CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This Contract is entered this __________________________by and between:

The _____________________, a local government unit created and

existing under the Philippine Laws, with office address at the
__________________________ , represented herein by
____________________, hereinafter referred to as the "First Party",

____________________ of legal age, (_______) citizen, (marital status) and a

resident of ____________________ hereinafter referred to as "Second Party".

-— WITNESSETH —

WHEREAS, the First Party is in need of the Services of the Second Party who
shall perform work not performed by the regular personnel of the First Party;

WHEREAS, the Second Party proposes to provide the services needed by

the First Party who in turn agrees to the proposal;

WHEREAS, the Second Party hereby attests that he possesses the

education experience and skills required to perform the functions herein
stated;

WHEREAS, the Second Party further attests that s/he is not related within
fourth degree of consanguinity or affinity to the a) hiring authority
and/or b) representative of the First Party, that s/he has not reached the
compulsory retirement age of sixty-five (65);

NOW THEREFORE, in consideration of the foregoing premises, the First

Party hereby engages the services of the Second Party as (Position) in
(Name of Institution), subject to the following terms and conditions;

2. That the service of contract will cover the period from January 1,
2023 to December 31, 2023, renewable at the discretion of the
parties. The rate per month, as indicated in the table below.

 3. That under the Civil Service Rules and Regulations this contract
does not create an employee-employer relationship between the
First Party and the Second Party; that the services rendered will
not be accredited as government services; and that the latter is
not entitled to benefits enjoyed by regular personnel of the First
Party. Furthermore, the Second party is an independent
professional and will be entitled to work at such times and places
as he determines appropriate.

4. That the First Party reserves the right to discontinue this

Contract on the following grounds:

i. Violation by the Second Party of the Terms and

Conditions of this Contract;
ii. Non-availability of funds;
iii. Violation of the rules and regulations; and
iv. Unsatisfactory performance of duties and
responsibilities.

5. That the Second Party shall have the right to terminate this
Contract in case of violation by the First Party of the Terms and
Conditions stated therein.
