SCOPE OF WORK

The contents of this section centers on the work of Contractor: Group 3 for the Project 1-Storey
Residential House. The contractors hereby claim responsibility for providing all necessary equipment,
tools, manpower including its proper supervision, testing devices, mobilization and transport of
necessary materials, installation of consumable supplies services, and all other costs pertaining to the
Pre-construction works, Structural Works, Architectural works, and etc. The specifications of the
equipment and materials, as well as the methodologies to be employed are provided within this section.

I. Site preparation

- The required facilities, equipment, manpower, materials, their mobilization and


transport, etc. essential for the implementation of the site preparation will be provided
by the Contractor.

1. Clearing and Grubbing


- The Contractor will provide all necessary equipment and tools required to
implement the clearing and grubbing of the site, along with the manpower, their
safety equipment, supervision, and etc. The contractor will complete the following
tasks: removal and disposal of trees, stumps, roots, logs, shrubs, grass, weeds, fallen
timber, miscellaneous surface litter, wherever they occur within the specified areas
staked out by the engineer.

1.1 Specifications:

a.) Equipment:
⮚ Backhoe – The contractor will provide 1 backhoe, along with 1
operator and 1 assistant laborer. It will be mobilized on site for 3
days to cover any necessary excavation for the clearing and
grubbing.
⮚ Dump Trucks – a 10 cubic meter dump truck will be mobilized
for 5 working days to dispose of waste materials at the end of
every day.
⮚ Wheelbarrows – The contractor will provide 15 wheelbarrows.

⮚ Ropes, cables, chains and pulleys

⮚ Miscellaneous hand tools, including:


o Shovels,
o Trowels,
o Pry bars,
o Axes
o Etc.
⮚ Safety equipment including:
o Gloves,
o Hard hats,
o Work boots,
o Etc.
b.) Methodology
⮚ The site will be divided into three major areas, (east, middle,
and west). The clearing and grubbing work will be started in the
east area first.
⮚ All identifiable vegetation within the site will be uprooted and
disposed of; trees will be cut down and roots taken out, except
the ones specified to be left alone by the engineer and owner of
the project. The contractor will obtain a burning permit
beforehand, and thus the collected organic material will be
burned on-site, in the area farthest from the direction of the
public right of way and from any nearby trees and shrubs.
⮚ The Contractor will remove pre-existing concrete, rebars,
boulders, jutting rocks, and protruding topsoil from the grade
line, and other materials on site. These will be collected and
piled in the east side of the site, so as to make it accessible to
dumptrucks for disposal.
⮚ The burning of vegetative materials and the disposal of solid
materials (concrete, soil, rocks, etc.) will be carried out
simultaneously before the end of every working day, at around
4pm.
⮚ The clearing and grubbing is estimated to be completed within 5
working days.

2. Installation of Temporary Facilities


- The contractor will put up and install temporary facilities to aid in the construction
phase of the project. This includes public comfort rooms, storehouse, barracks, etc.
The contractor will provide the necessary equipment and manpower necessary to
complete this task.

2.1 Specifications:

a.) Equipment & materials:


⮚ Pickup trucks – The contractor will also provide 1 driver and
1 assistant along with every truck. 2 trucks will be deployed
for the first 5 days to facilitate the transport of materials.
⮚ Concrete mixer – The concrete mixer will be mobilized for 2
days to facilitate the construction of some temporary
facilities such as restrooms, and storehouses.
⮚ Wheelbarrows and pushcarts

⮚ Ropes and cords – Ropes and cords made of nylon and


assortment of natural fibers, with typical diameters of 10
mm, will be provided for use in various scenarios, such as
hoisting materials, construction of scaffolds, etc.
⮚ Nails and bolts – The nails and bolts will be provided as
specified in the plans.
⮚ Safety equipment including:
o Gloves,
o Hard hats,
o Work boots,
o Etc.
⮚ Miscellaneous handtools:
o Hammers
o Tamping tools,
o Levels.
o Etc.

b.) Methodology
⮚ An area to the east of the construction site will be dedicated as the
main location for temporary storage and deployment of equipment
and materials.
⮚ As specified in the plan, the temporary facilities will be erected by
the south-east side of the site, closer to the road.

