Party, armed with the ammunition of data should unleash this weapon and inform
the citizens of what is really happening and what will be the consequences in future.
With proper planning, this issue has the potential to uproot this government in the next elections on its
own and this issue has to be strategically used in those states where the impact will be the maximum.
In the same breath we should also inform the people how the border population is getting changed. How
Hindu majority areas have now become Hindu minority areas and what is the population growth in these
districts in the last five years and How Hindus are tortured in rural Bengal This should be passed onto
friendly media channels and newspapers, especially the local media. Perhaps we can take help from
friendly organizations to enhance this propaganda in the relevant states, discredit the ruling parties and
destroy their vote bank by aggressive wooing the voters to change in our favour.
According to the report, at present there are 80 lakh Bangladeshi infiltrators in Bengal, 55 lakh in
Assam, 4 lakh in Tripura and 5 lakh in Bihar (Katihar, Purnia and Kishenganj districts) and
Jharkhand(Sahebganj district). As far as West Bengal is concerned, the concentration of infiltrators is
quite marked in the border districts like North and South Dinajpur, Cooch Behar, Nadia,

Udaipur and Belonia areas in Tripura. Pakistan's ISI is believed to have a hand behind this large-scale
infiltration which has been playing havoc with the economy of Bengal and Assam. Home ministry
sources say HUJI, has succeeded in sending a large number of militants along with the infiltrators to
West Bengal.
As many as 53 out of 294 Assembly constituencies in West Bengal have a high concentration of
voters who happen to be illegal Muslim from Bangladesh. Similarly, the fate of 40 Assembly
seats in Assam depends on the votes cast by illegal Bangladeshi Muslim infiltrators. All this has
been revealed by a recent report of the union home ministry on infiltration from India's neighbour.
The report has been prepared on the basis of facts and figures provided by the Task Force on Border
Management and Assam's former governor S.K. Sinha.
As such the Bangladeshi Muslims can control the West Bengal Assembly, and dictate terms to the
state government of West Bengal in all respects. The picture of plight of majority Hindu electorates
worsened in the State, as Muslim electorates have a clear majority in three districts viz. Malda,
Murshidabad & North Dinajpur and 63 (sixty three) blocks in West Bengal. Again, an analysis upon
the projection into the 2001 Census hints at abnormal Muslim growth everywhere in West Bengal,
where the Muslim population is 28% of the total state population.

According to the 2001 census report, Indian population is 1,027,015,247.3. Of this, 1.5 crore people
are Bangladeshi infiltrators who are living in India. The Intelligence Bureau has reportedly estimated,
after an extensive survey, that the present number is about 16 million. The August 2000 report of the
Task Force on Border Management placed the figure at 15 million, with 300,000 Bangladeshis
entering India illegally every month. It is estimated that about 13 lakh Bangladeshis live in Delhi
alone. It has been reported that one crore Bangladeshis are missing from Bangladesh [August 4, 1991,
Morning Sun] and it implies that those people have infiltrated into India. These infiltrators mainly
settle in the north-east India and in West Bengal. This is shown by the fact that there has been irregular
increase in the Muslim population in these states and many of the districts have become Muslim
majority.
In West Bengal, the Muslim population in west Dinajpur, Maldah, Birbhum and Murshidabad 36.75
per cent, 47.49 per cent, 33.06 per cent and 61.39 per cent respectively, according to 1991 census.
With the passive support of both the UPA Central Government and the CPI(M) State Government and
with the active support of all the political parties in West Bengal (except for the BJP) for winning the
Muslim vote bank's support, the DGFI & ISI has actively put down roots in the soil of West Bengal for
their purposes. Not only are they successful in the ongoing demographic change of West Bengal by
means of mobilizing the election machinery of Bengal, they have also opened their fronts everywhere
in smuggling, trafficking, drug peddling, illegal cow smuggling, trans-border gang robbery and of
course terrorism, with the active grassroots support to the HUJI-B, LeT and JeM.
West Bengal BJP leader Tathagatha Roy said the extent of atrocities against Hindus in Bangladesh can
be seen from the fact that in several districts there was not a single woman between the ages of seven
to seventy years who had not been raped in that country. He apologized for the indifference of the BJP
Government which did not grant refugee status to Hindus fleeing oppression in Bangladesh. North
Eastern Students Organisation chairman Samujjal Bhattacharya said all 49 tribal belts and blocks in
Assam have been occupied by Bangladeshis. The shadows have spread to Arunachal, Nagaland,
Manipur and Meghalaya
Tarun Gogoi, the Congress(I) Chief Minister of Assam, is giving all protection to these Muslims due
to political compulsions. The Assamese community has been overpowered by Muslims. These
Bangladeshi Muslims are sneaking into upper Assam too, creating serious problems for the Assamese.
