Inleiding
Inleiding
Dit is het werkboek dat hoort bij het intensieve onderwijs in het vak
Internationaal Recht. Het bevat de vragen die worden behandeld en
bediscussieerd in de werkgroepen.
NB: zie voor algemene informatie over het vak de Handleiding & Reader
Internationaal Recht 2015-2016.
Intensief onderwijs
Succesvolle deelname aan het intensieve onderwijs houdt het volgende in:
a. De student is aanwezig bij en neemt actief deel aan de
werkgroepen. De docent kan studenten die een keer afwezig of
onvoorbereid aanwezig zijn, verdere toegang tot de werkgroep
ontzeggen.
b. De student heeft de opgegeven stof bestudeerd en de vragen uit
dit Werkboek voorbereid. Hij/zij neemt actief deel aan de
discussie.
In dit werkboek zijn voor iedere week vragen en opdrachten opgenomen. Dit
zijn soms betrekkelijk eenvoudige kennisvragen, soms vragen die toepassing
van de stof vereisen en soms casusposities waarbij een creatieve oplossing
gezocht moet worden voor een complex juridisch probleem.

Voor alle vragen geldt dat een goed antwoord een aantal kenmerken heeft: het
antwoord is volledig, is opgesteld in goed Nederlands en verwijst naar de
relevante bronnen, in het bijzonder de verdragen en jurisprudentie.
IRAC Structuur
IRAC verwijst naar Issue, Rule, Analysis, Conclusion. Dit betekent dat u bij
beantwoording van de vraag eerst beschrijft wat precies de vraag is,
met andere woorden dat u de juridische vraag formuleert die ten
grondslag ligt aan het probleem.
Voorbeeld: in de casus wordt de vraag gesteld of Staat A een journalist van
een krant mag verbieden stukken te publiceren over een bepaald onderwerp.
De juridische vraag die hieraan ten grondslag ligt is of Staat A het recht op
vrije meningsuiting, zoals vastgelegd in bijvoorbeeld Artikel 10 van het
Europees Verdrag van de Rechten van de Mens, mag beperken in het geval
van de journalist.
Vervolgens moet u bepalen welke regels van toepassing zijn op deze
vraag.
Voorbeeld: bij een vraag naar de toelaatbaarheid van een gewapende aanval
van staat A op staat B zijn de regels over het verbod op gebruik van geweld
zoals vastgelegd in het VN Handvest, maar ook de regels over het recht op
zelfverdediging en de autorisatie van geweldsgebruik door de
Veiligheidsraad van toepassing.
Als derde moet u de regels toepassen op de feiten van de casus of het
vraagstuk: de analyse. Hierbij toetst u of in dit feitencomplex aan de
regels is voldaan.
Voorbeeld: bij een beroep op noodzakelijkheid als uitsluitingsgrond moet
het gaan om een essentieel belang, dat bedreigd wordt door ernstig en
onmiddellijk gevaar en er moet geen andere manier zijn om het belang te
beschermen. Is in een bepaald feitencomplex aan deze eisen voldaan?
Tenslotte beantwoordt u de vraag; u geeft een conclusie. Hierin geeft u
aan wat uw antwoord is op het in de vraag gestelde probleem. Was iets
toegestaan? Heeft een Hof rechtsmacht? Is een staat aansprakelijk?

Inleiding
Tentamenvragen
Tijdens de werkgroep zullen verschillende soorten vragen aan bod komen. Het
tentamen zal bestaan open vragen, waaronder in ieder geval een casuspositie.
De vragen en casusposities die tijdens de werkgroep besproken worden,
kunnen complexer en uitgebreider van aard zijn dan de tentamenvragen. Ook
zal er tijdens de werkgroep veel ruimte zijn voor discussie. Zoals reeds vermeld
zullen er geen standaardantwoorden beschikbaar gesteld worden voor de
vragen uit dit werkboek. Op Blackboard wordt voor zover mogelijk een
(beperkt) aantal oefententamens met modelantwoorden geplaatst.

a. Welke bronnen worden genoemd in Artikel 38 van het Statuut van het
Internationaal Gerechtshof?
i. Weens Verdragenverdrag;
ii. Resolutie 1514 van de Algemene Vergadering van de
Verenigde Naties;
iii. Bilateraal WOTS- verdrag tussen Thailand en Nederland
(WOTS is Wet Overdracht Tenuitvoerlegging
Strafvonnissen);

