JOINT AFFIDAVIT

We, the undersigned personnel assigned in the Forest Protection and Law
Enforcement Unit of the Department of Environment and Natural Resources
(DENR), all of legal age and presently assigned at Community Environment and Natural
Resources Office (CENR Office) Iligan City, do hereby depose and state THAT:

1. We are the DENR Employees who apprehended and seized the said illegal forest
products.

2. On October 3, 2022 (Monday) at around 9:45 in the morning, after having a

Monday Convocation, the then OIC, CENR Officer Forester Jamel A. Tiburon
instructed the CENRO Iligan Quick Response Team (QRT) under the
Enforcement and Monitoring Section to conduct surveillance/monitoring against
illegal source/vending of forest products without pertinent documents from the
DENR.

3. On the same day at around 10:20 in the morning, the CENRO Iligan Quick
Response Team (QRT) led by the Chief Enforcement Unit, FR Benny G. Arie,
conducted surveillance/monitoring along the national highway from CENRO
Iligan Station to Municipality of Baloi, Matungao, Linamon, Bacolod, and
Maigo, all in the province of Lanao del Norte and under the Area of
Responsibility (AOR) of CENRO Iligan.

4. Upon arrival in the Municipality of Maigo at around 2:00 in the afternoon, while
the team taking their lunch, they received a report via cellphone call from a
concerned citizen that allegedly there is a big volume of sacks of Charcoal
stockpiled along the national highway beside the RUSI Building. The Team
immediately proceeded to the said addressed area to verify the veracity of the
report. Soon after, the Team saw a large number of sacks of Charcoal and bundles
of native/naturally grown species (Binunga) in the suspected area.

5. The owner and manager of the establishment and of the illegal forest products is a
certain MR. NELYN SARAO IMBO, a Business Permit Holder of NELYN
CHARCOAL WHOLESALING, who at that time, was not present. The said
Charcoal owner is also the Officer-In-Charge of MINDANAO RUSI-RAMAS-

UYPITCHING Sons, Inc., and yet only his employees were able to present a
Business Permit, and no legal/pertinent documents from the DENR were shown.

6. The Team coordinated the Maigo Municipal Police Station/PMAJ AUSTIN

KARL T. TIROL asking for security assistance and the Poblacion Maigo
BLGU/Brgy. Captain Ruth T. Pareja to witness the verification/investigation and
apprehension of the illegal forest products.

7. On the following day, the Team went back to the Municipality of Maigo in order
to personally meet the identified owner. Upon arrival thereat, the Team was able
to meet Mr. NELYN SARAO IMBO. The Chief Enforcement Unit FR Benny G.
Arie tried to ask the former to present any supporting/legal documents he has in
connection with his line of business, and yet the suspected owner presented only a
Business Permit and nothing else.

We executed this joint affidavit to attest the truthfulness of the foregoing facts and
to support the filing of Criminal Case against MR. NELYN SARAO IMBO for violation
of Section 77 of PD 705 otherwise known as the Forestry Code.
