AFFIDAVIT OF UNDERTAKING

I, --------------------------, Filipino of legal age, married and a resident of Sun St. Tumaga,
Zamboanga City, after having duly sworn to in accordance with law do hereby depose and say:
1. That I am a co-owner of the property located at Zamboanga City covered in the
Transfer Certificate of Title No. -----------, containing an area of 6.8777 hectares.
2. That the said property was mortgage to Luzoñ Surety Co. Inc., sometimes on 1965 to
secure the loan amounting to Five Thousand Pesos P5,000.00.
3. That the said mortgage/loan was already fully paid by the Mortgagor sometimes in
1974. However, prior to the execution of Deed of Release of Real Estate Mortgage,
the Mortgagee close its business and it can never be located.
4. That the evidence that the loan/mortgage was already paid is that Transfer Certificate
of Title was already in the hand of the Owner, where usually the said title will be in
the hand of the Mortgagee in case the mortgage is still existing.
5. That I execute this affidavit in order to attest the truthfulness of the foregoing and in
support of my application to partition the said property.

IN WITNESS WHEREOF, I have hereunto affix my signature this 15th day of October
