ቁጥር 17/2011
በንግዴ ስራ የተሰማሩ ነጋዳዎችን ተዯራሽ በማዴረግ ሇክትትሌ አሰራር ምቹ ሁኔታዎችን
መፍጠር በማስፈሇጉ፣
የምርቶችንና አገሌግልቶችን ፍሰት በመከታተሌ፣ የንግዴ ስራ ፈቃዴ ሇተሰጠበት ዓሊማ

መዋለን በማረጋገጥ የንግዴ ዘርፉን ሇማሌማት የሚያስችለ ሁኔታዎችን መፍጠር አስፈሊጊ
ሆኖ በመገኘቱ ፣
ሀገራችን ሇግለ ክፍሇ ኢኮኖሚ በሰጠችው ሌዩ ትኩረት በመነሳት የንግዴ አሰራር ስርዓቱን
ቀሊሌ፣ ቀሌጣፋና ውጤታማ ማዴረግ በማስፈሇጉ፣
የንግዴና ኢንደስትሪ ሚኒስቴር በንግዴ ምዝገባና ፈቃዴ አዋጅ ቁጥር 980/2008 አንቀጽ 4(9)
እና አንቀጽ 42 (2) መሰረት ይህን መመሪያ አውጥቷሌ፤
1. አጭር ርዕስ
ይህ መመሪያ "የኢትዮጵያ የንግዴ ስራ ፈቃዴ መስጫ መዯብ መመሪያ ቁጥር 17/2011"
ተብል ሉጠቀስ ይችሊሌ፤
2. የቃሊት ትርጓሜ
የቃለ አግባብ ላሊ ትርጓሜ የሚሰጠዉ ካሌሆነ በቀር በዚህ መመሪያ ዉስጥ፤
1. ˝አዋጅ˝ ማሇት የንግዴ ምዝገባና ፈቃዴ አዋጅ ቁጥር 980/2008 ነው፤

2. በአዋጁ አንቀጽ 2 የተዯነገጉት የቃሊት ትርጓሜዎች በሙለ ሇዚህ መመሪያም ተፈፃሚ
ይሆናለ፡፡
3. የተፈፃሚነት ወሰን
ይህ መመሪያ በንግዴ ምዝገባና ፈቃዴ አዋጅ 980/2008 አንቀጽ 4/9 መሰረት የንግዴ ስራ
ፈቃዴ አገሌግልት በሚሰጡና በሚጠቀሙ ማናቸውም ሰዎች ሊይ ተፈፃሚ ይሆናሌ፡፡

4. የኢትዮጵያ የንግዴ ስራ ፈቃዴ መስጫ መዯብ
1. የኢትዮጵያ ንግዴ ስራ ፈቃዴ መስጫ መዯብ የዋና ዘርፍ መዯቦች የሚከተለት ናቸው፤
1.1 የግብርና፣ አዯን፣ የዯን ሌማትና ዓሳ ማስገር፣
1.2 የማዕዴን ቁፋሮና ኳሪዪንግ፣
1.3 የማኑፋክቸሪንግ፣
1.4 የኤላክትሪክ፣ የጋዝ ፣ የእንፋልት እና የውኃ አቅርቦት፣
1.5 የኮንስትራክሽን፣
1.6 የጅምሊና ችርቻሮ ንግዴ፣ ጥገና፣ የሆቴሌና ሬስቶራንት፣ የአስመጪነትና ሊኪነት
ስራዎች፣
1.7 የትራንስፖርት፣ የመጋዘንና የኮሙኒኬሽን ስራዎች፣
1.8 የፋይናንስ፣ የኢንሹራንስ፣ የሪሌ እስቴትና የንግዴ ስራዎች፣
1.9 የማህበረሰብ፣ ማህበራዊና የግሌ አገሌግልቶች፣
2. እያንዲንደ ፈቃዴ ሰጪ መስሪያ ቤት የንግዴ ስራ ፈቃዴ የሚሰጠው በዚህ መመሪያ
መሰረት ሆኖ የፈቃዴ መስጫው ባሇ አምስት ቁጥር መዯብ መሆን አሇበት ፣
3. በዚህ የንግዴ ስራ ፈቃዴ መስጫ መዯብ መሰረት ብቃት አረጋጋጭ መስሪያ ቤቶች
የፌዯራሌ ተቋማት ሲሆኑ እነዚህ ተቋማት እንዲስፈሊጊነቱ ውክሌና መስጠት ይችሊለ፤
4. የብቃት አረጋጋጭ መስሪያ ቤቶች በሚመሇከታቸው የንግዴ ስራ ፈቃዴ መዯብ መሰረት
የብቃት ማረጋገጫ መመሪያ በማዘጋጀት የብቃት ማረጋገጫ ሰርተፊኬት የመስጠት
ግዳታ አሇባቸው ፡፡
5. የንግዴና ኢንደስትሪ ሚኒስቴር ተግባርና ኃሊፊነት
1. የክሌሌና የባሇዴርሻ አካሊትን ስሇመመሪያው ያሳውቃሌ፣ያስተባብራሌ፣