3. a. Leg uit aan de hand van de uitspraken North Sea Continental Shelf en
Nicaragua uit hoeveel en welke staten een bepaalde praktijk dienen te volgen
voordat die praktijk kan leiden tot een regel van gewoonterecht.
c. Wat is volgens het Hof in het advies Legality of the Threat or Use of Nuclear
Weapons (Algemene Vergadering VN) de relevantie van resoluties van de
Algemene Vergadering van de Verenigde Naties bij het vaststellen van
gewoonterecht? Is het stemgedrag van staten bij dergelijke resoluties van
belang?
e. Als één staat zich stelselmatig en expliciet verzet tegen “zich ontwikkelend
volkenrecht”. Wat zou het juridisch effect zijn van dit protest voor i) de
binding van de protesterende staat aan de eventuele gewoonterechtelijke
regel; ii) het bestaan van de gewoonterechtelijke regel als zodanig?
5. Zoals blijkt uit par. 190 van de Nicaragua zaak wordt het verbod op het
gebruik van geweld, zoals ook neergelegd in het Handvest van de Verenigde
Naties, door sommigen beschouwd als een norm van jus cogens of ‘dwingend
recht’. Een aantal andere normen wordt naar algemene opvatting beschouwd
als normen van dwingend recht. Niet alle juristen zijn echter overtuigd van
de waarde en de werkbaarheid van jus cogens. In 1991 schreef professor
d’Amato:
“If an International Oscar were awarded for the category of Best Norm,
the winner by acclamation would surely be jus cogens. Who has not
succumbed to its rhetorical power? … [I]n a recent article, … authors claim
that the right to life is a norm of jus cogens, as are the prohibitions against
torture and apartheid. Indeed, … the authors end by claiming that the
entire body of human rights norms are norms of jus cogens…. Shares
skyrocketed on all international exchanges when the World Court found in

the Nicaragua case that the international prohibition on the use of force
was "a conspicuous example of a rule of international law having the
character of jus cogens." … As usual, … the judges [do not] give the reader
the slightest clue as to how they came to know that their favorite norms
have become jus cogens norms…” (Anthony d’Amato, “It’s a Bird, It’s a
Plane, It’s Jus Cogens!”, Connecticut Journal of International Law vol. 6
(1991) pp. 1-6).

Nederlandse Antillen en Aruba in verband met drugsbestrijdingsactiviteiten;

EMBASSY OF THE UNITED STATES OF AMERICA
No. 20 The Hague, April 9, 1999
Excellency:
1. The United States of America and the Kingdom of the Netherlands, concerned about the
threat that illicit drugs pose to the health and wellbeing of people in their respective societies,
wish to stress their continued commitment with respect to cooperative measures against drug
trafficking in the Western Hemisphere.
2. To that end, the Kingdom of the Netherlands shall facilitate both ground and air access to
and use of selected airfields by United States Armed Forces and United States Government
civilian personnel, as well as United States contractors, in the Netherlands Antilles and Aruba
for the purpose of conducting counternarcotics detection and monitoring and, as appropriate,
interdiction missions.
3. Overflight clearance procedures established in the United States Embassy’s note No. 47 of
October 20, 1998, and the Ministry of Foreign Affairs’ note No. VADV-2188/98 of
December 18, 1998, shall be adhered to scrupulously.
4. United States Armed Forces and United States Government civilian personnel shall respect
the laws of the Kingdom of the Netherlands (Netherlands Antilles and Aruba). While in the
Netherlands Antilles and Aruba in connection with this agreement, United States Armed
Forces and United States Government civilian personnel shall abstain from any activity
inconsistent with this agreement; they shall enjoy immunity from the criminal, civil, and
administrative jurisdiction of the Kingdom of the Netherlands (Netherlands Antilles and
Aruba). However, such personnel shall not be immune from the civil and administrative
jurisdiction of the Kingdom of the Netherlands (Netherlands Antilles and Aruba)for acts
performed outside the course of their duties. The authorities of the United States shall give
sympathetic consideration to a request for a waiver of immunity in cases which the authorities
of the Kingdom of the Netherlands (Netherlands Antilles and Aruba) consider to be of
particular importance.
5. The Kingdom of the Netherlands (Netherlands Antilles and Aruba) shall accept as valid
driving licenses issued by appropriate United States authorities to United States Armed Forces,
United States Government civilian personnel, and the personnel of United States contractors

