2. SCOPE OF WORK:

The contract shall mean the construction, completion and maintenance during defects liability period,
provision of all labours for masonry work, plaster work, tools and machinery as mentioned herein.
The contract shall include the following works on labour basis:

1. Entire masonry work of various widths in clay bricks or fly ash bricks/blocks or AAC blocks in
super structure of the building including parking and terrace parapets as per drawings.
2. Internal rough/tar finish plaster in kitchen and toilet/bathroom/WC walls to receive wall
tiles/dado upto specified height.
3. Internal rough/tar finish plaster or sanla/lime finish plaster to all walls of apartment, floor
lobbies, staircase walls. (Delete this point if POP/Gypsum is to be applied directly on masonry)
4. Internal sanla/lime finish plaster to ceiling of all toilets/Bathrooms/WC’s.
5. Internal rough/tar finish plaster or sanla/lime finish plaster to all ceilings including staircase
flight bottoms, parking slabs. (Delete this point if POP/Gypsum is to be applied directly on
ceiling.)
6. External double coat sand faced plaster to entire building including overhead water tank, lift
machine room, attached terraces/balconies, top terrace parapet walls, parking columns, chajjas
etc.
7. External single coat sand faced plaster or Sanla/lime finish plaster to attached
terrace’s/balcony’s slab bottoms.
8. Single coat sand faced plaster inside all ducts, opening side of lift duct.
9. Making and finishing of all dhars/ edges of internal and external plaster.
10. Elevation features in external plaster like grooves, cornices, bands, pargolas, round columns,
flower beds etc.
11. Curing of all masonry and plaster work as instructed.

3. PAYABLE AREA (WORK QUANITY):

The payable area for the contract is _______ Sqft. It includes out to out slab areas of all floors
(Excluding lift shafts/bigger ducts), 50% of attached terraces/balcony areas, 50% of parking area, 50% of
top terrace area, lifts machine room bottom slab, OHWT bottom slab.

Service ducts of areas less than 30 Sqft area are not deducted.

The detailed area calculation is as per annexure I.

4. QUANTITY VARIATION:

If due to any reasons, this area changes as per the actual executed work on site, then the revised actual
area shall be considered for the final payable amount calculation. The change in the area shall be jointly
certified by the contractor and our site in charge.
5. PAYABLE AMOUNT:

The rate agreed for the completion of the work as mentioned in the scope of the work is Rs.__________
per built up area as per annexure I. As per this rate, the total amount of this contract comes out to
Rs.__________________/-(In words Rs_________________________)

6. BILL OF QUANTITIES:

The Bill of Quantities as mentioned in annexure I, forms part of the Contract but the developer does not
undertake to carry out the whole of the work as shown in it and reserves the right to modify any part
thereof. The Contractor shall not be allowed any compensation or damages for work, which is so
omitted or cancelled by the developer.

The Bill of Quantities is for indication purposes only and the item rates shall remain valid for any
variation in individual quantities or for variation in overall value of work.

7. TERMS OF PAYMENTS:

a. No mobilization advance shall be paid to contractor.

b. Contractor shall submit his RA bill after each payment stage along with abstract /measurements on
the company’s standard format.

c. Retention of 5% of bill value shall be deducted from each R.A bill & the same shall be released after
successful completion of defects liability period of _____ months.

d. Payment of RA bills will be made be to contractor within 15 days on submission of technically &
commercially correct invoice to our project manager. Contractor shall get the RA bills scrutinized and
certified at site from the site in charge.

e. Debit notes , if any , shall be attached along with each RA Bill duly signed by site in charge and
accepted by the contractor .Decision of director / project manager /site in charge will be considered as
final in case of discrepancies.

f. Applicable TDS will be deducted from each payable amount and TDS certificate for the same will be
handed over to the contractor at the financial year end.

g. Service tax shall be paid extra on each RA bill (Service tax registration shall be provided to claim
service tax)

8. PAYMENT STAGES:

The payment stages of the contractor shall be per attached annexure II.
9. TIME OF COMPLETION:

Time is the essence of the contract. The entire work in your scope shall be completed in all respects and
handed over to us before the targeted date of completion. Contractor shall adhere to the schedule fixed
by the site in charge to suit the site conditions. It shall be the contractor’s responsibility to jointly
workout the detailed program along with the site in charge so as to complete the work within the time
period.

