Vice Mayor (VM) and Presiding Officer (PO) J. Melchor B. Quitain Jr. called the
session to order at 9:40 in the morning. The session commenced with a prayer led by
Councilor Luna Maria Dominique S. Acosta then it was followed by the singing of the
Philippine National Anthem and “Tayo’y Dabawenyo”.
Upon direction of the Presiding Officer, Ms. Charito N. Santos, Secretary to the
Sanggunian, called the roll which established that all of the twenty-three (23)
Members of the Body were present, thereby establishing a quorum.

Moving forth with the next part of the agenda, Floor Leader (FL) Jesus Joseph P.
Zozobrado III presented a motion, duly seconded by Councilors Pilar C. Braga, Wilberto
E. Al-ag, Rodolfo M. Mande, Augusto Javier G. Campos III, Louie John J. Bonguyan,
Trisha Ann J. Villafuerte, Edgar R. Ibuyan Sr., Myrna G. L’Dalodo-Ortiz, Bai Hundra
Cassandra Dominique N. Advincula, Dante L. Apostol Sr., Bonz Andre A. Militar and
Jessica M. Bonguyan, for the approval of the minutes of the July 12, 2022 Regular
Session; hence, the motion was carried.

FIRST READING

With a manifestation regarding the inclusion of proposed Supplemental Budget


No. 3, FL Zozobrado III presented a motion, duly seconded by Councilors Jessica M.
Bonguyan, Pilar C. Braga, Wilberto E. Al-ag, Dante L. Apostol Sr. and Conrado C.
Baluran, to consider Item Nos. 41 to 90 as stated in the agenda to have been read
and passed under First Reading.

Before the approval of the motion, PO Quitain Jr. directed the SP Secretary to
change the status of Councilor Nilo M. Abellera Jr. from absent to present, which
was duly noted.

Duly recognized, Councilor Braga noted that Item No. 85 must be removed
from the agenda since the subject matter was already taken up during the previous
Council. As there were no further comments from the Members, the pending motion
was approved and the following items were considered to have been read and passed
under First Reading:

On a somber note, Councilor Ocampo declared that the City has lost a well-
revered member and pillar of society, Mr. Antonio Movera Ajero, who passed away
peacefully on July 17, 2022. Mr. Ajero served relentlessly as a community journalist
spanning three decades; thus, he serves as an inspiration to many young journalists.
To acknowledge the life of Mr. Ajero that was dedicated to service through community
journalism, Councilor Ocampo presented a motion, duly seconded by Councilors
Ibuyan Sr., B.E. Al-ag, W.E. Al-ag, Militar, Alejandre, L.B. Villafuerte and Abella;

Expressing concern over reported numerous cases of diarrhea or acute


gastroenteritis from Toril District, Councilor T.A. Villafuerte manifested that bsaid
ailment has affected twelve (12) Barangays of Toril District.

Councilor T.A. Villafuerte noted that in 2014, records from the City Health
Office show that gastroentistinal diseases as one of the City’s top health problems.
Furthermore, in 20416, a study conducted by the University of Immaculate Conception
revealed that water from Talomo and Davao Rivers, two of the main sources of water,

have high alkalinity and high fecal coliform count commonly associated with feces from
animals and humans. The same study confirmed that the rapid increase in population,
urbanization and industrialization continuously reduces the quality of water, especially
in places of industrial and agricultural activities such as the Third District.

In view of the foregoing, Councilor T.A. Villafuerte called on Davao City Water
District (DCWD) to be stringent with the conditions required for issuance of the
certifications required for developing subdivisions and that the same should ensure that,
upon completion of the repairs of its pipes, the water will be disinfected. Moreover, she
added that ambulant street food vendors must comply with sanitation requirements.

Lastly, Councilor T.A. Villafuerte called upon the City Health Office, particularly
the City Epidemiologic Service Unit and the Environmental Sanitation to look into the
matter.

Following the privilege speech of Councilor T.A. Villafuerte, Councilor L.J.


