Ⅰ. 의약품 규제기관
1. 미국 식품의약품청1)
미국 식품의약품청(Food and Drug Administration, FDA)은 인체 및 동물용
의약품, 생약 제제, 의료기기, 국가 식량 공급, 화장품, 방사선 제품의 안전성,
유효성 및 안전을 보장함으로써 공중보건을 보호하는 기관이다.
1.1 조직
미국 식품의약품청은 청장직속실과 식품의약품청의 주요 기능을 감독하는 5개의 국
(의료제품 및 담배관리국, 식품·동물용의약품국, 글로벌 규제운영·정책국, 운영지원국
및 정책·기획·법무·분석국)로 구성된다(그림 1 참조).

연방법령에 따라 인체용 생물의약품을 규제한다. 생물의약품평가연구센터는
생물의약품의 안전성 및 유효성을 확보하고, 필요한 사람들이 이용
가능하도록 보장함으로써 공중보건을 보호하고 증진하는 역할을 한다.
또한, 생물의약품의 안전하고 적절한 사용을 도모하기 위해 대중에게 관련
정보를 제공하고 있다.
3) 의약품평가연구센터 산하
의약품평가연구센터는 의약품 규제를 담당하는 아래의 실들로 구성된다.
센터장실(Office of the Center Director)
커뮤니케이션실(Office of Communications, OCOMM): 커뮤니케이션실은
다음의 기능을 수행하며, 인체용 의약품 정보를 제공한다.
(1) 센터 및 미국 식품의약품청의 리더십에 대한 전략적 커뮤니케이션에
대한 조언 제공
(2) 의약품평가연구센터의 이해관계자가 필요로 하는 정보에 대한 관리
(3) 대내외 커뮤니케이션 및 교육 활동 개발 및 조정
(4) 의약품평가연구센터의 커뮤니케이션에 대한 일관성 있는 브랜드 관리
(5) 메시지 전달, 전략적 방향을 보장하기 위한 포괄적인 커뮤니케이션
접근법 활용
(6) 내외 협력자 및 이해관계자와 협력
(7) 홍보 및 교육을 위한 멀티미디어 커뮤니케이션에 대한 전문성 제공
감시실(Office of Compliance, OC): 감시실은 안전성과 유효성이 없고 낮은
품질의 의약품에 대한 소비자의 노출을 최소화함으로써 공중보건을
증진하고 보호한다.

제네릭의약품실 (Office of Generic Drugs, OGD): 제네릭의약품실은
안전하고 유효성 있는 우수한 품질의 제네릭의약품을 환자들이 이용할 수
있도록 신속한 처리를 위한 규제 감독을 수행한다. 또한 규제 대상 업계에게
제네릭의약품 관련 다양한 임상, 과학, 규제 문제들에 대한 지침을 제공한다.

전략프로그램실(Office of Strategic Programs, OSP): 전략프로그램실은 의약품
평가연구센터의 기획, 분석, 사업정보 활동에 관해 센터장, 의약품평가연구
센터 및 다른 주요 기관의 관계자들에게 조언을 제공하고 협력한다.
사후조사 및 역학조사실(Office of Surveillance and Epidemiology, OSE):
사후조사 및 역학조사실은 의약품 개발 과정 동안 발생하지 않은 유해사례를
파악하기 위해 시판 후 감시와 위해평가 프로그램을 수행한다. 이러한
활동에는 의약품 표시기재사항 갱신, 관련 커뮤니티에 보다 많은 정보 제공,
위해관리 프로그램의 실행 및 개정, 허가 또는 판매 결정의 재평가 등이 있다.
중개연구실(Office of Translational Sciences, OTS): 중개연구실은 통계과,
임상약리과, 의약품평가연구센터와 미국 식품의약품청 내 센터 산하
국들과의 협력을 통해 의약품의 유효성, 안전성 및 용법용량을 정량적으로
평가하기 위한 효율적이고 유용한 시험 설계 및 자료 분석 방법을 연구한다.

1. 연방 식품 ․ 의약품 ․ 화장품법4)
『연방 식품·의약품·화장품법(Federal Food, Drug and Cosmetic Act, FD&C 법)』
은
미국 내 의약품 허가의 기본법령이다. 1938년 통과된 이 법은 미국 식품의약품청이
신약의 안전성에 대한 근거를 요구하고, 식품에 대한 기준을 발행하고, 제조소
실태조사를 수행하도록 권한을 부여하는 것을 포함, 공중보건 시스템에 대해
다루고 있다.
『연방 식품·의약품·화장품법』
은 10개의 장(Chapter)으로 구성되어 있다.

2. 연방 규정집5)
미국『연방 규정집(Code of Federal Regulations, CFR)』
은 집행부에서 연방관보에
게재한 총칙 및 영구 규정의 법전이다. 연방 규정집의 Title 21–식품과 의약품(또는
21 CFR)은 미국 식품의약품청을 위한 규정이다. 연방 규정집의 각 타이틀은 매년
한번씩 개정된다.
3. 관련 지침
지침(Guidance)은 어떤 주제에 대한 미국 식품의약품청의 현재 견해를 나타낸다.
지침은 특정인을 위한 또는 특정인의 권리를 창출하거나 부여하지 않으며 미국
식품의약품청 또는 대중을 구속하도록 운영되지 않는다. 만일 적용 가능한 법령
및 규정의 요건에 부합할 경우, 대안이 되는 다른 방법을 사용할 수 있다. 지침은

Ⅲ. 의약품의 분류
1. 신약
『연방 식품·의약품·화장품법』321조에 따라 “신약”의 정의는 다음과 같다.