The demography of Assam has drastically changed and the very existence of the indigenous people is
threatened. The manifold growth in Muslim population has overburdened Assam and the Assamese
people are feeling harassed and tortured. The livelihoods of the local people are getting snatched away
by these illegal Muslim migrants. The Janjati (indigenous tribal) communities in Assam are not
organized. Therefore, their land and forests are very often forcefully occupied by these Muslims. The
Nelli massacre in 1983 was the worst clash between the local people and Bangladeshi Muslims in
which several Lalung Janjati people were reportedly killed and many Lalung villages were burnt.
These Bangladeshis have illegally sneaked into Manipur, Mizoram, Meghalaya, Arunachal Pradesh
and Tripura too. They are marrying the local girls of influential people and are thus getting protection
from their in-laws' families. After marriage with a Janjati girl, they convert her to Islam. They
purchase land in the Janjati belts in the name of their Janjati wives by producing Janjati certificates in
her name. Now, the new generation of Muslims, i.e. the Janjati Muslims, is growing. They give
Muslim names to their children but the clan remains that of local wives, like Saidullah Ningrum, Azad
Lingdoh (Khasi Muslims), Nizamuddin Semia, Akram Semia (Naga Muslims), Shahabuddin
Chowdhury, Akbar Laskar (Assamese Muslims) and others. In Assam, Muslims are using Assamese
surnames like Hazarika, Barbhuian, Bargohain, Bhuiyan, Bora, Gohain and others. There are Meitei
Muslims too in Manipur.

In Nagaland, the Muslim menace is more serious. Dimapur has become the den of these Bangladeshi
Muslims. They constitute the leading labour force in the agriculture sector owned by the Naga
community. The majority of rickshaw-pullers, auto-drivers and other manual labourers is now of
Bangladeshi Muslims. This has given rise to robbery, theft, illegal trafficking of narcotic drugs and
liquor, smuggling of pornographic films and vulgar literature and an unprecedented rise in crime,
flesh trade and prostitution.
Nagaland capital, Kohima, has become the second biggest haven for the illegal migrant Muslims who
occupy most of the shops in the main market, P.R. Hills and other localities. They marry Angami girls
and become sons-in-law of the Naga people.
Similarly, all the district areas such as Mokokchung, Wokha, Zunheboto, Phek, Mon and Tuensang
are infested with them. They are sneaking into the interiors of Nagaland. In places like Jalukie in
Zeliang area, Naginimora, Tizit and other central places of Nagaland, the pain of the presence of
migrant Muslims is felt by the local Naga populace. Some ten years before, the students´ bodies had
agitated against these foreigner Muslims. But the agitation was silently withdrawn reportedly due to
threats from Bangladesh that the Government of Bangladesh would demolish all the camps of Naga
undergrounds established in the territory of that country if the Bangladeshi Muslims were harassed in
Nagaland. On seeing this unprecedented growth of Muslim population in Nagaland, S.C. Jamir, the
then Chief Minister, once stated, "Muslims are breeding like mosquitoes in Nagaland."
As a result of such illegal migration of Bangladeshi Muslims and their nuptial ties with the local
Naga girls, a new community called Semiya or Sumias has already emerged in the state. Their
number is estimated to be several thousand. The concentration of the Semiyas is the highest in
Dimapur and Kohima districts respectively. There are fears among many that the voters' list might
have been doctored to accommodate the Semiyas as well other immigrants. The result of such
immigration is gradually being felt in the state.
According to a Dimapur-based newspaper, on any Muslim religious day at least half of the shops in
Kohima and some 75 per cent in Dimapur remain closed. It is also a fact that control over business
establishments is fast receding from the hands of the locals. A recent survey conducted by the state
directorate of Agriculture showed that 71.73 per cent of the total business establishments are being
controlled and run by non-locals. Out of the 23,777 numbers of shops in the state, the local people
own only 6,722 shops. Since the illegal migrants provide cheap labour, they are aggravating the
unemployment problem. Besides, they pose a threat to the internal security as well. Reliable sources
indicate that they are also involved in various unwanted activities like drug peddling and flesh trade.
