PART II: INQUEST PROCEEDINGS: MGA DAPAT TANDAAN

Section 7, Rule 112 of the Revised Rules of Court is called INQUEST PROCEEDINGS in relation to Rule
113, Section 5 (a) and (b) on WARRANTLESS ARREST. Inquest proceedings follow sa mga kaso ng mga
taong arrested WITHOUT a Warrant of Arrest or Search Warrant.

Kaya naman ang LAYUNIN lang ng inquest proceedings ay hingin ang court’s approval upang gawing
LEGAL ang pagdetain natin sa taong hinuli dahil sa paglabag sa batas kahit wala tayong hawak na
warrant of arrest or search warrant.

ITO RIN ANG DAHILAN kung bakit HINDI NA APPLICABLE ANG INQUEST PROCEEDINGS kapag PATAY na
ang mga Respondents na sangkot sa krimen kasi there will be no one to detain in the first place and to
be prosecuted in court thereafter. This is true since Article 89 of the Revised Penal Code stated that
DEATH extinguishes criminal liability...

So, if and when the Respondent died in the course of police operation, the police officers would just
narrate the incident in their reports and submit the same to their superior officers for investigation and
proper disposition. (Note: Elaboration of this topic will soon be posted…)

PERO HINDI LAHAT NG VIOLATION SA BATAS AY PWEDENG MAGUNDERGO THROUGH INQUEST.

TANDAAN: Ang mga paglabag lamang sa batas na kailangan ng preliminary investigation ang kailangang
mag-undergo through inquest, usually ito ay mga kaso at paglabag na defined and penalized ng Revised
Penal Code or Special Penal Laws (RA 9165, RA 10591, etc.).

Kaya nga ung mga caught-in-the-act na mga TRAFFIC VIOLATORS, BARANGAY/CITY/MUNICIPAL


ORDINANCE VIOLATORS like jaywalking o umiihi sa daan o nagtatapon ng basura, etc.-- since ang
kanilang paglabag ay defined and penalized ng isang traffic/ barangay/municipalcity ordinances at
MULTA (“fine”) lamang ang karampatang kaparusahan-- ay HINDI NA KAILANGANG IPRESENT PA ang
Respondent through inquest proceedings.