Bonguyan presented a motion, duly seconded by Councilors Advincula, Mande, Abella,
L.B. Villafuerte, Ocampo, Militar, Braga and J.M. Bonguyan, to consider the same as
having been read and passed under First Reading. (Docketed as Item No. 92)

Afterwards, Councilor L.J. Bonguyan manifested that the City Government


already received reports regarding the diarrhea outbreak in Toril. As the Chairperson of
the Committee on Energy and Water, he invited the following officers of DCWD to shed
light on the matter: Ms. Hydie R. Maspiñas, Division Manager, Water Quality
Division, Ms. Alma Judith Canson, Quality Assurance Chief, and Engr. Cherry
Hidalgo, OIC Supervisor of the Planning Division.

Considering the importance of the matter, the Floor Leader presented a motion,
duly seconded by Councilors Braga, J.M. Bonguyan, Advincula, L.B. Villafuerte, Abella
and Acosta, to suspend the rules to allow the resource persons to participate.

BACK TO SUSPENDED RULES

Duly recognized, Ms. Hydie R. Maspiñas, Division Manager, Water Quality


Division, Davao City Water District (DCWD) stated that, on July 15, 2022, reports were
made on social media regarding the diarrhea outbreak in Toril. Consequently, DCWD
checked their operations especially on chlorination which showed that the chlorine
residual is well within the right levels meaning the chlorine is enough to inactivate any
water born bacteria. They also collected ten (10) samples from affected areas, namely:
Puan, Baliok, Bago Aplaya, Bago Gallera, Lizada, Binugao, Sirawan, Rasay, Bato and St.
Peter’s College. DCWD performed a microbiological analysis for Escherichia coli and
Total Coliform Which yielded negative Escherichia coli and Total Coliform results. Ms.
Maspiñas clarified that the samples were taken in the affected areas but not in the
house of the patients as they were not privy to information on the patients.

Ms. Maspiñas further stated that DCWD checks their water source and reservoir
monthly and that they furnish the results to the City Health Office and to the Committee
on Health of the Sangguniang Panlungsod. Moreover, the City Health Office also
conducted its own sampling and testing but there are no results yet. She then gave an

assurance that DCWD will continue to monitor the matter and that the diarrhea
outbreak in Toril is not water related as far as their analysis is concerned.

Responding to the clarificatory questions from PO Quitain Jr., Ms. Maspiñas


established that DCWD has already issued its official statement through social media
due to the exigency of the issue. Furthermore, the results of the tests being performed
by the City Health Office will be out after 72 hours which means that the results will be
out by Thursday.

Addressing the queries of Councilor Ungab, Ms. Maspiñas manifested that the
Philippine Standards for Drinking Water requires that they have to monitor at the
endpoints. The law only requires them to test 121 samples per month but records will
show that DCWD monitors around 400 to 500 samples per month in order to increase
the confidence of the public to the quality of water being served by DCWD. The testing
by DCWD is done twice a month. Moreover, DCWD has the history of the results of
their sampling since 1973. One sampling site is monitored for about 2 to 5 years. Ms.
Maspiñas explained further that there are two kinds of samples: before the meter and
after the meter. Before the meter refers to the water from DCWD whereas after the
water is the consumers’ since there are circumstances that may affect the results such
as old pipes and cross-connections.

On whether DCWD uses the standard operating procedures, Ms. Maspiñas


answered that their laboratories as well as their samples are accredited by the
Department of Health. Moreover, all of their analysts are competent. Councilor Ungab
put on record that DCWD stated that they religiously follow the accepted standard
sampling methods that should be done on all water sources and distribution of water.
It was also established that, by law, they are only allowed within six (6) hours from the
collection of samples to the analysis. After the samples are collected, they have to be
in the laboratory within six (6) hours. They also follow protocol by putting ice in their
sampling bottles. The aforementioned are being done in all sources of water of
DSCWD, including the Bulk Water Supply Project. In fact, the time of sampling and the
time of examination are included in the report to determine the standard.