present in the Netherlands Antilles and Aruba pursuant to this agreement. Vehicles owned by
the United States Armed Forces need not be licensed or registered by host countries’
authorities.
6. With regard to licensing and registration of company vehicles, and the export, import, and
acquisition of goods and equipment, as well as personal effects, United States contractors and
their personnel shall be accorded the same privileges as United States Armed Forces and
United
States Government civilian personnel.
8. Unless they benefit from more favorable treatment under international law, assigned United
States Armed Forces and United States Government civilian personnel shall be allowed entry
into and exit out of the Netherlands Antilles and Aruba with appropriate United States
identification and with collective movement or individual travel orders, and be exempted from
visa requirements. United States authorities shall be prepared to provide to appropriate host
country authorities the passenger manifest of aircraft within a reasonable period of time after
arrival.
9. United States Armed Forces and United States Government civilian personnel shall be
authorized to wear uniforms and to carry arms while on duty if authorized to do so by their
orders. The carrying of arms shall be limited to the airfield, to include the designated aircraft
parking area, the broader airfield restricted area, and the weapons storage area.
10. The competent authorities of the Parties shall consult with regard to appropriate security
measures to be taken with respect to the United States Armed Forces and United States
Government civilian personnel, contractor employees, and property.
11. Products, property, material, equipment, and personal effects imported into, exported
from, or acquired in the Netherlands Antilles and Aruba in connection with counternarcotics
operations under this agreement shall be exempt from import and export fees and direct or
indirect taxation.
12. Aircraft and vessels operated by or for the United States of America shall not be subject to
the payment of landing, parking, port, navigation, or overflight charges; however, the United
States of America shall pay reasonable charges for services requested and received.
13. The United States of America and the Kingdom of the Netherlands (Netherlands Antilles
and Aruba) waive any claims (other than contractual claims) against each other for damage,
loss, or destruction of the other government’s property arising out of official activities, or for
the injury or death suffered by Armed Forces personnel and other government personnel while
engaged in the performance of their duties. In cases where one of the Parties is of the opinion
that the claim may be of unusual seriousness, the Parties shall consult. The United States of
America shall pay under applicable United States law compensation in settlement of claims by
third parties. Such claims shall be filed with the authorities in charge of United States
operations under this agreement in the Netherlands Antilles and Aruba, as the case may be.
United States authorities shall process such claims promptly, in accordance with United States
law. Contractual claims will be settled by the arrangements set forward in the respective
contracts.
14. Each Party shall facilitate the cooperative counternarcotics efforts envisioned by this
agreement to the maximum extent possible, and shall consult as appropriate.

15. Any disagreements arising out of the application of this agreement shall be settled through
consultation between the appropriate authorities, including if necessary through diplomatic
channels.
16. The Parties shall facilitate to the extent possible cooperation with other nations in the
region.
17. Recognizing that time constraints do not currently allow for more detailed arrangements,
this exchange of notes and the provisions contained therein will serve as a guide for the
development of a more definitive agreement setting forth the terms and conditions for a
continued United States cooperative presence in the Netherlands Antilles and Aruba for a
more extended time period.
18. The provisions contained in this agreement shall serve to support an initial approach to the
development of a continued cooperative United States presence subject to applicable requirements of the
Parties. Both Parties shall consider the provisions of this agreement as applying uniquely to the
activities covered by this agreement. If these proposals are acceptable to the Government of the
Kingdom of the Netherlands, I have the honor to propose that this note and your Excellency’s
affirmative note in reply, shall constitute an agreement between the United States of America and the
Kingdom of the Netherlands, which shall enter into force for a maximum period of one year on the
date of your Excellency’s note in reply. Within one year from the date that this agreement has entered
into force, the Parties intend to conclude a more definitive agreement setting forth the terms and
conditions for a continued United States cooperative presence in the Netherlands Antilles and Aruba.