2. አፈፃፀሙን በመገምገምና የግብረ መሌስ ስርዓት በመዘርጋት የተሻሇ አተገባበር እንዱኖር
ማናቸዉንም አስፈሊጊ ተግባራትን ያከናውናሌ፤
3. ሇአፈፃፀም የሚጠቅሙ የቁጥጥር ፣ የክትትሌ እና የዴጋፍ ስራዎችን ያከናውናሌ፤

6. የክሌሌ ንግዴ መሥሪያ ቤት ተግባርና ኃሊፊነት
1. በዚህ መመሪያ መሰረት የንግዴ ስራ ፈቃዴ አገሌግልቶችን ይሰጣሌ፣

2. አስፈሊጊ መረጃዎችን ሇሚኒስቴር መስሪያ ቤቱ ያቀርባሌ፣ የሚኒስቴር መስሪያ ቤቱ ግብረ
መሌስን በመቀበሌ እንዱተገበር ያዯርጋሌ፤
3. የክትትሌ፣ የዴጋፍና ቁጥጥር ተግባራትን ያከናውናሌ፤
4. በመመሪያው አፈፃፀም የሚያጋጥሙ ችግሮችን ሇይቶ ከመፍትሄ ኃሳብ ጋር ሇሚኒስቴር
መ/ቤቱ በማሳወቅ እንዲስፈሊጊነቱ ማሻሻያዎች እንዱዯረጉ ያዯርጋሌ፤ በሚሰጠው ውሳኔ
መሠረትም ያስፈፅማሌ፤
5. ሇዚህ መመሪያ አፈፃፀም ጠቃሚ የሆኑ ማናቸውም ተግባራት ያከናውናሌ፡፡
7. የመተባባር ግዳታ
በዚህ መመሪያ መሰረት የሚመሇከታቸዉ የመንግስት አካሊት ሇመመሪያው ተፈፃሚነት
መተባበር ይኖርባቸዋሌ፡፡
9. ተፈፃሚነት የማይኖራቸው ሕጎችና ሌማዲዊ አሰራሮች
1. የኢትዮጵያ የንግዴ ስራ ፈቃዴ መስጫ መዯቦች መመሪያ ክሇሳ አንዴ በዚህ መመሪያ
ተሽሯሌ፣
2. ይህን መመሪያ የሚቃረን ማንኛውም ህግ ወይም ሌማዲዊ አሰራር በዚህ መመሪያ

ውስጥ በተሸፈኑ ጉዲዮች ሊይ ተፈፃሚነት አይኖራቸውም፡፡
10. ስሇ አባሪዎች
ከዚህ መመሪያ ጋር ተያይዞ የሚገኘው አባሪ ቁጥር 1 የዚህ መመሪያ አካሌ ነው፡፡
11. መመሪያውን ስሇማሻሻሌ
ሚኒስቴሩ ይህን መመሪያ እንዯ አስፈሊጊነቱ ሉያሻሽሌ ወይም ሉሇውጥ ይችሊሌ፡፡

የኢትዮጵያ የንግዴ ስራ ፈቃዴ መስጫ መዯብ መመሪያ ቁጥር

የምርቶችንና አገሌግልቶችን ፍሰት በመከታተሌ፣ የንግዴ ስራ ፈቃዴ ሇተሰጠበት ዓሊማ

1. ˝አዋጅ˝ ማሇት የንግዴ ምዝገባና ፈቃዴ አዋጅ ቁጥር 980/2008 ነው፤

5. የንግዴና ኢንደስትሪ ሚኒስቴር ተግባርና ኃሊፊነት

1. የክሌሌና የባሇዴርሻ አካሊትን ስሇመመሪያው ያሳውቃሌ፣ያስተባብራሌ፣

1. በዚህ መመሪያ መሰረት የንግዴ ስራ ፈቃዴ አገሌግልቶችን ይሰጣሌ፣

9. ተፈፃሚነት የማይኖራቸው ሕጎችና ሌማዲዊ አሰራሮች

2. ይህን መመሪያ የሚቃረን ማንኛውም ህግ ወይም ሌማዲዊ አሰራር በዚህ መመሪያ

11. መመሪያውን ስሇማሻሻሌ

ሚኒስቴሩ ይህን መመሪያ እንዯ አስፈሊጊነቱ ሉያሻሽሌ ወይም ሉሇውጥ ይችሊሌ፡፡

ይህ መመሪያ ከሰኔ/ 2011 ዓ.ም ጀምሮ ተግባራዊ ይሆናሌ።
