AFFIDAVIT OF ADVERSE CLAIM

We, SPOUSES BERNARD B. VILLALUZ and JOCELYN G. VILLALUZ, of


legal age, Filipino, residents of Brgy. Concepcion, Tagkayawan, Quezon Province,
after having been sworn to in accordance with law, hereby depose and say:

1. That we are the registered owners of a property with Transfer Certificate of


Title (TCT) No. 057-2015022987, more particularly described as follows:

“A PARCEL OF LAND (LOT 2, BLOCK 10, OF THE CONS.-SUBD.


PLAN, PCS-04-026017, BEING A PORTION OF THE CONS. OF LOT
3877-A-3-A & LOT 3877A-3-B. (LRC) PSD-132014 AND LOT 3877-A-4-
A, PSD-04-188053), SITUATED IN THE BARANGAY OF (MALINTA)
NOW SAMPALOC – 2, MUNICIPALITY OF DASMARINAS,
PROVINCE OF CAVITE, ISLAND OF LUZON. BOUNDED ON THE
SE., ALONG LINE 1-2 BY LOT 1, BLOCK 10; ON THE NW., ALONG
LINES 2-3-4-5 BY ROAD LOT 3-A; ON THE NW., ALONG LINES 5-6-7
BY ROAD LOT 8; ON THE NE., ALONG LINE 7-8 BY LOT 4; AND ON
THE SE., ALONG LINE 8-1 BY LOT 3, BOTH OF BLOCK 10; ALL OF
THE CONS.-SUBD. PLAN. BEGINNING AT A POINT MARKED “1”
ON THE PLAN, BEING N. 04 DEG. 58’W., 1859.22 M. FROM MON.
NO. 84, IMUS ESTATE; THENCE S. 76 DEG. 28’W., 9.95 M. TO POINT
2; THENCE N. 24 DEG. 24’E., 4.70 M. TO POINT 3; THENCE N. 14
DEG. 33’E., 5.74 M. TO POINT 4; THENCE N. 04 DEG. 38’E., 2.51 M.
TO POINT 5; THENCE N. 40 DEG. 33’E., 4.00 M. TO POINT 6; THENCE
N. 76 DEG. 28’E., 8.34 M. TO POINT 7; THENCE S. 13 DEG. 32’E.,
13.50 M. TO POINT 8; THENCE S. 76 DEG. 28’W., 8.00 M. TO THE
POINT BEGINNING, CONTAINING AN AREA OF ONE HUNDRED
EIGHTY TWO (182) SQ. M. ALL POINTS REFERRED TO ARE
INDICATED ON THE PLAN BEARINGS: TRUE; DATE OF ORIGINAL
SURVEY, JULY 27, 1905 TO JUNE 11, 1908, AND THAT OF THE
CONS.-SUBD. SURVEY, DEC. 01-20, 2009, AND WAS APPROVED ON
MAY 26, 2010.”

2. That a Deed of Absolute Sale was made to appear to have been executed
between us, as the Sellers, and Maristel B. Sales, as the buyer, on 27
December 2018;

3. That the said Deed was registered and annotated with the aforesaid TCT;

4. That, in view of the said Deed, the aforesaid TCT was cancelled and that
another TCT was issued in the name of the purported buyer;

5. Said TCT is aptly more described as follows:

6. That the we executed a Joint Affidavit, dated 18 January 2021, indicating,


among other things, that we never transacted with the purported buyer;

7. A copy of such Joint Affidavit is heretofore attached and made integral part
hereof;

8. That our were forged and that we never signed a Deed of Absolute Sale with
Maristel B. Sales;

9. That unless an Adverse Claim is annotated on the above-described TCT No.


057-2015022987 or the TCT referred to in the 4 th paragraph of this affidavit,
the said registered owners named under TCT No. 057-2015022987 are in
danger of being defrauded by third (3rd) persons, as what had happened;

10.We are executing this Affidavit in support of our request for annotation of an
adverse claim over the parcel of land described above.