⮚ The contractor will prioritize construction of the following


temporary facilities in this particular order:
a.) Storehouses - erected as soon as possible to accommodate for
the storage of materials.

b.) Restrooms - erected simultaneously with the storehouses, to be


completed within the first day upon arrival of materials.

c.) Barracks - erected as soon as the restrooms are completed.


Expected to be finished within the 3 days.

d.) Field office - to be constructed simultaneously with the barracks.

II. Earthworks
– The Contractor will provide the necessary equipment, tools, manpower, mobilization, and
etc. to accomplish the following tasks under earthworks.
1) Excavation
- The contractor shall perform all excavations true to lines, widths and
depths shown on the Drawings or to such further lines, depths or
dimensions as may be directed by the Engineer.
a) Specifications:
i) Equipment/Materials
(1) Dump Trucks - The contractor will provide 1 truck with 1
driver and 1 assistant to mobilize and dispose of the
excavated materials.
(2) Wheelbarrows - These will aide transport for excavated
materials from the
(3) Safety Equipments includes:
(a) Gloves,
(b) Hard hats,
(c) Work boots,
(d) Etc.
(4) Other essential equipment
(a) Shovel,
(b) Pickaxe,
(c) Levels,
ii) Methodology
(1) The site shall be divided into two working areas which
compose of area A(A-B in reference to drawing plans)
and B(B-C in reference to drawing plans)
(2) Necessary markers shall be put in place before digging
can commence.
(3) The contractor will commence digging in specification
stated in the drawing plans
(4) Excavation shall start from Area A and finish at Area B.
(5) Excess or unwanted materials that are not necessary for
backfilling shall be disposed of in accordance with local
authorities mandates.
(6) Excavation is estimated to be complete in 3 working
days
2) Backfilling
- The contractor shall proceed with backfilling once the concrete has
sufficiently cured. Materials, equipment, manpower, etc. will be
provided by the contractor to accomplish backfilling.
a) Specifications
i) Equipment/Materials
(1) Wheelbarrows - Wheelbarrows will be the means of
transportation for filling materials to necessary
excavated sites or stations.
(2) Portable Compactor - The contractor shall provide 2
portable compactors to be used to compact loose
backfill materials.
(3) Safety Equipments includes:
(a) Gloves,
(b) Hard hats,
(c) Work boots,
(d) Etc.
(4) Other essential equipment
(a) Shovels,
(b) Rakes,
(c) Spades
ii) Methodology
(1) In connection with Excavation , Backfilling shall
approach the site in two working areas(Area A and Area
B).
(2) Backfill will be carried out in layers. Each layers shall
have a measure of more or less 4”
(3) After the 4” layer is met, compaction shall follow. This
will ensure backfilled materials are leveled with the
ground
(4) Backfilling is estimated to be finished in only one(1)
working day.
III. Plumbing

- All necessary equipment, materials and manpower in terms of plumbing installation will
be provided and taken care of by the contractor.

2.2 Specifications:

a.) Equipment/Materials:
➢ Carts and wheelbarrows - Carts and wheelbarrows are to be
used for aiding the transport of tubes, pipes, and other
materials necessary in the installation of plumbing. These will be
deployed for the duration of the plumbing phase.

- The hand tools will be provided for each

B.) Methodology
i. The plumbers will lay down the iron pipes as the poured
concrete in essential areas are still hardening to
minimize wastage of concrete materials.

ii. The plumbers will prioritize finishing the kitchen sink


waterline to aid in the water supply for the construction
site. The restrooms will be finished later so as to avoid
unnecessary traffic in the site from workers who wish to
use the completed restroom on site.

IV. Electrical

- The contractor will provide for the necessary materials, equipment, manpower, as well
as ensuring safety in the installation of electrical systems on site.

2.3 Specifications:

a.) Equipment/Materials:
➢ Step ladders - made of aluminum and provides a 5 meter
vertical extension at maximum, these step ladders will aid the
electricians in reaching high places for installation of light
fixtures, wiring, etc. These will be deployed for use for the
whole duration of the electrical installation period
➢ Carts and wheelbarrows - Carts and wheelbarrows are to be
used for aiding the transport of cables, wires, and other
materials necessary in the electrical installations. These will be
deployed for the duration of the electrical installation phase.

CONTRACT AND AGREEEMENT

for the

CONSTRUCTION of the One-Storey Residential House


for Dr. Robert Forger, M.D.