10. LIQUIDATED DAMAGES FOR DELAYS:

Amount of Rs ..................../- will be deducted every week from the payable amounts, for the delay,
after the above mentioned targeted date OR intermediate targeted dates, if the delay is due to any
reasons attributed to the contractor except Force Majeure or any other reasonable cause beyond
control.

11. GENERAL CONDITIONS REGARDING WORKMANSHIP AND WORK PROCEDURES:

1. Before starting the masonry work, one layer of brick /block should be laid first and get checked
from site engineer.
2. The mortar should be mixed in a mixing tray and using pharma for volumetric proportion of
cement and sand as instructed. ( For eg Cement : Sand mortar 1: 6 etc)
3. In case of red clay bricks, the bricks should be soaked in water before using.
4. The river sand should be screened before using for masonry/plaster work.
5. The thickness of joints in case of bricks should be 12 to 15 mm. The thickness of joints using
block jointing mortar in case of AAC blocks should be 3 to 4 mm.
6. Horizontal concrete bed with or without reinforcement should be laid for 4” to 6” masonry if
required as guided.
7. The readymade MS/ Concrete/ Wooden door frames shall be fixed using holdfast as guided
along with the masonry activity. (Delete this point if door frames are to be fixed using
screws/fasteners before internal plaster.)
8. Pharma should be used during masonry work for uniform sizes of door/window openings.
9. The gaps between masonry work and beam bottoms should be properly packed with mortar and
coarse aggregates before internal/external plaster.
10. Chicken mesh should be fixed to all joints of masonry and concrete as instructed before internal
and external plaster. Holes for the plumbing nails should be done using drill machine. The drill
machine and the drill bits should be bought by the contractor.
11. The surface to be plastered should be wet by watering around 12 to 24 hours before plastering.
12. Before internal plaster, thiyyas ( Plumb dots) should be marked on the wall to maintain line,
level and plumb.
13. Internal plaster inside rooms should be cut at 9“ above slab level to receive skirting.
12. External sand faced plaster on attached terraces balcony walls should be cut at 9 “ above slab
level to receive skirting. (Delete this point if POP/Gypsum is to be applied directly on masonry)
14. Butt filling above skirting tiles should be done wherever skirting is fixed. It should be finished in
plumb and line with the existing wall plaster. (Delete this point if POP/Gypsum is applied directly
on masonry.)
15. The contractor shall supply the metal/bamboo (Delete one) scaffolding and erect/ dismantle it
at his own cost.
16. The contractor shall finish the holes of scaffolding in plaster properly on internal and external
sides. (Delete this point in case of metal scaffolding)
17. Curing should be done for brick masonry and internal/ external plaster for minimum 14 days.
18. The labour contractor shall return all empty cement bags to the storekeeper before demanding
further cement for any work for that / next day’s work .
19. The contractor shall co-ordinate with plumbing and electrical contractors for their related work
during masonry and plaster work.
20. Main distribution boards and electrical switch boxes wherever provided shall be protected and
thoroughly cleaned.
21. Care shall be taken during the execution of work to avoid nuisance and disturbance to the
neighborhood.
22. Any departmental work directed by company’s site in charge (not in scope of civil contractor)
shall be paid at actual. Contractor to keep proper record of the same duly certified by site in
charge with supporting reason, usage of labour, area of work etc.
23. For all defective work, labour contractor shall be solely responsible and shall bear the cost
material and labour for redoing the same as directed by the engineer in charge.
24. The labour contractor shall not remove any material from site either belonging to the company
or the labour contractor without prior knowledge, consent and written instructions from site in
charge.
25. One copy of material requisition note (MRN) for the material which is brought on site by the
contractor must be given to the company.
26. No extra cost shall be paid to the labour contractor for any work that is carried out beyond the
working hours of the day by day of night shift.
27. Contractor or his representative shall give daily labour report to the site in charge.
28. The company reserves right to debit the contractor for the cost of ->a) any company material
damaged during the work, b) excessive wastage of material supplied by the company for the
work, c) The cost of rectification of the defective work if the same has not been rectified by the
contractor at his cost.