Ms. Maspiñas expounded that their laboratory is the only laboratory in the
Philippines which can do an 18-hour test on bacteria so DCWD can immediately respond
to water quality complaints. They also have an online chlorine analyzer that for twenty-
four (24) hours. After giving once again an assurance that DCWD continues to work
towards serving the public with safe and potable water, she also stated that same is still
on the process of getting its ISO 17025 accreditation.

Upon the request for clarification of PO Quitain Jr., Ms. Maspiñas declared that
DCWD already uses the highest standard for monitoring water. The ISO certification is
for the competency of the analysts.

Upon due recognition, Councilor B.E. Al-ag made it clear that DCWD is stating
that there is no contamination in its wells and that water from DCWD is not the source
of the infection of the patients as far as their analysis is concerned. Ms. Maspiñas
cleared that the samples were taken from the affected areas, meaning the Barangays,
but not from the respective residences of the patients. The ten (10) random samples
were taken from faucets of certain houses, not from the well. As far as she knows for
the duration of her stay with DCWD, Ms. Maspiñas stated that there is no history of a

well being shut down due to contamination. She also cleared that there is no ongoing
repairs in the area.

Councilor B.E. Al-ag pointed out that there may be ongoing repairs in the area
that may contaminate the water. Furthermore, the source of drinking water of the
patients must be ascertained and included in the investigation. He shared that a lot of
households in the Toril area have their own artesian wells which might be
contaminated. Councilor B.E. Al-ag suggested to DCWD and the City Health Office to
collect samples of the water source of the patients. Ms. Maspiñas thanked the
Councilor for his suggestion as they have not taken such angle into consideration yet.
Stressing the importance of the matter as it affects health and public safety, Councilor
B.E. Al-ag emphasized that the reason and source of the infection must be determined
in order to stop the diarrhea outbreak.

In response to the query of PO Quitain Jr., Ms. Maspiñas manifested that the
samples collected by the City Health Office were taken to the laboratory of Southern
Philippines Medical Center (SPMC). The results will be out after 72 hours. DCWD may
test water sources other than those they already own, they will charge a fee. However,
they will be waiving such fee for the testing of the sources of water of the patients
since it is for public safety.

At the question of Councilor L.J. Bonguyan on whether the patients already


told them where they could have been infected, Ms. Alma Judith Canson, Quality
Control Assurance Chief of DCWD, was acknowledged then she reported that, on the
previous day, she went to six (6) hospitals, namely: Malta Medical Center, St. John of
the Cross Hospital, Ernesto Guadalupe Community Hospital, Davao Mediquest Hospital,
St. Felix Medical Hospital and Viacrucis Infirmary where the diarrhea patients were
admitted in order to gather data.

At Malta Medical Center where there were 28 cases, a nurse revealed that most
of the patients ate street food before they had diarrhea. Some of the 10 diarrhea
patients at St. St. John of the Cross Hospital said that they did not eat street food and
that the last food they ingested varied from sardines to chicken while others drank tap
water from DCWD. Ernesto Guadalupe Community Hospital had 16 cases but 2 of them
were taken to SPMC due to severe dehydration. Some of their patients had street food
and tap water. 30 cases were admitted to Davao Mediquest Hospital. Some of their
patients had street food. Viacrucis Infirmary had 22 diarrhea patients, some of whom
also ate street food. Lastly, the diarrhea patients at St. Felix Medical Hospital revealed
that they had street food and tap water. There are diarrhea patients who did not have
street food.

Ms. Canson manifested that the City Health Office already identified 20 sampling
sites where there are high cases of diarrhea incidents. However, on the previous day,
said office were able to collect from 4 sites only due to time constraints. As for the age
bracket of the patients, Ms. Canson stated that, from the patients she have seen, the
age varies from 12 years old to 40s. She did not see any toddlers. The last diarrhea
patient was admitted to the hospital on July 17, 2022.

