SANGGUANIANG PANLUNGSOD

WHEREAS, as per Sangguniang Panlungsod Resolution No. 02026-12 and Ordinance No.
0318-12, both Series of 2012, the subject properties have been reclassified from Protected Low
Density Residential Zone(PR-1) to Protected Medium Density Residential Zone (PR-2), subject
to the condition that the developer will only build a maximum of Forty (40) dwelling units per
hectare;
WHEREAS, the Barangay Council of Baranagy Bago Galleara also passed Resolution No.
34, Series of 2012 endorisng the application;
WHEREAS, the City Engineer’s Office (CEO) certifies that the applicant has combined
with the technical requirements for the proposed development on the conditions of its drainage
concern given the following configurations and details, to wit:
1. That the allowable discharge development is 5.371 cubic meter per second;
2. That the locational configuration of possible outfall is the natural waterway traversing
the development area flowing down to Bago Creek;
3. That the discharged capacity of outfall is 26.659 cubic meters per second,
WHEREAS, the Davao Light and Power Company (DLPC) certified that it can supply the electric
power requirements of the proposed project. DCWD further required for a complete sanitary sewerage
system with primary and secondary waste water treatment facilities to minimize ground water
contamination;
WHEREAS, the Barangay Council of Barangay Bago Gallera attested that no development has
been undertaken related to the said subdivision development;
WHEREAS, a committee hearing was conducted by the Committee on September 28, 2012 at the
Sangguniang Panglungsod, this City, foe the purpose of ventilating the issues attendant to the application
where representatives from all the concerned agencies were invited. During the public hearing, no
objection from the stakeholders and concerned agencies was interposed;
WHEREAS, the applicant substantially complied with the documentary requirements needed to
grant approval of the Preliminary Approval and Locational Clearance (PALC) foe Villa Conchita located
in Barangay Bago Gallera, Talomo District, this City, containing an area of 246,286 square meters more
or less;
ADOPTED, December 7, 2012 by a majority vote all the members of the Sanggunian
present, there being a quorum.
