AN ORDINANCE DECLARING THE MONTH OF
OCTOBER EVERY YEAR AS INDIGENOUS PEOPLES
MONTH IN BUTUAN CITY, AND FOR OTHER
PURPOSES
EXPLANATORY NOTE
WHEREAS, Republic Act No. 8371, otherwise known as the Indigenous Peoples
Rights Act of 1997 (IPRA LAW), was promulgated to promote the general welfare and
propagate the rich cultural heritage of the Indigenous Peoples/Indigenous Cultural
Communities ((IPs/ICCs);Page two

WHEREAS, Presidential Proclamation No. 1906 series of 2009 declares October of
every year as National Indigenous Peoples Month in observance of the Mandate of the
Constitution;
WHEREAS, such proclamation upholds the right and active participation of the
Indigenous Peoples in developing, promoting and preserving the indigenous cultural
communities, this as well molds social, physical, intellectual, spiritual and mental aspects of
the indigenous peoples;
WHEREAS, Section 16 of Republic Act 7160, also known as The Local Government
Code of 1991, mandates the local government unit to “ensure and support among other
things the preservation and enrichment of culture”;
WHEREAS, the significance of enriching and preserving the local heritage of a
people, which encompasses their common history and culture, is also enshrined in the 1987
Philippine Constitution, Article XIV, Section 14. “The State shall foster the preservation,
enrichment and dynamic evolution of a Filipino national culture based on a principle of unity
in diversity in a climate of free artistic and intellectual expression.”
WHEREAS, the City Government of Butuan endeavors to establish necessary
‘mechanisms to ensure the protection and promotion of the rights, culture and traditions of the
Indigenous Cultural Communities (ICCs)/ Indigenous Peoples (IPs) pursuant to the
abovementioned laws, by declaring the month of October each year as Indigenous Peoples
Month in Butuan City;
Be it ordained by the Honorable SangguniangPanlungsod in session
assembled and by authority of the same that:
SECTION 1. ALTERNATIVE TITLE. This ordinance shall likewise be known as
INDIGENOUS PEOPLES MONTH IN BUTUAN CITY ORDINANCE;
SECTION 2. POLICY STATEMENTS - The Local Government of Butuan City:
a, recognizes and promotes the rights of ICCs/IPs within the framework of national
unity and development;
b. recognizes, respects and protects the rights of ICCs/IPs to preserve and develop
their cultures, traditions and institutions;
c. institutes and establishes the necessary mechanisms to enforce and guarantee the
realization of these rights, taking into consideration their customs, traditions,
values, beliefs, interests and institutions.
SECTION 3. DECLARATION OF INDIGENOUS PEOPLES MONTH IN
BUTUAN CITY. In view of the local historical and socio-cultural significance of the
Indigenous Peoples in the City of Butuan, the month of October every year is hereby
declared as Indigenous Peoples Month in Butuan City;
SECTION 4, SEPARABILITY CLAUSE. Should any provision of this ordinance
be declared unconstitutional by any competent court, the remaining provisions shall remain
valid and legal.
SECTION 5. REPEALING CLAUSE. Any ordinances, resolutions and issuances,
or parts thereof, inconsistent with any of the provisions of this ordinance are hereby repealed,
amended or modified accordingly.Page three

SECTION 6, EFFECTIVITY. This Ordinance shall take effect immediately upon
its approval.
LET COPIES OF THIS ORDINANCE be furnished the Offices of the City Mayor,
the City Administrator, the Office of the Indigenous Peoples, and the National Commission
of Indigenous Peoples — Caraga Region, all of Butuan City, for information and appropriate
action.
