6. Reasons for this Request :

The contractor, ROLCO CONSTRUCTION & DEVELOPMENT CORPORATION

in its letter dated May 03, 2017 requested for approval of Contract Time Extension
No. 1 due to work suspensions covering the period from March 30 to April 28, 2017
or equivalent to thirty (30) calendar days.

Per evaluation based on the attached documents, i.e. (1) Certification from the
Barangay Captain/City or Municipality Mayor that there is RROW problem and
the affected owners do not allow the entry of the contractor to their property; (2)
Geotagged pictures (with caption) of the site with RROW problem; (3) Certified True
Copy of Permit to Enter/writ of possession; (4) List of Properties/Lots/Structures
affected by RROW and with the recommendation of the Project Engineer.

Hereunder is the tabulated suspended days for the period March 30 to April 28, 2017
derived from the attached Approved Suspension and Resume Orders:

10. Remarks:

On the basis of the submitted documents indicated in the Checklist of Supporting

Documents and Attachment for DoTS, this Office finds this request for Contract
Time Extension No. 1, equivalent to thirty (30) calendar days to be meritorious
since the delayed implementation of the project due to acquisition of property to
be used as right-of-way (ROW) which greatly hindered the implementation of the
project to the detriment of the general public is not the fault of the contractor
and beyond the control of the Implementing Office. The said request is in
accordance with the provision of Sub-Section 10.3 and 10.5 of Annex “E” of the
Revised IRR of R.A. 9184, to quote:

10.3. Extension of contract time may be granted only when the affected
activities fall
within the critical path of the PERT/CPM network.

10.5. Extension of contract time shall be granted for non-acquisition of permit to

enter private properties within the right-of-way resulting in complete paralyzation
of construction activities
considered unfavorable for the prosecution of the works at the site, based on
the actual conditions obtained at the site, by the government in relation to the
original contract time during the conduct of detailed engineering and in the
preparation of the contract documents as agreed upon by the parties before
contract perfection ….. and other

meritorious causes as determined by the Government's authorized Engineer and

approved by the procuring entity ….. among ….. The written consent of
bondsmen must be attached to any request of
the contractor for extension of contract time and submitted to the procuring
entity for consideration and the validity of the performance security shall be
correspondingly extended.

Based on the approved PERT/CPM Network Diagram, the items of Work within
the Critical Path that are affected by the suspension of works are; Item 102(2)
– Surplus Common Excavation; Item 103(3) – Foundation Fill; Item
104(1)a - Embankment from Roadway Excavation (Common Soil); Item
404(1)a – Reinforcing Steel Grade 40, Item 405(1)a2 – Structural
Concrete Class A; Item 506(1) – Stone Masonry.

With this proposed Contract Time Extension No. 1, the contractor has executed
an Affidavit of Quit Claim that they will not file any monetary/financial claim.

In view of the above premises, the request for Contract Time Extension No. 1
equivalent to thirty (30) calendar days is respectfully recommended pursuant to
D.O. No. 144, Series of 2016 and DO 106 Series of 2018, for the District
Engineer’s consideration and approval, subject however to the condition that
the written consent of bondsmen must be submitted and the validity of
the performance security shall be correspondingly extended in
accordance with the above mentioned provision of Sub-Section 10,5 of
Annex E of the Revised IRR of R.A. 9184.
