(A) Brief about the submittal:

The Contractor vide letter under reference has requested for consent from the Engineer regarding the
water source (Chinchwada Village Open Well, Karanjade Tal- Panvel) to be used for construction works
in CTP-11 Package.

(B) Engineer’s observations:

The Contractor’s submittal is reviewed by the Engineer and found in order in terms of Sub clause 7.10
‘Water’ of Clause 7 ‘Material for Structures’ of Contract Agreement Part-3: Specifications.

(C) Engineer’s Recommendations:

‘Notice of No Objection’ (NONO) is accorded to the Source of Water (Chinchwada Village Open Well,
Karanjade Tal- Panvel) to be used for construction works in CTP-11 Package, in terms of Sub Clause
3.1. (1), Clause 3 ‘Engineer’s Response’ of Appendix -13 (Document Submission and Review Procedure)
under Employer’s Requirements, CA Part-2.

FIDIC Clause 5.2 is relevant in this context which specifies that any such approval or consent, or any
review shall not relieve the contractor from any obligation or responsibility. Subsequently if any errors,
mistakes, discrepancies are found after this NONO, the same will be rectified by the Contractor on his
own cost.

The Letter conveying Engineer’s approval has been drafted and is being put up for your consent and
review.
