EXTRAJUDICIAL SETTLEMENT OF ESTATE WITH SIMULTANEOUS

DEED ABSOLUTE SALE


KNOW ALL MEN BY THESE PRESENTS:
This AGREEMENT made end and entered into this _____ day of ________
20__, in by and between:

PERLITA G. ERICE, of legal age, widow, Filipino, residing at Purok 5,


Babalag East, Rizal, Kalinga;

CESAR G. ERICE, of legal age, married, residing at Purok 5, Babalag


East, Rizal, Kalinga;

WITNESSETH, that:

WHEREAS, we are the sole heirs of the deceased CESAR G. ERICE who died
on November 22, 2002, at Babalag East, Rizal, Kalinga, copy of his death
certificate is hereto attached as Annex A;
WHEREAS, CESAR G. ERICE died intestate, without Will or Testament, and
without any outstanding debts in favor of any person or entity;
WHEREAS, the deceased CESAR G. ERICE is the absolute and registered
owner of a parcels of land located at Babalag East, Rizal, Kalinga covered by
Original Certificate of Title No. P-4291, respectively, of the Registry of
Deeds of Tabuk City, Kalinga and more particularly described as follows:

Beginning at a point marked “l” of lot 5067, PLS-245, being S 59.05W.


465.12m. From BBM No. 18 to corner 1, Pls-245, containing an area of Thirty
Seven Thousand Five Hundred (37,500) Square Meters and situated in the Barrio
of Babalag (now Babalag East) Municipality of Tabuk (now Rizal) Province of
Mountain (now Kalinga) covered with Homestead Patent No. 95952.

WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court of


the Philippines, and being with full capacity to contract, we do hereby
adjudicate unto ourselves the parcel of land described above, in equal
shares.
FURTHER, FOR AND IN CONSIDERATION of the sum of FOUR HUNDRED FIFTY THOUSAND
PESOS( 450,000.00), Philippine Currency, the receipt whereof is hereby
acknowledged in full sum from SPOUSES MARIO BORJA and ROSEJEAN B. BORJA ,
both of legal age, Filipinos, and with residence address at Babalag West,
Rizal, Kalinga, we do hereby SELL, TRANSFER, CONVEY and DELIVER, by way of
ABSOLUTE SALE, unto said Spouses MARIO BORJA and ROSEJEAN B.BORJA , their
heirs assigns and successors in interest the property above described with
all the improvements existing thereon;
That we hereby warrant our valid title to and peaceful possession of
the property herein sold and conveyed and further declares that the same is
free and clear of all liens and encumbrances of any kind whatsoever.
