Abstract

In Nepal, the policy of local governance Act 1999 has provisioned broad based organizational

structure, devolution of authorities, special provision to include women and disadvantages

communities, planned development process and judicial authorities to local bodies. In this

article, I try to explore whether the act has provided enough legal basis for the development of

capable, responsive and accountable local self-governance system is itself an issue. However

looking at the experience of the past 12 years in general and after the legislation of the Act in

particular, it seems that more and more political rivalry and unhealthy competition among all

development players have created a confusion and chaotic situation at the local level and have

threatened the total destruction of power devolution mechanism.

This paper examines some of the fundamental issues that have affected the power devolution in

Nepal over the past few years. I have choose defining responsibilities, reforms at the central

level, Regional inter-dependence as the analytical categories to see issue in power devolution

Introduction:

Throughout history, there has been a tendency for governments to centralize power. During the

late 20th century, however, groups in both federal and unitary system increasingly sought to

reduce the power of central government by devolving power to local or regional governments.

Devolution is usually refers to the statutory delegation of powers from the central government of

a sovereign state to govern at a subnational level, such as a regional or local level. It is a form of

administrative decentralization. Devolved territories have the power to make legislation relevant

to the area.