12. DRAWINGS FOR EXECUTION:

Drawings for construction will be issued progressively to meet the schedule. Drawings and sketches
provided along with this work order document are provided to indicate intent and extent of the work
and are provided for tender purpose only for enabling contractor to quote rates. Before commencement
of work, detailed drawings for construction shall be issued for enabling contractor to carry out
construction work.

13. COMPLIANCE OF INSURANCE, PF AND LABOUR LAWS:

Contractor has to comply with all statutory and legal requirements for applicable labour laws and acts
namely a) Building and Other Construction Workers Act, 1956 b) Contract labour ( Regulation and
abolition )Act, 1970 c) Workmen Compensation Act 1923 d) Minimum Wages Act e) Employee’s State
Insurance Act 1948 f) Provident Fund and Misc. Provision Act 1952.

Contractor shall acquire licenses under all applicable Acts & PF registration (in case not available at the
time of tendering) once the contract is awarded to him.

Contractor shall bear all the statutory & incidental charges on this account at no extra cost to owner.
Contractor shall keep company indemnified from all the liabilities and proceedings arising from such
statutory and/or legal requirements and in the event of any such liability arising there from, the same
shall be deducted from the amounts payable to the contractor. Contractor will submit Workman's
Compensation Policy to cover his laboUrs as mentioned along with 1st RA Bill.

Contractor shall adequately insure all men/women labours, machinery, shuttering material & other
resources deployed by him on site & indemnify the company from the claims arising out of any such
damages.

All notices with regards to the labour laws/PF/Labour insurance, which are served to the Owner for
default by the contractor, will be fully and effectively dealt with by the Contractor himself.

14. SAFETY AND SECURITY NORMS:

Contractor should take adequate precautions for safety at sit by providing, safety helmets, safety shoes,
goggles, hand gloves, reflector jackets, safety belts etc. to all the workmen who are working or present
at site. All electrical lines temporary/permanent at site should be checked before usage to ensure
leakage.

If any accident occurs at site due to negligence of the above mentioned safety norms, the contractor will
be solely responsible for all the consequences arising out of the above and the client is absolved of any
claims/Compensation if any payable by the contractor to his workman.

Company/client shall be indemnified for any theft, damages, accident for the plant & machinery. Entire
responsibility of safety, storage of machinery; consumables etc. shall be with the contractor after the
issue of material.

15. CLEANLINESS AT SITE:

Contractor shall keep the site in a clean and tidy manner as instructed by site in charge and if contractor
fails to maintain the desired cleanliness, contractor interim payment shall be withheld and the site shall
be cleaned by other agencies appointed by site in charge and the cost of the same shall be recovered
from contractor’s interim payment.

14. ELECTRIC SUPPLY FOR WORK EXECUTION/LABOURS:

Electricity for construction and labour hutment shall be provided free of cost by us at one point. Further
distribution shall be at your cost. Electricity for labour camps shall be arranged by us at one point in
labour camp. It shall be your responsibility to ensure that there is no misuse/wastage of electricity.

15. WATER FOR WORK EXECUTION/LABOURS:

Water for construction shall be provided free of cost by us at one point at every floor, further tapping
shall be done by you at your cost. Curing pipe will be provided by company. Water for labour camp shall
be supplied at one place and further distribution shall be at your expenses. Water taps shall be kept shut
each day from 9.00a.m to 7.00p.m at the labour colony. It shall be your responsibility to ensure that
there is no misuse/wastage of water. Contractor shall make adequate arrangements for curing of
masonry and plaster work, to the satisfaction of site in charge at no extra cost to us.

16. ESCALATION IN RATES:

Contractor’s contract rate shall remain same till the completion of the work as mentioned in the scope
of work herein. No extra charges shall be paid towards extra working hours, increase in labour wages ,
material tools and machinery rates, operator charges etc even though the work is delayed due to some
reasons .

Company shall only bear the additional charges due increase in statutory taxes, if any.

