MOTION TO RESET HEARING

DEFENDANTS, through the undersigned counsel and to this Honorable Court

most respectfully state that:

1. As stated in the previous Order, the hearing of this case for has been set
on 10 June 2022 at 8:30 o’clock in the morning to give sufficient time for
the amicable settlement of the case considering that the election was
approaching and there was yet no certainty as to who will be next official
in the Local Government Unit (LGU) of Pantukan, Davao de Oro;

2. However, the undersigned counsel hereby regretfully informs the

Honorable Court that while there are already newly elected officials in the
LGU, assumption to their respective office will only begin on July 1,
2022;

3. The undersigned counsel is yet to apprise the newly elected officials

regarding the status of the instant case since they will officially assume
on the date above-mentioned;
 4. With this, the undersigned is constrained to respectfully request the
Honorable Court to reset the hearing of the instant case to another date,
subject to the availability of the Honorable Court’s calendar;

5. A Copy of this Motion was electronically transmitted on 2 June 2022

with a copy furnished to the plaintiffs’ counsel;

6. This motion is made in good faith and not intended to delay the
proceedings of the instant case.

WHEREFORE, based on the premises presented, it is most respectfully

prayed that the hearing of the instant case be reset to another date, subject to the
availability of the Honorable Court’s calendar.

This is hereby submitted today, 2 June 2022, in Tagum City, Davao del Norte,
for Mabini, Davao de Oro, Philippines.