The Ministry of Finance of the Netherlands and the Department of Energy of the United
States of America, hereinafter referred to collectively as the “Participants”;
Being convinced of a need to deter, detect and interdict any terrorist attempt to disrupt global
trade or to attempt to make use of commercial shipping to further terrorist schemes;
Considering that terrorists may use containers as a way of illegal transportation of nuclear and
other radioactive material;
Recognizing Rotterdam's role as an intermodal transport hub for containers originating from
and destined for many countries;
Recognizing the role of the Tax and Customs Administration (TCA) of the Ministry of
Finance for the enforcement of the Dutch Nuclear Energy Act where it concerns the import
and export of goods;
Recognizing that modern technical equipment makes it possible to monitor large numbers of
containers for nuclear and other radioactive material;
Recognizing that it is essential that the logistic process in the Port of Rotterdam should not be
disrupted; and
I. SCOPE
1. TCA intends to issue a public tender according to applicable regulations to purchase
and install the required technical means to monitor containers for nuclear and other radioactive
material in the Port of Rotterdam.
2. The Department of Energy of the United States of America (DOE), through its
National Nuclear Security Administration, intends to provide on an interim-basis, subject to
Section I, paragraph 5, to the TCA equipment and materials for use at one container terminal
in the Port of Rotterdam to monitor containers for the purpose of detecting and interdicting
illicit trafficking in nuclear and other radioactive material.
b. delivery of spare parts kits, test equipment and other maintenance equipment;

4. At the request of TCA, the DOE may provide consultative and other technical
services to support TCA’s rapid implementation of additional technical means to monitor
containers for nuclear and other radioactive material.
6. The Participants understand that the DOE will not pay any taxes or duties on
equipment provided under this Declaration. Therefore these taxes or duties will be paid by the
Ministry of Finance of the Netherlands.
III. NON-DISCLOSURE
Unless the written consent of the DOE has first been obtained, the Ministry of Finance of the
Netherlands and TCA should not transfer possession of, nor disclose technology concerning,
any equipment provided by the DOE pursuant to this Declaration, other than within the
Government of the Netherlands.

Preamble
The Nations accepting this Constitution, being determined to promote the
common welfare by furthering separate and collective action on their part for
the purpose of:
hereby establish the Food and Agriculture Organization of the United Nations, hereinafter

the measures taken and the progress achieved in the field of action set forth above.

Vragen
1. Stel: China wil het onmogelijk maken dat inwoners van China via internet
toegang krijgen tot de (voor China vaak kritische) informatie die Amnesty
International (gevestigd in London) op het internet zet. China neemt een wet
aan die bepaalt dat voor het op het internet zetten van kritiek op de Chinese
regering, voor zover die informatie in China kan worden gedownload,
voorafgaande toestemming van Beijing nodig is. De wet bepaalt ook dat voor
het zonder die toestemming op internet zetten van dergelijke kritiek een boete
kan worden opgelegd van 10,000 dollar en een gevangenisstraf van maximaal
5 jaar. De wet is uitdrukkelijk ook van toepassing op personen die dergelijke
informatie vanuit het buitenland op internet zetten.
c. Stel dat de Chinese rechter de boete van 10,000 dollar daadwerkelijk oplegt
aan Amnesty International. Kent internationaal recht China het recht toe om
voor dat bedrag beslag te leggen op goederen van Amnesty in London? Hoe
zou China dat vonnis kunnen executeren?
c. Zou de zaak anders hebben gelegen indien het Spaanse schip zich binnen
de Canadese aansluitende (contiguous) zone zou hebben bevonden?
3. Staten genieten immuniteit onder internationaal recht ten opzichte van andere
staten. Dit vloeit onder andere voort uit het beginsel van soevereine
gelijkheid, par in parem non habet imperium.
Stel dat Nederland nalatig is in het voldoen van verschuldigde betalingen aan
leveranciers van levensmiddelen aan het Nederlandse marineschip Hr. Ms. De

4. In 2009 maakte het leger van Sri Lanka met veel geweld een einde aan de
jarenlange rebellie door de zogeheten Tamil Tijgers die streden voor
onafhankelijkheid. Al snel na het einde van deze militaire operatie doken er in
de internationale media berichten op van grootschalige schendingen van het
internationale (oorlogs)recht door het leger van Sri Lanka tegenover de
burgerbevolking in de door Tamil Tijgers bezette gebieden. De president van
Sri Lanka, Mahinda Rajapaksa, staat volgens Sri Lankaans recht aan het hoofd
van het leger en hij wordt nu beschuldigd van oorlogsmisdrijven en
misdrijven tegen de menselijkheid. Rajapaksa heeft al deze aantijgingen van de
hand gewezen.
Stel dat Mahinda Rajapaksa aftreedt als president en naar Nederland reist
voor een welverdiende vakantie. Het Openbaar Ministerie in Nederland ziet
nu zijn kans schoon en besluit Rajapaksa aan te klagen voor de Nederlandse
rechter.