Similarly in case, if the taxes are reduced corresponding reduction shall be applicable for the payable
amount.

17. GUARANTEE /DEFECTS LIABILITY PERIOD:

The total work executed shall be guaranteed for quality of workmanship etc. for a period of _________
months from the date of handing over of the entire works to the satisfaction of the company .During the
guarantee period, if any defective workmanship is noticed, you shall rectify the work at your own cost
including the required material cost.

18. SPACE FOR THE LABOUR CAMP ETC:

Land for Labor Camp, office, stores etc. will be provided at site free of cost as and when it is available at
site or nearby. Contractor shall provide hutments for his labor at site at his own cost including materials
required for the same at a suitable location identified by the Project Manager. No workmen will be
allowed to stay within the building under construction.
It shall be responsibility of Contractor to maintain the cleanliness and hygienic condition at labor camp
and at full site as well. You shall take the necessary action in this regards, as directed by our Project
manager at no extra cost to the company. In case contractor fails to maintain the requisite hygienic
conditions in labour camp as per the local authority’s health dept's requirements, company shall get the
same done & debit an amount of Rs. 500/- per labour per month deployed by contractor. Contractor
shall be responsible for his labor management thereof and upon completion of work you shall remove
labor camp etc. outside of the site.

22. WEEKLY/FORTNIGHTLY MEETINGS:

Weekly / Fortnightly Co-ordination and progress monitoring meetings will be held at site along with
Contractor.

23. MAN POWER, PLANT / MACHINERY REQUIREMENTS:

The contractor shall submit a comprehensive manpower, tools and machinery schedule, which shall
include the dates of arrival on and removal from site for all tools and machineries. Minimum numbers
for manpower and some of the tools and machinery expected is mentioned herewith for guidance.
However, contractor shall verify its sufficiency for himself and arrange additional manpower, tools and
machinery required to complete the work. None of the equipments and materials brought to site shall
be removed from the site without the permission of the site in charge

Contractor’s staff at site (per wing / building):

Contractor shall provide following minimum staff equipments per building at site for the period of
contract subject to approval of our director / site in charge.

24. RECONSILIATION OF MATERIALS:

Apart from day to day reconciliation of material consumed, the Contractor shall assist Site Engineer in
reconciliation of Cement, bricks/blocks received on site at following stages.

For masonry, internal plaster as well as external plaster-

First Reconciliation shall be done after completion of 4th floor

Second Reconciliation shall be done after completion of 8th floor.

Third Reconciliation shall be done after completion of 11th floor.

Fourth & final Reconciliation shall be done along with submission of final bill.

Permissible wastage limit for

Cement- 3%

Fly ash bricks/blocks- 5%

Clay bricks- 7%

AAC blocks- 3%

In case wastage identified at intermediate stages as mentioned above is more than these limits,
contractor shall make all the efforts to bring wastage within the permissible limits. Contractor shall take
care to see that the wastage of material does not exceed the standard consumption norms.

24. NON PERFORMANCE AND TERMONATION OF CONTRACT:

The developer / company reserve the right to terminate this subcontractor with immediate effect either
wholly or in part without payment of compensation to the contractor in case of following circumstances.

a) If the contractor fails within three day notice from the developers to proceed diligently with the
work to his satisfaction and at all times in such a manner as will not in the developers opinion ,
prejudice the completion of the whole or any portion of the work under the principal contract in
accordance therewith.
b) If the contractor refuses / delays or fails within three days notice to rectify any defective
workmanship to the developer’s satisfaction.
c) If the contractor fails to complete and deliver any work or portion of the work by the time or
times specified in the work schedule or by such extended time or times as may be allowed by
the developers in writing.
d) If the contractor fails to withdraw /replace immediately, at developers instructions any one or
more of the employees to whom developer objects o whose presence on the works may not be
good to maintain healthy working environment on site.
e) If the contractor sublets whole or part to this work without developers written prior approval.
f) If the contractor fails within three days notice from developer to take action on any of the
obligations on the part of the contract herein contained.
g) If the contractor fails to mobilize sufficient manpower, machineries etc .affecting quality and
progress of work .Company shall engage another agency to complete the work at contractors
risk and cost.