Some excerpts from the report, "Demography survey on eastern border" by Bhavna Vij-Aurora in
"The Telegraph" are startling. "There have been reports that more Madarsas and mosques are
sprouting along the borders, which in itself is an indication of increased Muslim population in the
area," disclosed an intelligence official. The last such study was done by the Intelligence Bureau and
the home ministry in 1992, and their report kept a secret in view of the sensitive findings. It was
ultimately leaked and the estimated number of illegal migrants from Bangladesh was anywhere
between 1.5 crore and 2 crore. It's time for a fresh survey, according to sources.
There have been renewed intelligence reports that militants are using madarsas and mosques as safe
havens, and also for storing arms and ammunition. According to reports, the largest number of
madarsas and mosques has come up in bordering areas with Nepal, lower Assam and Bengal. This
complements another secret survey that has revealed that nearly 40 per cent villages in the border
districts of Bengal are predominantly Muslim. There are reports that concentration of the minority
community, including the Bangladeshi immigrants in the villages, has resulted in the majority
community moving to urban areas.
Along with madarsas and mosques, a large number of Muslim NGOs have sprung up in the area
bordering Nepal. Most of these madarsas are used for anti-India activities by Pakistan-backed

terrorists. The NGOs ostensibly work for the social and educational uplift of the Muslim community
and receive substantial and completely unregulated funding from Saudi Arabia, Kuwait, Libya and
other Islamic countries," an intelligence report said."
West Bengal Governor G.K. Gandhi's warned that the State is sitting on an "infiltration time bomb"
(Pioneer 21 July 2005). Mr. Gandhi had informed President Kalam that unchecked infiltration is
creating a demographic crisis, with the border districts of Murshidabad and Malda witnessing a steep
rise in minority population.
BSF officials say the magnitude of the threat can be gauged from the fact that over eleven lakh
Bangladeshis who entered the State legally since 1971 have simply disappeared. As for the illegal
aliens, estimated at 1.5 crores by former Home Secretary Madhav Godbole, the entire north eastern
sector is bursting with Bangladeshi migrants, mosques, and madrasas. These are festering cancer
wards of an amnesiac nation, hurtling towards another potential Partition.
Bangladesh census chief Sharifa Begum has detected a 'missing' population of 1.4 crores, closely
matching Indian estimates of persons who have intruded with the connivance of Bangladesh and
Pakistan's ISI, to destabilize India. Bangladesh is even training infiltrators to speak Assamese before
pushing them into Assam.
Mr. R.K. Ohri, ex-IGP, Arunachal Pradesh, cautioned that an Islamic Caliphate is rising on India's
flanks, from Bangladesh to West Asia, and that the shadow of the Mughlistan corridor is now visibly
manifesting in various districts along the Indo-Nepal and Indo-Bangladesh border. The demand for a
'Muslim Banghboomi' has already been raised, warns ex-MP B.L. Sharma (Prem). Travelling in West
Bengal to check out certain atrocities against Hindus some years ago, his convoy was attacked by
Bangladeshis.
Bangladeshi soil is increasingly being used for terrorist and for subversive activities by religious
extremists, pan-Islamist terrorist groups, and insurgents operating in India's Northeast, substantially
through the active collusion of Pakistan's Inter Services Intelligence (ISI) and Bangladesh's
Directorate General of Field Intelligence (DGFI).
There were grave concerns about the possibility of Islamist extremists in the country acquiring
radioactive materials and the technical know-how to build a 'dirty bomb', when on May 30, 2003,
Bangladeshi police arrested four suspected members of a Islamist group, Jamaat-ul-Mujahideen, at a
house in the northern village of Puiya. Officers also seized a football-size package with markings
indicating it contained a crude form of uranium manufactured in Kazakhstan. Subsequent tests at the
Bangladesh Atomic Energy Commission in Dhaka confirmed that the 225-gram ball was uranium
oxideenough to make a weapon capable of dispersing radiation across a wide area if strapped to
conventional explosives.
Reportage during the first quarter of 2003 indicates the existence of Al Qaeda operatives in
Bangladesh, coordinating their activities with local Islamist groups, validating perceptions that the
country is emerging as a major safe haven for Islamist terrorist formations.
The broad trends during the year 2002 remained largely unchanged in the first quarter of 2003.
Pakistan's external intelligence agency, the Inter Services Intelligence (ISI), further tightened its hold
over Bangladesh by harnessing past linkages with Islamist fundamentalists and certain sections of the
military and political establishment. Internally, various Islamist groups remained active and enlarged

their subversive agenda.
