EXECUTIVE ORDER 017-2021

AN ORDER REORGANIZING THE MEMBERS OF BANTAY DAGAT OF THE MUNICIPALITY OF PINAMALAYAN,

ORIENTAL MINDORO

WHEREAS, Republic Act 7160, otherwise known as Local Government Code of 1991, mandates the local
government unit to adopt measures to protect the coastal and marine environment within their respective jurisdiction;

WHEREAS, Republic Act 8550 or the Philippine Fisheries Code of 1998, similarly mandates the local
government units to enforce laws and regulations relative to the protection of the coastal and marine resources;

WHEREAS, Fifty Seven (57) Bantay Dagat members of the Municipality of Pinamalayan were appointed by
virtue of Executive Order No. 017-2019 dated July 30, 2019;

WHEREAS, there is a need to reorganize the membership of Bantay Dagat to replace some inactive
members and to appoint additional members.

NOW, THEREFORE, I, ARISTEO A. BALDOS, JR, Local Chief Executive of Municipality of Pinamalayan, by
virtue of the powers vested in my by law, do hereby order the reorganization of the members of Bantay Dagay of
Pinamalayan, Oriental Mindoro, as follows:

Section 1. APPOINTMENT OF BANTAY DAGAT. The following are appointed as Fish Bantay Dagat of the
Municipality of Pinamalayan, Oriental Mindoro, to wit:

Section 2. DUTIES AND FUNCTIONS. The Bantay Dagat shall perform the following duties and
functions;
1. Enforce fisheries and environmental laws in the coastal areas of the Municipality of Pinamalayan,
Oriental Mindoro;
2. Do Citizens’ arrest as provided by the rules, regulations and laws in the Rules of Court;
3. To sign activity reports relative to the performance of their functions and duties as deputized Bantay
Dagat;
4. To file complaints against illegal fishers and environmental cases in the proper venue;
5. Perform other functions that may deemed necessary.
Section 3. SECRETARIAT. This Office of the Municipal Agriculturist shall serve as the focal office or
secretariat of the Bantay Dagat Team and shall perform the following functions:

1. Assist the team in enforcing fisheries and environmental laws in the coastal areas of the Municipality of
Pinamalayan, Oriental Mindoro;
2. Assist the team in apprehending fishery laws violators;
3. Monitor the performance of the Bantay Dagat Team;
4. Provide technical assistance such as trainings, mentoring and coaching relative to the performance of
their duties and functions as Bantay Dagat;
5. Perform other functions that may deemed necessary.
 Section 4. HONORARIA. Appointed Bantay Dagat shall receive an honoraria amounting to One Thousand
Five Hundred Pesos (Php 1,500.00) monthly, subject to availability of funds.

Section 5. REPEALING CLAUSE. All prior issuances on the appointment of Bantay Dagat inconsistent
herewith shall be deemed superseded by this Order.

Section 6. EFFECTIVITY. This Executive Order shall take effect on June 1, 2021.
