COMPROMISE AGREEMENT
[With Waiver, Release and Quitclaim]

KNOW ALL MEN BY THESE PRESENTS:

This COMPROMISE AGREEMENT [With Waiver, Release and Quitclaim], executed this 22 nd
day of February 2023 in Cordon, Isabela, by and between:

BERT GOROSPE Y MANIBOG of legal age, Filipino, single, with residence address at
Purok 4 Turod Sur, Cordon Isabela hereinafter referred to as the FIRST PARTY;

-and-

JINKY BAY-ONG PUGONG, in representation of ALEXANDER PUGONG as Sister, of legal

age, Filipino, single, with residence address at Andres, Bonifacio Diffun hereinafter referred
to as the SECOND PARTY;

WITNESSETH

WHEREAS, FIRST PARTY is the driver of a Toyota Atlis with plate number ZCT969 registered in the
name of VIRGILIO RINGOR II and the SECOND PARTY is the sister of Alexander Pugong who were
involved in a vehicular accident;

WHEREAS, Alexander Pugong, the brother of the SECOND PARTY was driving a black MC model
Euro 150, Color Black with plate number BO12499;

WHEREAS, the FIRST PARTY and Alexander Pugong were traversing in opposite direction
when the vehicle of Alexander Pugong overtook a vehicle in front of him going to Diffun
Quirino and it collided with the vehicle of the FIRST PARTY and as a result both vehicles
incurred severe damages of still un-estimated cost and the driver of the Euro motorcycle was
brought to the Javonillo Hospital of Barangay Quirino, Cordon Isabela but he was declared
dead on arrival (ALEXANDER PUGONG)

WHEREAS the FIRST PARTY and the SECOND PARTY have agreed to settle amicably the
said accident and the agreed as follows;

1. That the FIRST PARTY shall pay the amount of 70, 000.00 Phil. Currency to the
SECOND PARTY and that the FIRST PARTY has already paid an initial amount
15,000.00.
2. That the second payment shall pay on or before February 28,2023 in the amount of
P25,000.00.
3. Last payment of P30,000.00 shall be on or before March 20,2023.

WHEREAS in case of non-adherence to this agreement, the same shall be null and void and
both parties may pursue legal actions;

NOW, THEREFORE, in consideration of the foregoing premises, the parties hereby

undertake as follows:
 1. Both Parties will settle the case amicably;

2. FIRST PARTY will pay SEVENTY THOUSAND PESOS (P70,000.00) as stipulated above ;

3. That both parties agree to, release each other from any liabilities and obligation/s
whatsoever resulting from the accident, including all claims and counterclaims therein,
and agree not to file any case, whether civil, administrative or criminal, of any kind or
nature whatsoever, in any court, tribunal, or government agencies exercising quasi-
judicial function arising from the same facts, incident, claim, cause or causes of action
provided that both parties will follow the agreed stipulation in this agreement;

4. That both parties hereby irrevocably, freely and voluntarily release and forever
discharge the each other, from any and all manner of action, causes of action, sum of
money, damages, liability, responsibility, obligation, claims and demands whatsoever in
law or equity, which had, now have, or may have against each other, including, but not
limited to, actual, moral, exemplary and all other damages or causes of action provided
for under the law, if any, arising, directly or indirectly, from the facts and
circumstances, all of which claims or causes of action by these presents both parties
hereby abandon and waive provided that the parties will follow the agreed stipulation in
this agreement.

The parties shall abide with the provisions of this compromise agreement in utmost good
faith.

IN WITNESS WHEREOF, the parties have hereunto set their hand this 22 nd day of
February 2023 in Cordon, Isabela.

ACKNOWLEDGEMENT

BEFORE ME, a Notary Public for and in the Province of Isabela, personally appeared
the above named parties with their valid identification cards, known to me and to me known
to be the same persons who executed the foregoing instrument and acknowledged to me
that the same are their free act and voluntary deed.

This instrument, consisting of two (3) pages, including the page on which this
acknowledgment is written, has been signed on the left margin of each and every page
thereof by the concerned parties and their witnesses, and sealed with my notarial seal.