Since the elections of October 2001, and the installation of a new regime headed by Begum Khaleda
Zia of the Bangladesh National Party (BNP) and backed by the fundamentalist Jamaat-e-Islami (JeI),
communal tension and Islamist extremist mobilization has risen dramatically. The JeI, which has two
Ministers in the new government, and 17 members in Parliament, allegedly receives support from the
ISI, including funding and arms flows, as well as technical and training support.
A number of transnational Islamist terrorist groups, including the Al Qaeda, have established a
presence in Bangladesh in alliance with various militant fundamentalist organizations there.
Prominent among these is the Harkat-ul-Jehadi-e-Islami, Bangladesh (HuJI-B), which was
established with direct aid from Osama bin Laden in 1992. The HuJI-B has very close links with the
ISI, and received financial assistance from Pakistan, Saudi Arabia and Afghanistan (under the
Taliban) through Muslim Non-Governmental Organisations (NGOs) in Bangladesh, including the
Adarsa Kutir, Al Faruk Islamic Foundation and Hataddin.
Various terrorist groups operating in India's Northeast continue to find safe haven and operating
bases on Bangladesh territory. Groups like the United Liberation Front of Asom (ULFA) have been
emboldened by the BNP Government in Bangladesh, which in its previous term was seen as
supportive of insurgent formations acting against India. Many leaders of Bangladesh's ruling party
have direct business linkages, including partnerships in corporations and financial operations that are
run by, or co-owned with, leaders of such terrorist organisations. During its previous regime between
1991 and 1996, the BNP provided these groups with liberal facilities, including training camps, bank
accounts, facilitation for arms purchases, and freedom of operation from Bangladeshi soil. As a result
these terrorist groups, on the run in India's Northeast under persistent pressure from Army
operations, found a much-needed breathing space to regroup and re-launch their offensive against
India.
Although the Government has reacted fiercely to suggestions that Bangladesh has become a new
theatre of the activities of Islamist fundamentalist groups, including the Al Qaeda, reports suggest
otherwise:
Shortly after the fall of Kandahar in late 2001, several hundred Taliban and Al Qaeda fighters
escaped by ship from Karachi in Pakistan to Chittagong. They were then trucked down allegedly by
the DGFI to hidden camps in the Ukhia area, south of Cox's Bazaar.
Asian security services indicated that militants from the Jemaah Islamiah which is connected to the
Al Qaeda and seeks to set up a gigantic Islamic state encompassing Malaysia, Singapore, Indonesia
and southern Philippines were also hiding out in these camps, which were set up in the early 1990s
to train rebels from the Muslim Rohingya minority in Myanmar's Rakhine State. The Jemaah
Islamiah militants in hiding in southeastern Bangladesh are believed to be mostly citizens of
Malaysia and Singapore.
On May 10-11, 2002, representatives of nine Islamist fundamentalist groups, including the HuJI,
reportedly met at a camp near Ukhia town and formed the Bangladesh Islamic Manch (Platform). A
transnational organization, it includes a group representing the Rohingyas, a Muslim minority in
Myanmar, and the Muslim Liberation Tigers of Assam, a small group operating in India's northeast.
By June 2002, Bangladeshi veterans of the anti-Soviet war in Afghanistan in the 1980s were
reportedly training members of the new alliance in at least two camps in southern Bangladesh.

The HuJI, , is reported to have 15,000 members of whom 2,000 are described as 'hard core'.
Islamist extremists in Bangladesh have for long maintained operational linkages with a number of
foreign Islamist groups. Investigations into the January 22, 2002, terrorist attack on the American
Centre in Kolkata, capital of the Indian State of West Bengal, brought these linkages to the fore.
The Asif Reza Commando Force (ARCF), which claimed responsibility for the attack, is essentially a
criminal group allied to the HuJI-BD, which has very close links with the ISI.
The arrest of Aftab Ansari alias Farhan Malik, prime accused in the American Centre attack, led to
further disclosures regarding the international linkages between the Pakistan-based Jaish-e-
Mohammed , LeT and the HuJI based in Pakistan and Bangladesh.
Aftab Ansari played a key role in the July 25, 2001 abduction of Kolkata-based businessman Partha
Pratim Roy Barman, who was subsequently released on July 30, 2001 after reportedly paying a
ransom amount of Rupees 37.5 million in Dubai through the Hawala network.
It was out of this money that Omar Sheikh convicted by a Pakistan court in the Daniel Pearl murder
case is said to have wired $100,000 to Mohammed Atta, the alleged ringleader of the hijackers in the
9/11 multiple terrorist attacks.
