Punishment in schools – action against teachers/schools –
Instructions issued – Regarding.

The Regional Join Directors and the District Educational Officers are
informed that there should be zero tolerance to the corporal punishment in
schools and all other settings. Its prevalence in one form or the other and its
continuation unquestioningly causes untold harm to children.

As per the sub-rule.10 under Rule.10 of G.O.Ms.No.1, Education,


dt:01-01-1994 the educational agency shall ensure that the students are not
subject to corporal punishments of any nature under any circumstances
and the staff enforcing such punishments against the students shall be
subject to suitable disciplinary action.

The Section.17 of Right to Education (RTE) Act "No child shall be


subjected to physical punishment and mental harassment." Besides, the
Hon’ble Supreme Court of India has banned corporal punishment for
children and directed the State to ensure "that children are not subjected to
corporal punishment in schools and they receive education in an
environment of freedom and dignity, free from fear".

In view of the above all the Regional Joint Director and the District
Educational Officers in the state are requested to ensure that the following
initiatives are taken immediately:

1. Take requisite steps to enlighten all the teachers/ institutions under


all managements about the prohibition of corporal punishment and
the action against the teacher/institution for such incidences.

2. Issue Instructions to all the field officers to bring every incidence of


corporal punishment to the notice of the DEO/RJDSE, as the case
may be.

3. If any such incidence occurs in Government/Local body/ Aided


schools, the teacher involved should be suspended immediately.
Further disciplinary action should be initiated against the teacher,
responsible, as per rules issued by Government from time to time.

4. If the incidence occurs in Private un-aided schools a criminal case is


filed against the teachers, responsible. A show cause notice may be
issued immediately to the Private Unaided Management on why the
Permission and/or Recognition, granted should not be withdrawn and
take follow up action.

5. Every such incidence must be brought to the notice of the


Commissioner of School Education along with submission of an
action taken report.

Sub: School Education – Safety of the school children –


certification of the maintenance of busses by the
Educational Institutions in the State – guidelines issued –
Regarding.

The schools, especially under private managements are running


school busses/vehicles for transporting school children. Several
incidences of mishaps to school buses in various parts of the State
confirm that the buses are not maintained up to the required extent
by the school management. Moreover, there have also been instances
of appointment of un-trained drivers, to man school buses, reckless
driving causing grievous injuries to children, etc.

All the Regional Joint Directors of School Education and the


District Educational Officers in the State are, therefore, instructed to
take up a special drive to check the school busses and see the
following preventive measures are followed properly for the safety of
the school children:
 The school buses/vehicles shall be properly maintained, should
be road worthy and should posses the relevant certificate of
fitness.

 Appropriate provision is being made on the Commissioner


School Education web portal and instructions will be issued
separately. The fitness certificate should be obtained from the
concerned Management for every bus they are operating and
the same should be uploaded in the web portal of the
Commissioner School Education.

 Every vehicle, bus, van or such other means of transport,


carrying school children shall hold a proper permit/permission
from the RTA.

 The vehicle should be manned by trained, experienced and well


versed driver. The bus driver engaged should have needed
driving experience.

 The vehicle/bus driver should not have been challaned more


than 5 times for traffic violation like jumping red light, improper
parking, violating stop line, unauthorized lane changing,
overtaking etc. and ought not to have been challaned for an
offence under any section of Traffic/RTA rules during the period
of requisite experience of 5 Years.

 All School vehicles/buses transporting school students shall


have an attendant. The attendant should be adequately trained
to handle young children.

 All schools shall ensure that the vehicles/busses drop all the
children are dropped inside the boundary wall of the school..

 All the vehicles/busses transporting of school children shall


carry First-Aid-Box and Fire Extinguisher as required under the
rules.
 No vehicle/bus transporting of school children shall carry the
children in excess of its permitted capacity.

 The educational institution shall control and man the traffic


through own manpower in and around the school premises and
especially near unmanned railway crossings.

In addition to the compliance, the following points must


also be ensured by the administrative authority of the schools:

 Name, home address with telephone number of driver must be


made available for DEO’s record.
 Documents of School bus/vehicle should be inspected by school
authority from time to time and its condition should be got
certified by the competent authority.
 In case of any lapse/guilt by driver for not following the rules
the matter should be reported to police by school authorities.
Otherwise the recognition of the school should be cancelled
immediately.
 A transport committee should be formed with parents of the
children at every school level for deciding the transport fees,
rout of the bus, bus stops and to check if the school
vehicles/buses have the required documents like registration
papers, fitness certificates, insurance papers, transport permit,
driving license of the concerned school bus driver, fire
extinguisher and first aid box in the bus.

The above instructions may be followed scrupulously and action


taken report may be submitted in the matter.

Sub: Right to Education Act-2009 – Appointment of qualified


teachers in private un-aided schools – Instructions issued –
Regarding.

The Regional Join Directors and the District Educational Officers are
informed as per the sub-rule.1 of Rule.12 of G.O.Ms.No.1, Education, dt:01-
01-1994, the educational agency shall appoint staff as per the staffing
pattern prescribed by the Government and all staff shall conform to the
qualifications prescribed by the Government from time to time. Hence, in all
educational institutions including private institutions/schools appropriately
qualified teachers are to be appointed.

Further, as per the provisions of Right to Education (RTE) Act-2009


all the institutions under all managements have to engage only qualified and
trained Personnel to teach in all classes. In Andhra Pradesh State adequate
number of qualified candidates is available for appointment under different
categories/subjects in view of sufficient number of B.Ed & D.Ed Colleges.

Therefore, all the Regional Join Directors and the District Educational
Officers are instructed to undertake a review and ensure that only qualified
personnel are appointed in private un-aided schools. To ensure this they are
requested to take the following measures:

1. Issue instructions to all the private un-aided institutions to submit


the list of teachers, working in their school along with the copies of
the relevant certificates.

2. At the time of inspection the Deputy Educational Officer/ Mandal


Educational Officer shall verify and certify that only qualified teachers
are working.

3. Periodic checks should be made in Private Un-aided schools to ensure


that qualified teachers are working on a regular basis in the said
institution.

4. Initiate action by way of show cause notice, cancellation of


permission/recognition of the institution, etc. if the institution fails to
follow these rules.

5. Any such incidences should be reported to the Commissioner of


School Education from time to time.