KNOWN ALL MEN BY THESE PRESENTS

This contract made and entered into this 18th day of June, 2022 by and betweeen:

DR. ROBERT FORGER, M.D. with an address at Moalboal, Cebu, Philippines, hereinafter
referred to as the OWNER.

-and-

WESTALIS CONSTRUCTION, with business address of Mambaling, Cebu City, Cebu,


duly represented by its Proprietor, ENGR. JEREMY L. SARVIDA, hereinafter referred to
as the CONTRACTOR;

WITNESSETH:

WHEREAS, a public bidding was conducted last June 12, 2022 at the Forger Engineering
Consultancy Conference Room, Ramos Street, Cebu city, for the Construction of the One-Storey
Residential Building for Dr. Robert Forger, M.D.

WHEREAS, the Bids and Awards Committee recommended to the OWNER that the project
shall be awarded to WESTALIS Construction, its offer being the most advantageous to the project.

WHEREAS, time is the essence of this contract

NOW, THEREFORE, for and in consideration of the foregoing premises and other covenants
hereinafter name, the parties agree as follows:

ARTICLE I - CONTRACT DOCUMENTS


The following documents shall be deemed to form and be interpreted and construed as part
of this agreement:

a) Design and Construction Agreement Contract


b) Invitation to Bid
c) Bidding Documents
d) Addenda and/or Supplemental/Bid Bulletins, if any
e) Bid Form including all the documents/statements
f) Eligibility requirements, documents and/or statements
g) Detailed Architectural and Engineering Design of the Project
h) Constructions Drawings, Plans, Designs and Specifications (setting forth in
detail the work required for architectural, structural, electrical, mechanical,
plumbing, sanitary and site development work
i) Statement of Probable Project Construction Cost
j) Resolution of the BAC recommending award of project of winning bidder
k) Construction plans and Phases and Timeline of the completion of the project

ARTICLE II - SCOPE OF WORK

The scope of work to be done by the CONTRACTOR consist of professional services for the
following:

1. The CONTRACTOR shall in accordance with the provisions of and subject to the
conditions contained in the documents referred to in Article 1 hereof, with a provision that
this construction activity belongs to WESTALIS Construction, and in consideration of the
sum of money hereinafter stated shall fully and faithfully perform all labor and furnish
needed equipment and services necessary to complete the Construction of the PROJECT as
per plan and specification of the OWNER;
2. The CONTRACTOR shall hire skilled workers as may be necessary
3. The CONTRACTOR shall construct the PROJECT under the supervision and management
of Forger Engineering Consultancy; and
4. The CONTRACTOR shall complete the PROJECT within the timeline provided herein.
5. The Contractor shall in no way suspend the works stipulated herein unless due to: bad
weather, fortuitous events or other justifiable causes.
ARTICLE III - TIME OF COMPLETION

1. The work to be performed by the CONTRACTOR under this contract shall commence
after ten (15) calendar days upon receipt and acceptance of the Notice to Proceed from the
OWNER by the CONTRACTOR.
2. The construction of the PROJECT shall be completed within One Hundred Twenty (120)
calendar days including Saturdays, Sundays and holidays.
3. Should the CONTRACTOR refuse or otherwise fail to complete the work stipulated herein,
the CONTRACTOR agrees to pay the OWNER liquidated damages in an amount equal to
One-Tenth of One Percent (0.1%) of the total contract sum for each calendar day of delay
until the work is completed and accepted by the OWNER or when the OWNER takes over
the project by administration or re lets it to other contractors until such time as the
OWNER may reasonably secure the completion of the works. Such amount shall be
deducted from any money due or which may become due the CONTRACTOR under this
contract.

EXTENSION. The following are grounds for the extension of the TIME OF COMPLETION, in
which case the CONTRACTOR shall not be held liable for the cost therefore:

a. Fortuitous events, such as but not limited to flood, typhoon, earthquake, accidents,
natural calamities, including those which affect the timely delivery of materials,
tools, equipment, facilities, and services provided in the Contract Documents;
b. Changes and alterations made or otherwise approved by the OWNER;
c. Delay in the payment of the fees by the OWNER; and
d. Delay caused by the OWNER;

Any other delays independent of the will of the CONTRACTOR.

