የኢትዮጵያ የንግድ ስራ ፈቃድ መስጫ መደብ መመሪያ
ቁጥር 17/2011
በንግድ ስራ የተሰማሩ ነጋዴዎችን ተደራሽ በማድረግ ለክትትል አሰራር ምቹ ሁኔታዎችን
መፍጠር በማስፈለጉ፣
የምርቶችንና አገልግሎቶችን ፍሰት በመከታተል፣ የንግድ ስራ ፈቃድ ለተሰጠበት ዓላማ

መዋሉን በማረጋገጥ የንግድ ዘርፉን ለማልማት የሚያስችሉ ሁኔታዎችን መፍጠር አስፈላጊ
ሆኖ በመገኘቱ ፣
ሀገራችን ለግሉ ክፍለ ኢኮኖሚ በሰጠችው ልዩ ትኩረት በመነሳት የንግድ አሰራር ስርዓቱን
ቀላል፣ ቀልጣፋና ውጤታማ ማድረግ በማስፈለጉ፣
የንግድና ኢንዱስትሪ ሚኒስቴር በንግድ ምዝገባና ፈቃድ አዋጅ ቁጥር 980/2008 አንቀጽ 4(9)
እና አንቀጽ 42 (2) መሰረት ይህን መመሪያ አውጥቷል፤
1. አጭር ርዕስ
ይህ መመሪያ "የኢትዮጵያ የንግድ ስራ ፈቃድ መስጫ መደብ መመሪያ ቁጥር 17/2011"
ተብሎ ሊጠቀስ ይችላል፤
2. የቃላት ትርጓሜ
የቃሉ አግባብ ሌላ ትርጓሜ የሚሰጠዉ ካልሆነ በቀር በዚህ መመሪያ ዉስጥ፤
1. ˝አዋጅ˝ ማለት የንግድ ምዝገባና ፈቃድ አዋጅ ቁጥር 980/2008 ነው፤

2. በአዋጁ አንቀጽ 2 የተደነገጉት የቃላት ትርጓሜዎች በሙሉ ለዚህ መመሪያም ተፈፃሚ
ይሆናሉ፡፡
3. የተፈፃሚነት ወሰን
ይህ መመሪያ በንግድ ምዝገባና ፈቃድ አዋጅ 980/2008 አንቀጽ 4/9 መሰረት የንግድ ስራ
ፈቃድ አገልግሎት በሚሰጡና በሚጠቀሙ ማናቸውም ሰዎች ላይ ተፈፃሚ ይሆናል፡፡

4. የኢትዮጵያ የንግድ ስራ ፈቃድ መስጫ መደብ
1. የኢትዮጵያ ንግድ ስራ ፈቃድ መስጫ መደብ የዋና ዘርፍ መደቦች የሚከተሉት ናቸው፤
1.1 የግብርና፣ አደን፣ የደን ልማትና ዓሳ ማስገር፣
1.2 የማዕድን ቁፋሮና ኳሪዪንግ፣
1.3 የማኑፋክቸሪንግ፣
1.4 የኤሌክትሪክ፣ የጋዝ ፣ የእንፋሎት እና የውኃ አቅርቦት፣
1.5 የኮንስትራክሽን፣
1.6 የጅምላና ችርቻሮ ንግድ፣ ጥገና፣ የሆቴልና ሬስቶራንት፣ የአስመጪነትና ላኪነት
ስራዎች፣
1.7 የትራንስፖርት፣ የመጋዘንና የኮሙኒኬሽን ስራዎች፣
1.8 የፋይናንስ፣ የኢንሹራንስ፣ የሪል እስቴትና የንግድ ስራዎች፣
1.9 የማህበረሰብ፣ ማህበራዊና የግል አገልግሎቶች፣
2. እያንዳንዱ ፈቃድ ሰጪ መስሪያ ቤት የንግድ ስራ ፈቃድ የሚሰጠው በዚህ መመሪያ
መሰረት ሆኖ የፈቃድ መስጫው ባለ አምስት ቁጥር መደብ መሆን አለበት ፣
3. በዚህ የንግድ ስራ ፈቃድ መስጫ መደብ መሰረት ብቃት አረጋጋጭ መስሪያ ቤቶች
የፌደራል ተቋማት ሲሆኑ እነዚህ ተቋማት እንዳስፈላጊነቱ ውክልና መስጠት ይችላሉ፤
4. የብቃት አረጋጋጭ መስሪያ ቤቶች በሚመለከታቸው የንግድ ስራ ፈቃድ መደብ መሰረት
የብቃት ማረጋገጫ መመሪያ በማዘጋጀት የብቃት ማረጋገጫ ሰርተፊኬት የመስጠት
ግዴታ አለባቸው ፡፡
5. የንግድና ኢንዱስትሪ ሚኒስቴር ተግባርና ኃላፊነት
1. የክልልና የባለድርሻ አካላትን ስለመመሪያው ያሳውቃል፣ያስተባብራል፣