When Councilor L.J. Bonguyan asked for DCWD’s future actions in connection
with the incident, Ms. Canson manifested that DCWD will continue to monitor the
matter.

Addressing the query of P.O. Quitain Jr. on whether the patients were infected
by the same kind of bacteria, Ms. Canson clarified that there were no findings yet but
that the symptoms of the patients were the same, namely: vomiting, diarrhea and
feeling weak with low blood pressure. Additionally, Ms. Maspiñas stated that CHO
already conducted rectal swabbing on the patients.

Moreover, Ms. Maspiñas recommended to boil tap water before drinking it and to
be vigilant of the pipelines. DCWD will also be flushing its lines to cleanse their
facilities.

In addition, Councilor B.E. Al-ag urged the City to act fast because, as MS.
Canson gathered from her investigation, most of the patients ate street food. This
angle must likewise be examined. Councilor B.E. Al-ag urged CHO and DCWD to
investigate the source of the contamination from street food, artesian wells and others.

In conclusion, PO Quitain Jr. gave the task to the Vice Chairperson of the
Committee on Health, Councilor T.A. Villafuerte, to coordinate with the City Health
Office and that, if a legislation is necessary, to propose such legislative measure.

Afterwards, Councilor Ungab manifested that, according to records from the


City Health Office, the patients came from 15 different barangays and the most highly
affected age is from 0 to 5 years old.

In response to the question raised by FL Zozobrado III, Councilor Ungab


cleared that those affected by diarrhea reside in 15 different barangays all in Toril
District. However, it was not stated where such patients were immediately prior to
having diarrhea. For this reason, FL Zozobrado III suggested to CHO to include in the
investigation the location of the patients 24 hours immediately before having diarrhea.

COUNCILOR JESUS JOSEPH P. ZOZOBRADO III

Since the Body was still under Suspended Rules, FL Zozobrado III presented
the proposed Memorandum of Agreement (MOA) between the City and the Department
of Health – Drug Abuse Treatment and Rehabilitation Center (DOH-DATRC) Davao for
the use of fifty-four (54) container van type rooms installed at DOH-DATRC, Malagos,
Baguio District, this City. The motion presented by said Councilor for the approval of
the appropriate Resolution was duly seconded by Councilors J.M. Bonguyan, Braga,
Ocampo, Baluran, Militar and Alejandre.

Prior to the approval of the motion, Councilor B.E. Al-ag contended that he
had no copy of the proposed legislative measure, thus, he could not vote on it. He also
requested to be given in advance copies of proposed legislations especially those to be
passed under Suspended Rules. P.O. Quitain Jr. suggested to the Floor Leader to
prepare copies for the other Members of the Body the next time.

Proceeding with his question, Councilor B.E. Al-ag asked whether the area is
owned by the City. FL Zozobrado III answered in the affirmative then requested that a

representative of CHO be present to answer queries from the Body. Thereafter, he
withdrew the pending motion and requested the Secretariat to furnish copies of the

matter to the later part of the session to allow Atty. Janis Louis H. Esparcia, Asst. City
Administrator (Operation) to participate.

BACK TO PRIVILEGE HOUR

COUNCILOR CONRADO C. BALURAN

Speaking on behalf of persons with special concerns, Councilor Baluran raised


the point that it is the policy of the State to adopt comprehensive policies that
prioritizes the needs of persons with special concerns such as senior citizens, pregnant
women and Persons with Disabilities (PWDs) by adopting programs that guarantee their
welfare. He manifested that there have been complaints regarding the elevator in the
Sangguniang Panlungsod Building since there are times when it if filled with youngsters
and able-bodied individuals. On such occasions, persons with special concerns are
forced to use the stairs. In connection therewith, he asked that persons with special
concerns be prioritized in using the elevator. He then presented a motion, duly
seconded by Councilors J.M. Bonguyan and Braga, for the approval of the Resolution

Seizing the opportunity to thank his colleagues, Councilor Mande expressed his
heartfelt gratitude for giving the Indigenous Peoples (IPs) of the City a chance to
improve their economic and living conditions through the institutionalization of the
Iskolar ng Tribu Program (Ordinance No. 0999-22, Series of 2022). The Iskolar ng
Tribu Program endeavours to give IPs opportunity to obtain Tertiary Education.

