Your quotation / quotations shall be placed in the relevant tender box; which is placed in the Internal Audit Department of the Head Office of the State
Pharmaceuticals Corporation. prior to closing date and time indicated above. (Any late delivered / submitted bids will be rejected without accepting)
Tender Samples, with clear indication of the Tender No, shall be handed over to the Administration Department on or before the closing of tender and
acknowledgement of such samples should be attached to the quotation (bid).
SPC reserves the right to call samples from bidders who have not submitted samples before closing of the tender in cases of none of the bidders had
submitted samples, evaluators are with the opinion of calling samples from bidders who have not submitted samples and / or the Procurement committee
is with the opinion of calling of samples from the bidders who have not submitted samples will help them to make a cost effective decision.
Note
1. Please indicate the current market whole sale and Retail prices in your quotation (bid)
2. Your Quotation (bid) shall be submitted in one original and one duplicate, sealed separately and marked as “ORIGINAL” and “DUPLICATE”
respectively. Both envelopes shall be enclosed in one envelop and deposited in the tender box kept in the Internal Audit Department.
3. In case if the supplier / manufacturer is not registered with NMRA – Sri Lanka, please provide following details together with the bid
(Quotation)
i) GMP certificate
ii) Certificate of Pharmaceutical Products
iii) Manufacturer’s information letter
iv) Certificate of Analysis of the Product
Bid Bond should be submitted together with the Bid or to reach SPC on or before the closing date and time of Bid.
The Bid Bond should be valid for at least 60 days beyond the validity of the Bid. (The amount of bid bond is indicated against
each item of the Bidding Document)
The Bid Bond shall be as per specimen at Annex I and shall be issued by one of the following institutions.
i. A Commercial Bank operating in Sri Lanka, approved by the Central Bank of Sri Lanka.
ii. ii. A Bank based in another country but the security or guarantee “Confirmed” by a Commercial Bank operating in
Sri Lanka.
iii. iii. A Letter of Credit issued by a Foreign Bank, but ‘Confirmed’ by a Commercial Bank operating in Sri Lanka.
iv. iv. Any other Agency approved by the Treasury from time to time.
Or
v. A cash deposit
Bids which do not comply with this requirement will be rejected. If Procurement Committee makes a request to extend the validity
of the Bid Bond, the bidder may have to honour that request.
CONDITIONS OF SUPPLY
1. The Product should have minimum of 15 months / 12 months shelf life at the time of delivery at Medical Supplies Division (As indicated under “Delivery” of
each item in the above schedule)
2. Description of item, Date of manufacture, Date of expiry, Batch No, Name and address of manufacture Should be clearly marked on the outer covering
containing the item and on the outer cover of the carton/box.
3. Offers for any other economically viable pack sizes different from the specify pack sizes are acceptable with the prior approval of Director Medical Supplies
Division.
4. MSD Order List No, SR No. of Item, SPC Indent No/purchase order no Description and storage condition of item and Batch No shall be indicated in all Supply
Invoices.
5. Storage condition of the items should be clearly indicated in the inner most and outer most carton labels.
6. Cold chain monitors should be included for each cartons and the cold chain should be maintained according to the manufacturer's instructions during
storage, transport and delivery.
9. Standard- any other pharmaceutical standard accepted by cosmetics, devices and drugs regulatory authority in Sri-Lanka for registration of pharmaceutical
item also acceptable.
10. In the event that item is awarded to unregistered bidder, the NOL/PUL issued by NMRA should be submitted when item is delivered. If not, payment will
not be released for the delivered item. (In case of applying for NOL, relevant fee due to NMRA shall be borne by the supplier)
11. In the event of failing to supply the item within the delivery schedule given the Purchase order the item will not be accepted by MSD. However, if the item
is still required by Medical Supplies Division and decides to accept the same , a penalty of 0.1% of the total value per day up to 7 days(total of 0.7% for 1st
7days of late delivery), 0.3%per total value per day from 8th to 14th (another 2.1% for 7 days from 8th to 14th day of late delivery),0.5% per total value per
day from 15th to 21st day (another 3.5% for the period from 15th to 21st day of late delivery) for the lapsed period will be deducted from your payment as
liquidated damage.
In case of an item delivered after 3 weeks, if the item is still required MSD reserves the right to accept maximum penalty of 10% of the total value will be
imposed.
12. In addition to the condition given herein any other relevant condition as per the tender document issued by SPC are also applicable.
13. IN CASE OF AWARD, DELIVERY OF SPC MAIN ORDER(S) WILL BE CONSIDERED PRIOR TO RELEASEING THE INDENT / PURCHASE ORDER FOR THE LOCAL
SUPPLY
Annex 1
SPECIMEN FORM OF BID SECURITY (BID BOND)
By this Bond We ………………………………………………………………………………………… (hereinafter called “the Bidder”) and We (name of bank or insurance company) whose registered office is at

(hereinafter called “the Authority”) in the sum of for the payment of which sum the Bidder and the Surety bind themselves their successors and assigns jointly and severally by these presents.
Whereas the Authority has invited the Bidder and other persons to complete bids in similar terms for the supply of …………………………………………………………………………… to submit the same for the
consideration of the Authority, and the Bidder proposes to submit to the Authority a bid (hereinafter called “the Bid”) in accordance with such invitation, the Bond shall provide security to the
Authority that the Bidder will honour certain obligations to be undertaken by him in the Bid in accordance with the following conditions.
(a) that it shall remain in full force and effect until the earliest of
(i) (date), being ( ) days from (submission date), the date stipulated by the Authority for the submission of bids, or any prolongation of such date above notified to the Authority by the Bidder
and the Surety in writing;
(ii) in the event of acceptance of the Bid by the Authority, the date upon which the Bidder provides a performance security to the Authority in accordance with the terms of the contract
thereby made between them, or
(iii) in the event of acceptance by the Authority of a bid for the Works from a third party, the date upon which such third party provides the relevant performance security.
(b) subject to this Bond being in full force and effect, the Surety shall pay the full amount specified in this Bond upon receipt of first written demand from the Authority stating that
(i) the Bidder has withdrawn his Bid during the validity of this Bond, or
(ii) the Bidder has failed to provide a performance security to the Authority in accordance with the terms of the contract between them upon acceptance of the Bid.
No alteration in the terms of the Bid, nor any forbearance or forgiveness in or in respect of any matter or thing concerning the Bid on the part of the Authority, nor any objection from the bidder shall
in any way release the surety from any liability under this Bond.
The benefit of this Bond shall not be assignable by the Authority and upon its ceasing to be in full force and effect the Authority shall return the same to the Bidder.
