TERMS & CONDITIONS OF HIRE

1. PAYMENT
1.1. The time of all payments shall be of the essence. Full payment shall be due and
shall be made (without any deductions set-off or counter claim) by direct bank
transfer or online payment or in person in cash, so as to be received by The
Classic Grand in cleared funds prior to the doors open time on the date of The
Hirer’s event.

1.2. If in any calendar month a sum due under this Hire Agreement is not paid on its
due date, The Classic Grand will charge The Hirer £25, and a further 10% of the
hall hire agree fee for each week thereafter in which that sum remains unpaid,
that charge being payable on demand.

1.3. In accordance with The Copyright, Designs and Patents Act 1988, Performing
Right Society (PRS) fees are payable on all ticket sales. The minimum PRS fee is
£30. If sales receipts exceed £1000, PRS fee is calculated at 3% of net ticket
sales receipts.

1.4. The Classic Grand shall be entitled to charge The Hirer a default charge of the
agreed full hall hire fee if The Hirer cancels their event within seven days of the
event date.

1.5. The Classic Grand shall be entitled to charge The Hirer a default charge of 40%
the agreed full hall hire fee if The Hirer cancels their event within thirty days of
the event date.

1.6. All deposits paid are non refundable.

1. HALL HIRE USE


1.1. The Hirer or associate parties will not remove or interfere with any of The Classic
Grand’s or external hired items and/or equipment.

1.2. The Hirer or associate parties will not deface the paintwork or decor of the hall or
interior of the The Classic Grand, add or erect any painting, sign-writing, lettering
or advertising to or on the venue without prior consent.

1.3. The Hirer or associate parties will not damage the interior of The Classic Grand
including the showers, toilets, plumbing, dressing room facilities and production
room facilities, bar areas and stage areas.

1.4. The Hirer or associate parties will not damage any items and/or equipment either
hired or owned by The Classic Grand.

1.5. The Classic Grand will have a right of access to the hall(s), dressing room,
production room areas at all times for inspection both during and after the Period
of Hire.

1.6. The Classic Grand reserves the right to retain a modest guest list of up to ten
spaces for any hired event.

1.7. The Classic Grand reserves the right to monitor ticket sales pertaining to events
in The Classic Grand.

1.8. All children or young people aged under the age of eighteen years of age are only
permitted in The Classic Grand between the hours of 10:30am until 10pm in
accordance with the The Licensing (Scotland) Act 2005. All children under the
age of eighteen years of age are not permitted on The Classic Grand premises
after the hours of 10pm. All children or young people under the age of fourteen
years of age attending an event on The Classic Grand premises, must be
accompanied by a responsible adult at all times.

1.9. The Classic Grand’s licensed hours are:


11:00 - 03:00 Mondays to Saturdays
12:00 - 03:00 Sundays

2. LIABILITIES AND LIMITATIONS


2.1. The Hirer shall be solely responsible for and hold The Classic Grand fully
indemnified against all claims, demands, liabilities, losses, damages, proceedings,
costs and expenses which may be brought against or incurred by The Classic
Grand as a result of any accident (other than death or personal injury resulting
from the negligence of The Classic Grand, The Classic Grand’s employees or The
Classic Grand’s agents).

2.2. The Classic Grand do not hire the venue subject to any condition or warranty
express, implied or statutory in connection with the fitness of the venue for any
purpose of hire and all conditions and warranties are hereby expressly excluded
to the fullest extent permitted by law. The Classic Grand will not be responsible
for any liability, claim, loss, damage, or expense of any kind or nature caused
directly or indirectly.

2.3. The Hirer shall be solely responsible for all claims, demands, liabilities, losses,
damages, proceedings, costs and expenses suffered or incurred by The Classic
Grand as a result of any breach or default on The Hirer’s part in the discharge of
obligations under the Hire Agreement.

2.4. The Hirer shall be solely responsible for all traffic offences or violations of parking
regulations involving any vehicle parked outside the venue, in connection with

The Hirer, including all fines or penalties and will indemnify the Classic Grand
Venue in respect of all such matters.

2.5. The Classic Grand is not liable or responsible for any advertising or promotional
material pertaining to the hall hire or event.

3. TERMINATION
3.1. If The Hirer or any guarantor of The Hirer obligations shall (i) fail to pay any Hire
Fee or other sum payable under the Hire Agreement in full within 14 days after it
becomes due, or (ii) commit a breach of any of the other terms of the Hire
Agreement and (if capable of remedy) shall fail to remedy such breach within 30
days after notice in writing from The Classic Grand requiring the same, or commit
breach of any other Hire Agreement or any other agreement or arrangement
presently existing or hereafter entered into between The Hirer or the guarantor
and tThe Classic Grand, or (iii) (being an individual) die or suffer an interim order
(within the meaning of the Insolvency Act 1986) to be made against The Hirer or
any guarantor or enter into a voluntary arrangement or suffer the making of a
statutory demand or the presentation of a petition for a bankruptcy order or to
make any arrangements or suffer the composition with The Hirer or any
guarantor’s creditors, or (iv) (being a limited company) enter into compulsory or
voluntary liquidation or have a receiver or administrative receiver appointed to
any part of the Hirer’s assets or suffer the presentation of a petition for the
appointment of an administrator under the provisions of Part II of the Insolvency
Act 1986. The Classic Grand may thereupon, or at any time within 3 months after
becoming aware of the same (and without prejudice to any of our other rights
and any further liability you may have to The Classic Grand Venue and even if we
subsequently accept any Hall Hires) accept that repudiation and serve written
notice on you terminating the Hire Agreement immediately and for all purposes.

3.2. Upon termination of the Hire Agreement and on the expiry of the period of hire
The Hirer will no longer be responsible for the Hire of the Hall, however the Hirer
will:

3.2.1. Pay all arrears due

3.2.2. Pay any cancellation fee(s) where applicable

3.2.3. Pay any costs and expenses incurred by The Classic Grand as a result of
termination

3.2.4. By way of agreed damages all future, confirmed hires which would have
been payable for the remainder of the Period of Hire less a discount
(calculated separately on each separate Hall Hire) for the acceleration of
payment at a rate of 2% per month.

1. COST VARIATION
1.1. Where a schedule indicates that The Hirer has been offered a special rate and
other charges (if any) set out in the Hire Agreement hereto may be varied by the
Classic Grand; The Hirer will be notified in writing by the Classic Grand of such
alteration.

2. GENERAL
2.1. No relaxation of these terms and conditions shall prejudice our strict rights or be
construed as a waiver of any of them. If any of these terms and conditions
becomes unenforceable in any respect the enforceability of the others shall not in
any way be affected or impaired.

2.2. All notices shall be in writing and shall be duly served when delivered (in the case
of personal delivery, email or letter via Royal Mail) and when despatched (in the
case of email) to the other party addressed to it at its physical address, email
address (if any) specified herein or at such address or number as it may specify
for such purpose to the other by notice in writing. A notice received on a day
other than a working day or after business hours shall be deemed to be served on
the next working day.

2.3. No variation to this Master Contract Hire Agreement shall be of any force or effect
unless in writing signed by an authorised person on behalf of each party.
