Kindly refer to the memorandum No.F.1(9)/FSL/Estt./PF/2010/Pt.File-III/1147 dated 21/09/21.

In
this regard, a reply is humbly submitted and It is worthy to mention that:
● The referred email dated 18.08.2021 was concerned with seeking necessary
directions/guidance/advice from my competent senior officers i.e. Director, FSL, I/C
RFSL and your goodself regarding urgent disposal of a LVA case report being pursued
verbally & in writing by ACP, AHTU Crime Branch office since past more than a year
consistently;
● Several memorandums and office communications citing utmost priority and urgency for
disposals were served to me persistently by FSL office taking cognizance of, referring
and forwarding the communications received from ACP, AHTU office;
● Certain FSL officers with a malafide intention used this routine report query as an
opportunity to camouflage and justify their unusual actions of intrusion, unauthorised
access, breaking open my case Almirahs, and taking possessions of my classified case
files & records for future manipulations, just taking excuse in the name of handing over
my already reported case report, in response to the communications received from ACP,
AHTU office;
● I had always coordinated and cooperated for smooth functioning and tried my level best
to avoid complicating the matter any further and sought necessary guidance and
facilitation. I humbly suggested for reissuing the report once again from retrieved soft
copy of the already reported case but the disposal/direction/guidance/advice sought is
still pending;
● ACP, AHTU office is neither an outside agency nor I pressed any claim or sought
redressal of any of my grievances against any FSL office issue; rather it is my duty as a
public servant for responding to a public office whom I am accountable, and who was
already in loop of office communications & is authorized to receive them with reference
to the report of the case forwarded & submitted by that office.
● As a responsible reporting officer and govt. official, it is my duty to keep the concerned
public office aware of the proceedings in relation to timely disposal of their cases and
reports;
● ACP, AHTU office was informed neither to press any claim nor I sought redressal of any
of my grievances against my service rights or conditions, rather it is my duty as a
responsible reporting officer and public servant for responding to a public office to which
I am accountable, and which was already in loop of office communications & is
authorized to receive them with reference to the timely disposal of the case and report,
forwarded & submitted by that office.
● In the recent past, there had been incidents where due to deliberate communication
gaps manipulated between the reporting officer and concerned police authorities had
resulted in adverse remarks and recommendations for action against the reporting
officer by Hon'ble Court, due to submission of misrepresented facts and unverified
information by some third person with malafide intentions. These records are being
misused by the FSL officers at various forums and even in court proceedings against the
reporting officer to serve their vested interests.
In the light of above facts, it is my humble duty as well as right to inform the concerned public
offices, in the present case ACP, AHTU office, about all the proceedings and best efforts that
are being made for disposal of their case report at the earliest.
Hence, the DOPT OM dated 31.08.2015 is not applicable in this situation, and is issued on the
basis of wrong interpretation of the said OM. Therefore, you are hereby requested to kindly
withdraw this memorandum and arrange to guide/advise and facilitate me for earliest disposal of
the concerned report and related communications submitted in your good office.
Furthermore, I reserve my right to submit replies on other non-consonant issues covered in the
said memo at appropriate times.