Stel dat het kappen van de spar onder Macedonisch recht geen strafrechtelijk
vergrijp had opgeleverd, maar wel aanleiding was geweest tot een
hoogoplopend geschil met een particulier.
d. Mag Macedonië de Duitse ambassadeur tot persona non grata verklaren? Wat
is het rechtsgevolg van zo’n verklaring?
e. Is het verenigbaar met het diplomatiek recht wanneer Duitsland over zou
gaan tot vervolging van de ambassadeur bij diens terugkeer in eigen land?

Syria protested against Israel and declared that the Israeli operation was
to international law. It declared also that it would bring the matter to
the UN Security Council. The Israeli government, on the other hand,
considered its operation to be in conformity with international law.

6. On the 20th of March 2003, the United States and the United
Kingdom launched an attack against Iraq, one and a half hours after
the US ultimatum had passed. According to the coalition, the purpose
of the war against Iraq, called Operation Iraqi Freedom, was to bring
down the regime of Sadam Hussein, which allegedly repressed the Iraqi
people, supported international terrorism and possessed and employed
weapons of mass destruction.

in eastern DRC due to ongoing destabilizing activities of foreign and
domestic armed groups, and stressing the importance of neutralizing all
armed groups, including the Democratic Forces for the Liberation of
Rwanda (FDLR), the Allied Democratic Forces (ADF), the Lord’s
Resistance Army (LRA), the Bakata-Katanga and various Mayi Mayi
groups,

the FDLR, a group under UN sanctions whose leaders and members
include perpetrators of the 1994 genocide against the Tutsi in Rwanda,

killings in Rwanda and the DRC, and stressing the importance of

Urging the Government of the DRC to remain fully committed to the
implementation of the PSC Framework, including through the adoption of a
priority action plan, and to protecting the civilian population through the
swift establishment of professional, accountable and sustainable security
forces, the deployment of an accountable Congolese civil administration, in
particular the police, judiciary, prison and territorial administration and the
consolidation of rule of law and promotion and protection of human rights,
Urging the Government of the DRC to take immediate steps to uphold its
commitment to security sector reform, including the creation and support of
a Rapid Reaction Force, the development of a roadmap for the security and
justice sectors, the development of a comprehensive Disarmament,
Demobilization and Reintegration (DDR) and Disarmament,
Demobilization, Repatriation, Resettlement and Reintegration (DDRRR)
plan, noting in this regard that the Government has proposed a new DDR
plan, all of which will require the allocation of necessary resources and a
continued commitment from the Government to prioritize reform, and
regretting that progress has been slow up to date,
Reiterating its call on all parties to cooperate fully with MONUSCO, and
its condemnation of any and all attacks against peacekeepers, emphasizing
that those responsible for such attacks must be held accountable, and
recalling its decision to extend sanctions measures outlined in paragraph 3
of the resolution 2136 (2014) to individuals and entities who plan, direct,
sponsor or participate in attacks against MONUSCO peacekeepers,
Reiterating its call upon the Secretary-General to take all measures deemed
necessary to strengthen UN field security arrangements and improve the
safety and security of all military contingents, police officers, military
observers, and especially unarmed observers,
Recognizing the significant sacrifices made by MONUSCO, commending
the active steps taken by MONUSCO, including its Intervention Brigade
acting with the support of and in cooperation with MONUSCO’s wider
Force structure, to implement fully its mandate, in particular the protection
of civilians, and encouraging the continuation of these efforts by the
Mission,
Affirming that the successful protection of civilians is critical to the
fulfilment of MONUSCO’s mandate and the delivery of an improved
security environment, in this regard, recognizing that MONUSCO has
successfully deterred attacks on civilians through its approach to protection
of civilians and welcoming the efforts made by the mission to adapt the
Force in order to enhance the delivery of the mission’s comprehensive
protection of civilians strategy, including by becoming more flexible,
versatile, and widely deployable across the whole of eastern DRC,
Underlining the importance of MONUSCO deterring any threats to the
implementation of its mandate,
Recognizing the contribution of MONUSCO to a comprehensive strategy
for durable peace and security, noting with appreciation the contribution
that MONUSCO makes to early peacebuilding and emphasizing that
MONUSCO’s activities should be conducted in a manner so as to facilitate
post-conflict peacebuilding, prevention of relapse into armed conflict and
progress towards sustainable peace and development,
Stressing the importance of the full and urgent implementation of the PSC
Framework to permanently reducing threats against civilians, noting the
need for MONUSCO to strengthen support to the government of the DRC
to enable it to address security challenges and extend state authority of the
government of DRC as expressed in paragraph 5 of the PSC Framework,
and recognizing the need for a comprehensive peace process to put an end
to the sources of conflict in the region,
Determining that the situation in the DRC continues to constitute a threat to
international peace and security in the region,
Acting under Chapter VII of the Charter of the United Nations,

