EXCERPTS FROM THE MINUTES OF THE BARANGAY PEACE AND ORDER COMMITTEE (BPOC)
MEETING ON January 1, 2022 at 1:00 O’CLOCK IN THE AFTERNOON AT THE BARANGAY HALL, BRGY.
DANAO, ORMOC CITY.
PRESENT:
WHEREAS, Section 16 of RA 7160, otherwise known as the Local Government Code of 1991 states that “every local
government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers which
are essential to the promotion of the General Welfare, and to ensure, among other things, the preservation and promotion of
health and safety”;
WHEREAS, Republic Act No. 9211 or the Tobacco Regulation Act of 2003 Regulate the Packaging, Use, Sale,
Distribution, and Advertisements of Tobacco Products to protect the populace from hazardous products and promote the
right to health and install health consciousness among the general welfare;
WHEREAS, Republic Act 8749 otherwise known as the Philippine Clean Air Act of 1999 declares the right of every
citizen to breathe clean air, prohibits smoking inside enclosed public places including public vehicles and other means of
transportation and other public places and directs local government units to implement its provisions;
WHEREAS, the future of our minors are constantly under threat from the incessant exposure to the world of vices and
easy accessibility of intoxicating alcoholic beverages and cigarette in retail and/or sari-sari store within the barangay;
WHEREAS, there is a need to take steps in order to protect our younger and future generations;
WHEREAS, there is a compelling need to prohibit all the sari-sari stores in barangay from selling cigarettes and alcoholic
beverages to minors. Further prohibiting all individuals from smoking cigarettes and drinking intoxicating beverages in
public places within the territorial jurisdictions in barangay;
WHEREAS, creating smoke-free areas helps protect the health of nonsmokers, but because it is unavoidable for others,
particularly those addicted to cigarettes, the Sangguniang Barangay designates a smoking area for them, which must be
located 20 feet from the perimeter of the area in which they are located;
NOW, THEREFORE, on motion of Sangguniang Barangay Member Committee on Social Services Maria Luz S. Cane,
duly seconded by all members present, BE IT;
RESOLVED, as it hereby resolved, to recommend to the Sangguniang Barangay of Danao, Ormoc City to regulate the use
and operation of vedioke, karaoke, amplified audio devices, and loud systems within the territorial jurisdiction of the
barangay.
RESOLVED FURTHER to furnish copies of this resolution to the Sangguniang Barangay of Danao, Ormoc City.

Pursuant to Sec. 389 Par. 6 of Republic Act No. 7160 otherwise known as the Local
Government Code of 1991, You are hereby appointed MEMBER of the BARANGAY TANOD of this
barangay effective ______________________ until it is revoked. You may now appear before me and
take your Oath of Office to qualify as Tanod Member. Henceforth you shall be deemed an agent of
person in authority.

will faithfully conscientiously discharge to the best of my ability my duties and functions as such
member and as member of BARANGAY TANOD in which I may be chosen to serve, that I will bear
true faith and allegiance to the Republic of the Philippines, support and defend its constitution; and
obey the laws and decrees promulgated by duty constituted authorities; and I voluntarily impose upon
myself this obligation without any mental reservation purpose of evasion.