ARTICLE IV – THE CONTRACT SUM

The OWNER for and in consideration of the faithful and satisfactory fulfillment of the
contract by the CONTRACTOR in accordance with the terms and conditions of all contact
documents and subject to the deduction herein provided, shall pay to the CONTRACTOR in
Philippine Currency the sum equivalent of ONE MILLION FIFTY-NINE THOUSAND SEVEN
HUNDRED EIGHTY SIX (Php 1,059,786.00) ONLY

Payment shall be in accordance with the following conditions:

a. Monthly payment shall be based upon the work satisfactorily completed as certified by
the CONTRACTOR and concurred by Forger Engineering Consultancy.
b. Final payment shall be made upon completion of the work and upon submission by the
CONTRACTOR of his sworn statement that all taxes due him and all obligations for
materials used and labor employed in accordance with this contract have been duly
paid.

ARTICLE V - GUARANTEE

The CONTRACTOR hereby guarantees the work stipulated in this contract and all the
materials it will apply and use in the construction as well as workmanship of all its work under this
contract and shall make good of its own account and/or its own expenses.

After final acceptance of the PROJECT by the OWNER, the CONTRACTOR shall assume
full responsibility for any damage or destruction of the works except those occasioned by force
majeure. They shall be required to put up a warranty security denominated in Philippine Pesos
provided in Section 62.2.3.3 of IRRA of R.A. 9184 and shall remain effective for one (1) year from
the date of issuance of the certificate of final acceptance and shall be returned only after the lapse of
the said one (1) year.

In addition, the provisions of Article 1723 of the New Civil Code shall also apply to
guarantee the work performance of the CONTRACTOR.

ARTICLE VI – SAFEGUARDS AND WARRANTS

The CONTRACTOR shall provide and do everything necessary to perform its


obligations under this contract according to the true intent and meaning of the other contract
documents taken together particularly the drawings, plans and specifications provided that the same
shall be inferred therefrom and should the CONTRACTOR find any discrepancy in the drawings,
plans and specifications, he shall immediately refer the same to the OWNER or Forger Engineering
Consultancy whose decision shall be followed.
The OWNER reserves the right for an additional or increase in the number of laborers or
workers assigned to the construction site in the opinion of the OWNER or Forger Engineering
Consultancy as the exigencies of the circumstances may require.

The CONTRACTOR shall be considered as an independent CONTRACTOR and as such,


he assumes all obligations and liabilities arising out of the Employee’s Liability Act and any other
laws existing and those enacted thereafter that may affect the rights of the employees or laborers
employed in the performance of this contract. Should the OWNER be made liable for any of the
CONTRACTOR’s violation of any labor laws, the CONTRACTOR shall reimburse the OWNER
for whatever amount the latter is required to pay to said laborers.

Notwithstanding any provisions of this contract, the OWNER has the right and/or power to
terminate the contract without necessity of judicial action by giving written notice to the
CONTRACTOR upon his failure to comply strictly with any of the terms of this contract.

The CONTRACTOR is likewise mandated to implement the construction safety and health
program as may be provided by Forger Engineering Consultancy.

ARTICLE VII – VENUE OF COURT ACTION

Should any court action be instituted by the OWNER or the CONTRACTOR arising from
this contract, the parties hereby agree that the venue thereof shall be the proper court in the City of
Cebu.

1. Dr. Robert Forger, M.D. intends to undertake the construction of the One-Storey Residential

SUBJECT: Notice to Proceed with Construction Contract

A Proposed One-Storey Residential, located at National Highway, Poblacion


West, Moalboal, Cebu City was awarded to Engr. Jeremy L. Sarvida, Westalis
Construction, Mambaling, Cebu City, Cebu, (032) 254 - 1056, in the amount
of Php 431,941.00, on June 18, 2022. Contractor is hereby notified to
commence work set forth in the contract on or before July 22, 2022.

All work is to be done in accordance with plans, specifications, and conditions


provided in the contract. The project must be fully complete within One
Hundred Twenty (120) working days from the effective date of the contract.
The date of completion of all work is, therefore November 26, 2022.
Contractor will pay as liquidated damages an amount equal to One-Tenth of
One Percent (0.1%) of the total contract sum for each calendar day of delay
until the work is completed and accepted by the Owner as specified in line 3
of Article III under Time of Completion.

Please acknowledge receipt of this Notice by signing the space below and
returning a copy to this office.