2. አፈፃፀሙን በመገምገምና የግብረ መልስ ስርዓት በመዘርጋት የተሻለ አተገባበር እንዲኖር
ማናቸዉንም አስፈላጊ ተግባራትን ያከናውናል፤
3. ለአፈፃፀም የሚጠቅሙ የቁጥጥር ፣ የክትትል እና የድጋፍ ስራዎችን ያከናውናል፤

6. የክልል ንግድ መሥሪያ ቤት ተግባርና ኃላፊነት
1. በዚህ መመሪያ መሰረት የንግድ ስራ ፈቃድ አገልግሎቶችን ይሰጣል፣

2. አስፈላጊ መረጃዎችን ለሚኒስቴር መስሪያ ቤቱ ያቀርባል፣ የሚኒስቴር መስሪያ ቤቱ ግብረ
መልስን በመቀበል እንዲተገበር ያደርጋል፤
3. የክትትል፣ የድጋፍና ቁጥጥር ተግባራትን ያከናውናል፤
4. በመመሪያው አፈፃፀም የሚያጋጥሙ ችግሮችን ለይቶ ከመፍትሄ ኃሳብ ጋር ለሚኒስቴር
መ/ቤቱ በማሳወቅ እንዳስፈላጊነቱ ማሻሻያዎች እንዲደረጉ ያደርጋል፤ በሚሰጠው ውሳኔ
መሠረትም ያስፈፅማል፤
5. ለዚህ መመሪያ አፈፃፀም ጠቃሚ የሆኑ ማናቸውም ተግባራት ያከናውናል፡፡
7. የመተባባር ግዴታ
በዚህ መመሪያ መሰረት የሚመለከታቸዉ የመንግስት አካላት ለመመሪያው ተፈፃሚነት
መተባበር ይኖርባቸዋል፡፡
9. ተፈፃሚነት የማይኖራቸው ሕጎችና ልማዳዊ አሰራሮች
1. የኢትዮጵያ የንግድ ስራ ፈቃድ መስጫ መደቦች መመሪያ ክለሳ አንድ በዚህ መመሪያ
ተሽሯል፣
2. ይህን መመሪያ የሚቃረን ማንኛውም ህግ ወይም ልማዳዊ አሰራር በዚህ መመሪያ

ውስጥ በተሸፈኑ ጉዳዮች ላይ ተፈፃሚነት አይኖራቸውም፡፡
10. ስለ አባሪዎች
ከዚህ መመሪያ ጋር ተያይዞ የሚገኘው አባሪ ቁጥር 1 የዚህ መመሪያ አካል ነው፡፡
11. መመሪያውን ስለማሻሻል
ሚኒስቴሩ ይህን መመሪያ እንደ አስፈላጊነቱ ሊያሻሽል ወይም ሊለውጥ ይችላል፡፡

የኢትዮጵያ የንግድ ስራ ፈቃድ መስጫ መደብ መመሪያ ቁጥር

የምርቶችንና አገልግሎቶችን ፍሰት በመከታተል፣ የንግድ ስራ ፈቃድ ለተሰጠበት ዓላማ

1. ˝አዋጅ˝ ማለት የንግድ ምዝገባና ፈቃድ አዋጅ ቁጥር 980/2008 ነው፤

5. የንግድና ኢንዱስትሪ ሚኒስቴር ተግባርና ኃላፊነት

1. የክልልና የባለድርሻ አካላትን ስለመመሪያው ያሳውቃል፣ያስተባብራል፣

1. በዚህ መመሪያ መሰረት የንግድ ስራ ፈቃድ አገልግሎቶችን ይሰጣል፣

9. ተፈፃሚነት የማይኖራቸው ሕጎችና ልማዳዊ አሰራሮች

2. ይህን መመሪያ የሚቃረን ማንኛውም ህግ ወይም ልማዳዊ አሰራር በዚህ መመሪያ

11. መመሪያውን ስለማሻሻል

ሚኒስቴሩ ይህን መመሪያ እንደ አስፈላጊነቱ ሊያሻሽል ወይም ሊለውጥ ይችላል፡፡

ይህ መመሪያ ከሰኔ/ 2011 ዓ.ም ጀምሮ ተግባራዊ ይሆናል።