Likewise, Councilor Mande thanked all the Higher Educational institutions in the
City for participating in the consultative proicess for the crafting of the aforementioned
Ordinance.

As an educator himself, Councilor Mande sees the need for his fellow IPs to earn
their college degrees in order to alleviate their quality of life and help their community.
Finally, he expressed the hope that the future IP professionals who will benefit from the
program will serve not only the indigenous Cultural Coomunities (ICCs) but also other
constituents of the City.

COUNCILOR LORENZO BENJAMIN D. VILLAFUERTE

Councilor L.B. Villafuerte announced that from July 17 – 223, 2022, the 44 th
National Disability Prevention and Rehabilitation (NDPR) Week will be observed. This is
a chance to focus on the health and empowerment of Persons with Disabilities (PWDs).
He also invited everyone to join in the nation’s effort towards disability prevention and
rehabilitation, to stimulate awareness on the concerns of PWDs and the promotion of
their rights.

To set an example, Councilor L.B. Villafuerte mentioned that Apolinario Mabini,


one of the country’s heroes, had a disability yet he was able to champion nationalistic
goals. In fact, he inspired the observance of the National Disability Prevention and
Rehabilitation (NDPR) Week.

In connection thereto, Councilor L.B. Villafuerte manifested that he will propose


the following legislations: 1. the Creation of a Physical t6herapy Unit in every District
Health Center; 2. the Creation of Plantilla Positions for the Stroke Rehabilitation Center
in Ilang, Tibungco, this City; and 3. An Ordinance recognizing the rights of persons with
disability, granting privileges, benefits and protection from vilification.

Following the speech of Councilor L.B. Villafuerte, Councilor Alejandre recounted
that, in 2014, he passed an Ordinance creating or maintain the primary and secondary
tourism enterprises and government offices which provide frontline services to maintain
deaf-mute desks. Unfortunately, there are no deaf-mute desks in government and
tourism establishments. He expressed the hope that said Ordinance will eventually be
implemented. PO Quitain Jr. suggested to the Members of the Body to bring up during
the Executive-Legislative Agenda (ELA) legislations that have not been implemented
since the ELA is the best venue to present such concerns to the Executive Department.

Considering that there was no more Member who wish to deliver a privilege
speech, FL Zozobrado III presented a motion, duly seconded by Councilors B.E. Al-ag,
Advincula, L’Dalodo-Ortiz and L.B. Villafuerte, to suspende the rules to continue
discussing the item deferred earlier.

CONTINUATION OF SUSPENDED RULES

COUNCILOR JESUS JOSEPH P. ZOZOBRADO III

Manifesting that all the Members of the Body were already furnished with the
copies of the proposed Memorandum of Agreement (MOA) between the City and the
Department of Health – Drug Abuse Treatment and Rehabilitation Center (DOH-DATRC)
Davao for the use of fifty-four (54) container van type rooms installed at DOH-DATRC,
Malagos, Baguio District, this City, FL Zozobrado III presented a motion, duly seconded
by Councilors Braga and J.M. Bonguyan, for the approval of the Resolution.

Before approval of the motion and after thanking the Secretariat for giving the
Members of the Body copies of the proposed legislation, Councilor B.E. Al-ag stated
that the facility was donated by the Jesus Del Rosario Foundation Inc. DOH-DATRC
requested the City to retain the container vans to be used for their day-to-day
operations. The parties agreed that the City will allow DOH-DATRC free use of the
container vans and its inclusions for as long as the former has no immediate use of the
same. However, DOH-DATRC will bear the regular preventive maintenance and repair
of the same. Since no expenses will be incurred by the City, Councilor B.E. Al-ag
expressed his support to the proposed legislative measure.

As there was no further discussion, the Resolution was approved as:
