Greetings!

This has reference to your letter dated August 10, 2022 informing JINMA
ENTERPRISES of its deficiency relative ITB No. 2022-07-018-Goods wherein
the resultant bid evaluation by the BAC-TWG on the submitted bid documents
is “NON-COMPLYING”

Anent to this, we humbly seek your indulgence to RECONSIDER the said the
deficiency as INADVERTENT considering that the JINMA ENTERPRISES have
presented a Company Profile reflective of all transactions including but not
limited to its STATEMENT OF SINGLE LARGEST COMPLETED
TRANSACTIONS.

The Liaison Officer of the Company may have inadvertently, without malice and
intent to prejudice the government, accidentally excluded said document
during the preparation of the necessary Bid Documents. While we adhere that
the compliance to Section 30.1 of the IRR- said non-discretionary “PASS/FAIL”
criterion postulates a submission of an otherwise incomplete and patently
insufficient documents. This however, cannot be the case with JINMA
ENTERPRISES when on its face, upon opening of the BID Documents
submitted received the non-discretionary criteria and was rated as “PASS” on
July 27, 2022. In such a case, the BID Documents were not patently
insufficient or otherwise on its face incomplete.

Having received the non-discretionary criteria and was rated as PASS, the
Honorable August body of the Bids and Awards Committee can and is allowed
by the IRR to require JINMA ENTERPRISES additional and/or documents to
such as the inadvertently missing STATEMENT OF SINGLE LARGEST
COMPLETED TRANSACTIONS- same document we now hereunto attach in
compliance.

On the observation under the technical specification more particularly with the
BROCHURE wherein the discrepancy was with the imprinted specification of
tires in the BROCHURE which is 10+1/10.00 R20 instead of 10+1/12.00 R20
as per Invitation To Bid, we likewise move to RECONSIDER on the point of
issue that the BROCHURE was printed in a general specification and were
printed out in volumes for reference only-subject modification to conform
to the actual and more specific demands as specified in the Invitation To
Bid.
JINMA ENTERPRISES marked the specifications as per ITB as COMPLIANT
with what was submitted under the Bid Documents not relying on the
BROCHURE ALONE but on its confidence to deliver as specifically details in
the ITB. At JINMA ENTERPRISES, we take humble accord and confidence that
we DELIVER as per minute details from ground up in compliance to the
requirements laid down in the ITB.

On account of such premises, we seek not only the indulgence of this

more over allow the JINMA ENTERPRISES to submit and deliver in consonance
to its company mission and vision to deliver not only compliant but above
average quality of service