3. Notes the need for a clear exit strategy, including for the
Intervention brigade, and decides that future reconfigurations of
MONUSCO and its mandate should be determined on the basis of the
evolution of the situation on the ground and, in the context of
implementation by the Government of the DRC and all other signatories of
the PSC Framework, progress towards the following objectives, in line with
the three priorities of Protection of civilians, stabilisation and support to the
implementation of the PSC framework, as set out in the mission concept:
(a) Reduction of the threat posed by Congolese and foreign armed
groups, violence against civilians, including sexual and gender-based
violence and violence against children to a level that can be effectively
managed by the Congolese justice and security institutions;
(b) Stabilization through the establishment of functional,
professional, and accountable state institutions, including security
institutions, in conflict-affected areas, and through strengthened democratic
practices that reduces the risk of instability, including adequate political
space, promotion and protection of human rights and a credible electoral
process;
4. Authorizes MONUSCO, in pursuit of the objectives described
in paragraph 3 above, to take all necessary measures to perform the
following tasks;

Monitor the implementation of the arms embargo as described in paragraph
1 of resolution 2136 (2014) in cooperation with the Group of Experts
established by resolution 1533 (2004), and in particular observe and report
on flows of military personnel, arms or related materiel across the eastern
border of the DRC, including by using, as specified in the letter of the
Council from
22 January 2013 (S/2013/44), surveillance capabilities provided by
unmanned aerial systems, seize, collect and dispose of arms or related
materials brought into the DRC in violation of the measures imposed by
paragraph 1 of resolution 2136 (2014), and share relevant information with
the Group of Experts;
Support and work with the Government of the DRC to arrest and bring to
justice those responsible for war crimes and crimes against humanity in the
country, including through cooperation with States of the region and the
ICC;
5. Authorizes MONUSCO, in support of the Congolese
authorities and their efforts to deliver the reforms called by the PSC
Framework and stabilisation in eastern DRC, to contribute to the following
tasks, in coordination with the UNCT and other actors, including through
the SRSG’s good offices;
(a) Encourage and accelerate national ownership of Security
Sector Reform (SSR) by the DRC authorities, including through the urgent
finalisation and implementation of a national strategy for the establishment
of effective, inclusive and accountable security and justice institutions by
the DRC and play a leading role in coordinating the support for SSR
provided by international and bilateral partners and the UN system;
(b) Promote peace consolidation and inclusive and transparent
political dialogue among all Congolese stakeholders with a view to
furthering reconciliation and democratization and encourage the
organization of credible and transparent elections in line with the electoral
cycle and the constitution;
(c) Encourage the consolidation of an effective national civilian
structure to control key mining activities and to manage in an equitable
manner the extraction and trade of natural resources in eastern DRC;
(d) Monitor, report and follow-up on human rights violations and
abuses, including in the context of elections, and support the UN system in-
country to ensure that any support provided by the United Nations shall be
consistent with international humanitarian law and human rights law and
refugee law as applicable;
(e) Provide good offices, advice and support to the Government
of the DRC to enable the development and finalisation of a clear and
comprehensive SSR implementation roadmap including benchmarks and
timelines to establish effective and accountable security institutions,
including vetting mechanisms;
(f) Provide good offices, advice and support to the Government
of the DRC, in compliance with the HRDDP, for a reform of the army,
including, as a first step, the establishment of a vetted, well-trained and
adequately equipped “Rapid Reaction Force” within the FARDC which
should form the nucleus for a professional, accountable, well-sustained and
effective national defence force, and support, when appropriate and in
coordination with international partners, the training of the “Rapid Reaction
Force” which should, in the frame of the benchmarks and timelines set by
the SSR roadmap, develop the capacity to assume as soon as possible
security responsibilities from the Intervention Brigade of MONUSCO;
(g) Provide good offices, advice and support to the Government
of the DRC for the design and implementation of DDR and DDRRR plans
for foreign and Congolese combatants not suspected of genocide, war
crimes, crimes against humanity or gross violations of human rights, aimed
at integration into a peaceful civilian life contributing to stable communities
in eastern DRC, while paying specific attention to the needs of children
formerly associated with armed forces and groups;
(h) Provide good offices, advice and support to the Government
of the DRC, in close cooperation with other international partners, to build
on the Government’s STAREC and revised ISSSS to support the
establishment of a minimum level of sustainable state authority and control
in conflict-affected areas in eastern DRC, including through area-based
efforts to improve security, state authority and enable the commencement
of sustainable socio-economic recovery;
(i) Provide good offices, advice and support to the Government
of the DRC for the reform of the police, including by contributing, in
compliance with the HRDDP, to the provision of training to battalions of
the Congolese National Police (PNC);

