CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE made and entered into this _____________________ at


Dasmarinas City, Cavite, Philippines, by and between:

ABIGAIL D. DIZON, of legal age, Filipino, and residing at Block 3 Lot 7 Phase 3
Camella Lessandra, Bucandala 4, Imus City, Cavite, hereinafter referred to as the
LESSOR.

-AND-

JUSTINE NICOLE DELOS SANTOS LIVETA, of legal age, Filipino, and both
residing at 1209 Elena St. Tondo, Manila, hereinafter referred to as LESSEE.

W I T N E S S E T H: That:

WHEREAS, the LESSOR is the absolute owner of a residential house located at BLOCK
3 PHASE 3 LOT 7 LESSANDRA CAMELLA, BUCANDALA, IMUS CITY, complete with
fixtures. Hereinafter referred to as “LEASED PREMISES”.

WHEREAS, the LESSOR has agreed to lease in favor of the LESSEE, and the LESEE has
agreed to take the lease of the residential and under the terms and conditions hereinafter set
forth.

NOW THEREFORE, for and in consideration of the foregoing premises and the mutual
covenants herein contained, the LESSORS have let and by these presents hereby lets and leases
unto the LESSEE the aforesaid LEASED PREMISES and the LESSEE hereby accepts the same by
way of lease, subject to the following terms and conditions:

1. TERMS OF THE LEASE- The term of this lease shall be for a period of FIVE (5) year
commencing on April 28 2023 to April 28, 2028 extension will be at option of the LESSOR.
The period of lease of shall be renewable in writing upon mutual agreement of the parties
under such terms and conditions as are acceptable to the LESSOR.

2. AMOUNT OF RENT- The LESSEE shall pay to the LESSORS a monthly rental of TEN
THOUSAND PESOS ONLY (Php10,000.00) Philippine Currency;

3. WATER, ELECTRIC CURRENT, ETC. – All expenses for water, gas, electric current, cable,
and maintenance for appliances, furnishings and equipment shall be for the account of the
LESSEE. The LESSOR shall not be responsible nor liable for any stoppage, failure, absence
or deficiency in such utilities and service.

4. CANCELLATION OR PRE-TERMINATION- This Contract of Lease may be pre-


terminated by the LESSEE provided that the LESSEE shall give at least thirty (30) days prior
notice in writing of such pre-termination to the LESSOR. In the event of such pre-
termination, if such pre-termination is not due to the fault or negligence of the LESSOR, the
LESSEE will forfeit the security deposit, aside from paying all outstanding bills for utilities
and repair or replacement costs of damages, if any. Notice of cancellation by the LESSEE,
once given, may not be withdrawn or revoked without the LESSOR’s written conformity.

5. CARE OF LEASED PREMISES- The LESSEE hereby expressly acknowledge that the
LEASED PREMISES is in good and tenantable condition and agrees to keep the same in
good and tenantable condition. The LESSEE shall, at all times maintain the LEASED
PREMISES and its surroundings in a clean and sanitary condition. The LESSEE hereby
agrees and binds itself to undertake at its exclusive expense all minor and ordinary repairs
as may be required to maintain the LEASED PREMISES in good state of repair.

6. USE OF PREMISES -
a. The LESSEE shall not effect or construct any major improvement in the LEASED
PREMISES without the prior consent of the LESSOR. Any renovations/constructions
made on the property using the LESSEE’s money shall not be requested to be
reimbursed.

b. The LESSOR shall be responsible for all major repairs on the LEASED PREMISES
such as water, electrical, sewage installations caused by ordinary wear and tear. If
the Lessee pays for it, it shall be deducted from the monthly rental. However, the
LESSOR shall not be responsible for any repairs due to the fault or negligence of the
LESSEE, and/or their visitors in which case, said repairs will be for the account of the
LESSEE.

7. PUBLIC SERVICE UTILITIES- During the term of this lease, the LESSEE shall pay and
defray any and all cost of water, gas, electricity, telephone, internet and all other services
connected to the LEASED PREMISES, and shall comply with any sanitary, municipal, or
provincial orders of whatever kind or nature directed against and/or pertaining to the
LEASED PREMISES. The LESSEE agrees to furnish the LESSOR copies of payments on all
utility bills on a monthly basis. If so the Lessee wishes to leave the said property, she shall
settle first the utility bills such as water and electricity connection. If she fails to do so, her
deposit shall not be refunded to her.

8. SANITATION, REPAIRS AND IMPROVEMENTS - The LESSEE shall keep the premises
clean and in sanitary condition and take good care of the unit at all times in very good
condition.

