COMPLAINT AFFIDAVIT

I, CARLA TRIAS of legal age, fFilipinowith postal address at No. 12, Purok 27 San
Carlos Heights, Irisan, Baguio City, after being duly sworn in to accordance with law, hereby
depose and say:

1. I am filing a complaint against Agta Takaw for Estafa and for violation of BP 22, who can be
served with summons and notices at Room 12. Business Center, Kayang Street, Baguio City.

2. That sometime on February 23, 2022 at my residence in the City of Baguio, Agta Takaw
convinced me to take his checks for rediscounting representing that the checks will be good on
the date indicated on the checks.

3. That the respondent delivered several checks and TWO (2) among several checks are the
subject of this case amounting to P400,000.00, to wit:

METROBANK (Annex A) 03xxxxxx February 25, 2022

P200,000.00

CHINABANK (Annex B) 03xxxxxx February 28, 2022

P200,000.00

TOTAL: P400,000.00

1. That on the dates of the check I deposited the same and to my dismay they all
came back with annotations ACCOUNT CLOSED.

2. That he defrauded me to part with my money when he issued checks with

insufficient funds and worse, account closed. He issued checks knowing very well that the same
is worthless.
 3. That upon bouncing of the checks I delivered a demand letters to the respondent
giving him a chance to make good the payments of the checks but he chose to ignore the same.

AFFIDAVIT OF WITNESS

I, Carla Bautista, of legal age, Filipino, single and a resident of No. 13 Purok 27, San Carlos
Heights, Irisan, Baguio City, after having been duly sworn to in accordance with law, depose and state:

1. That I was present and personally saw that accused, Agta Takaw, committed the crime of
Estafa against the victim ;

2. That on February 15, 2022 at Jedaiah Aban’s residence, Agta Takaw convinced the victim to
take the accused checks for rediscounting representing that the checks will be good on the date
indicated on the checks.

3. That I executed this affidavit to attest the truthfulness of the foregoing facts and to support the
filing of criminal case against Agta Takaw for violation of Estafa and violation of B.P. 22.