(j) Provide good offices, advice and support to the Government
of the DRC for the development and the implementation, in accordance
with the Congolese strategy for justice reform, of a multi-year joint United
Nations justice support programme in order to develop independent
criminal justice institutions and processes, the police, the judiciary and
prisons in conflict-affected areas;
(k) Provide good offices, advice and support to the Government
of the DRC to promote human rights and to fight impunity, including
through the implementation of the Government’s “zero tolerance policy”
with respect to discipline and human rights and international humanitarian
law violations, committed by elements of the security sector;
(l) Continue to collaborate with the Government of the DRC in
the swift and vigorous implementation of the action plan to prevent and end
the recruitment and use of children and sexual violence against children by
FARDC, and continue dialogue with all listed parties to obtain further
commitments and work towards the development and implementation of
time bound action plans to prevent and end the recruitment and use of
children in violation of applicable international law and other violations of
international humanitarian law;
6. Reiterates that multi-dimensional peacekeeping requires a
comprehensive approach, and requests MONUSCO’s military and civilian
components to focus on a coherent division of labour in accordance with
their respective comparative advantages and available capacities;
7. Stresses that integrated action on the ground by security and
development actors requires coordination with national authorities in order
to stabilize and improve the security situation and assist in restoration of
State authority, and underlines the importance of integrated efforts among
all United Nations entities in the field to promote coherence in the United
Nations’ work in conflict and post-conflict situations

Hamester te investeren in de cacao-industrie in Ghana. Het zette
bedrijven op voor de verwerking van cacaobonen tot chocolade en
andere producten. Om dit te kunnen doen moest Hamester een
overeenkomst sluiten met de Ghanese Cacaobond, Cocobod. Cocobod
is weliswaar geen staatsorgaan, maar het is onder Ghanees recht wel
verantwoordelijk voor de inkoop van cacaobonen van Ghanese
cacaoboeren en vervolgens voor de verkoop en export van deze bonen.
Cocobod heeft een groot aantal taken, waaronder het reguleren van de
marketing en export van cacao, koffie en sheabonen, het bevorderen
van export van cacaobonen en het bestrijden van ziektes bij
cacaobonen, maar ook het afsluiten van commerciële transacties voor
verkoop en export van cacaobonen, koffie en sheabonen. Het
vervullen van deze taken is bij wet vastgelegd. Hamester was
afhankelijk van Cocobod voor de levering van cacaobonen om deze te
kunnen verwerken tot chocolade en andere producten. In het begin
verliep de samenwerking tussen Hamester en Cocobod zonder
problemen, maar na enige tijd ontstonden er conflicten over betaling
en levering van cacaobonen.
b. Is het relevant dat het bedrijf in kwestie niet Roemeens is, maar
Australisch?