9. FIRE HAZARD AND NOXIOUS SUBSTANCE -


Should the LESSEE for whatever reason bring into the premises any apparatus, machinery
or equipment which may cause obnoxious odors, tremors or noise, expose the premises to
fire, or increase the hazard fire of the building, endanger the building or change the
insurance rates on the building, or should the LESSEE brings into the premises any articles
which the LESSOR may prohibit, then in such cases, the LESSEE hereby expressly bind
themselves to shoulder any damage thus caused and expenses thereby incurred.

10. SUB-LEASE AND/OR TRANSFER OF RIGHT - the LESSEE is absolutely prohibited from
selling, ceding, assigning or otherwise transferring his leasehold rights over the LEASED
PREMISES. It is further expressly agreed that if, at any time during the term of its lease, the
LESSEE sublet or allow or permit the LEASED PREMISES to be occupied in whole or in
part by any other person, firm or corporation in any manner not permitted under this
Contract, the LESSOR shall have the right to rescind this Contract of Lease without
prejudice to his rights under the law.

11. THIRD PARTY LIABILITY - The LESSEE, during their occupancy of the LEASED
PREMISES, shall hold the LESSOR free and harmless from any damage or liability or
responsibility to any person or property arising out of or as a consequence of the use of the
LEASED PREMISES by the LESSEE, or their agents, employees, domestic helpers and
guests when such damage or liability is caused by LESSEE’S violations, non-observance of
any policies or laws referred to and in covenants set forth in this Contract of Lease.

12. INJURY OR DAMAGE - The LESSEE hereby assumes full responsibility for any death,
injury, loss or damage caused, suffered and sustained on his person or property or on the
person or property of any third person in or about the LEASED PREMISES, and binds
himself to hold the LESSOR harmless and free from claim for any such injury or damage
from whomsoever.
The LESSOR shall not be liable or responsible for:

a) the presence of bugs, ants, termites, insects, if any, in the LEASED PREMISES.
Treatment for pest control of the unit;

b) the failure of water and/or electric supply, if the cause is due to the LESSEE or to
circumstances beyond the control of the LESSOR, or;

c) any injury, loss, damage which the LESSEE, his employees or visitors might sustain on
their property or belongings or on their person in and around the premises hereby
leased, due to theft, robbery or other crimes, or;

d) any damage done or occasioned by or arising from plumbing, gas, water, and/or other
pipes, or the explosions leakage or destruction of any tank, washstand, water closet, or
for damages caused by water coming through the roof, or otherwise leaks coming from
arising from acts or negligence of the LESSEE or all other third persons.

However, in the event of any fortuitous events or acts of God or changes of politics, such as
typhoons, earthquake, floods, war, protest, etc., then the LESSEE shall not be liable to the
LESSOR.

13. LESSOR’S LIEN

a. The LESSEE acknowledges the preferred right or lien of the LESSOR for any credit on
account of any unpaid amount due to LESSOR, upon the personal properties of the
LESSEE existing in the LEASED PREMISES in accordance with the provision of
ARTICLE 2241, Paragraph 12 of the Civil Code.

b. The LESSEE especially warrants that it is the sole and absolute owner of all property,
furniture, fixtures, machine appurtenances, etc. brought by him into the Leased
Premises, and hereby undertakes that it shall not allow the property of any third
person/party to remain or be left therein without previously notifying the LESSOR in
writing to that effect. Consequently, unless the LESSOR is so previously notified by the
LESSEE all properties found in the Leased Premises are conclusively presumed as
properties of LESSEE and subject to the LESSOR’s liens.

14. BREACH OF CONDITIONS - In the event of failure of the LESSEE to pay the monthly rent
in the amount and on the date agreed upon, or in case of breach by the LESSEE of any of
the conditions and covenants of this Contract of Lease or should the LESSEE abandons or
vacates said premises before its expiration, the LESSOR has the option to automatically
terminate this Contract of Lease and exercise his right to extra-judicially eject the LESSEE,
and be entitled to collect whatever damages as provided in the Contract of Lease or by law.

15. WARRANTIES OF LESSOR - During the existence and continuance of this agreement
without any arrearages in rental payments by the LESSEE, the LESSOR warrants the
peaceful possession, use and enjoyment of the LEASED PREMISES by the LESSEE.

16. ATTORNEY’S FEES - In the event of any breach of this agreement by the LESSEE and the
LESSOR, the party causing the breach shall pay the aggrieved party, the sum equivalent to
twenty five percent (25%) of the total amount claimed in the complaint by court of law or
arbitration as and for the attorney’s fees which amount, however, shall in no case be less
than Five Thousand Pesos (Php5,000.00) nor more than Twenty-Five Thousand Pesos
(Php25,000.00) in Philippine currency plus the cost of the suit.