1.1 희귀의약품6), 7)
희귀의약품은『연방식품·의약품·화장품법』
의 526조에 정의된 바와 같이
“희귀질환 또는 증상에 사용되는 의약품”을 의미한다.
『희귀의약품 법』
에 따른 희귀질환 또는 증상이란, (A) 미국에서 20만명 미만의
사람들에게 영향을 미치거나, (B) 미국에서 20만명보다 많은 사람들에게 영향을
미치면서, 해당 질환 또는 증상을 위한 의약품을 미국에서 판매함으로써 그 개발
및 이용 가능하게 하는 비용을 회수할 수 있다는 합리적인 기대가 없는 질환과
증상을 의미한다.
2. 제네릭의약품
“제네릭의약품”은 선발의약품과 제형, 안전성, 함량, 투여 방법, 품질, 성능 특성,
용도 면에서 생물학적동등성을 가지는 의약품이다. 제네릭의약품은 대상이 되는
선발제품과 화학적으로 동등하지만 전형적으로 선발제품 가격에 비해 상당히
낮은 가격으로 판매된다.8)
3. 일반의약품9)
일반의약품(Over-the-Counter, OTC)은 처방전 없이 일반 대중이 사용할 수 있는
안전하고 유효성 있는 의약품이다. 약 800개의 중요한 유효성분을 포함하여
10만여개의 일반의약품이 시판되고 있다. 여드름치료용 의약품에서부터
체중조절용 의약품까지 80여개의 치료적 카테고리 이상의 일반의약품이 있다.
의약품평가연구센터는 처방의약품과 마찬가지로, 일반의약품이 적절하게 표시
기재되고, 의약품의 유익성이 위해성을 상회하도록 관리 ․ 감독한다.

1. 임상시험계획 승인신청
1.1 신청 유형10)
임상시험계획 승인신청(Investigational New Drug application, IND)은 판매용
및 연구용(비판매용) 두 가지 범주가 있으며 다음과 같은 세 가지 신청유형이 있다.

본 항에 따른 치료용 사용이 가능하다. 즉각적으로 생명을 위협할 수 있는
질환의 경우, 임상 3상 이전이라 하더라도, 통상 임상 2상 이전이 아니라면 해당
의약품을 본 항에 따른 치료용으로 사용 가능할 수 있다.
1.2 절차12)
임상시험계획 승인신청서 제출 시, 임상시험 의뢰자는 신청서를 3부(원본 1부,
사본 2부) 송부해야 한다. 가능할 경우 전자 제출 또한 고려된다.
각 신청에는 다음 자료가 첨부되어야 한다.
1) 식품의약품청 양식 1571 (임상시험계획 승인신청서 표지)
2) 식품의약품청 양식 1572 (연구자의 기술서)
3) 식품의약품청 양식 3674 (증명서 요건 및 임상시험의 결과의 ClinicalTrials.gov를
통한 의무적 등록 및 보고)
임상시험계획 승인신청서 송부용 주소는 미국 식품의약품청 웹사이트 내 연구자
개시 임상시험계획승인 신청 메뉴에서 찾을 수 있다.13) 임상시험계획 승인신청서를
수령하면, 미국 식품의약품청은 임상시험계획 승인신청 확인서를 통해 신청
접수일자를 의뢰자에게 고지한다.
1.3 심사기간14)
임상시험계획 승인신청은 미국 식품의약품청이 의뢰자에게 신청서에 기술된
시험이 임상시험 보류 대상(Clinical Hold)이라고 통지하거나 임상시험계획
승인신청의 임상시험을 시작할 수 있다고 미리 통지를 하지 않는 한 해당 신청이
접수된 후 30일에 효력을 가지게 된다. 이 기간 동안 미국 식품의약품청은 시험
대상에 부적합한 위해가 없음을 보증할 안전을 위해 임상시험계획 승인신청에
대한 심사를 수행한다. 의뢰자는 해당 시험이 적합한 승인을 받기 전에
임상시험을 시작하지 않아야 한다.

임상시험 중 의뢰자는 미국 식품의약품청에 관련 회의를 요청할 수 있다. 더

2.2.1 정의
505(b)(2) 신약 허가신청(NDA 505(b)(2))은 허가신청에 따른 하나 이상의 시험이
“신청자에 의해 또는 신청자를 위해 수행되지 않았고, 신청자가 시험을 수행한
자 또는 시험이 그를 위해 수행된 자로부터 참조권(right of reference)이나
사용권을 득하지 못했을 때” 이루어진다.

2.2.2 505(b)(2) 신약 허가신청 대상
아래 유형의 의약품 또는 의약품 신청은 505(b)(2) 신약 허가신청 대상이다:
1) 신화학물질/신분자물질 (New chemical entity, NCE/new molecular entity, NME)
505(b)(2) 신약 허가신청은 허가에 필요한 자료의 일부가 신청자에 의해 또는
신청자를 위해 수행되지 않은 시험에서 유래되었고 신청자가 참조권을 득하지
못하였을 때 신화학물질(NCE)에 대한 신약 허가신청서가 제출될 수 있다.
신화학물질에 대한 해당 자료는 의약품의 안전성과 유효성에 대한
식품의약품청의 이전 검토 결과보다는, 출간된 연구자료에서 비롯되었을
가능성이 크다. 신청자가 허가에 필요한 모든 정보에 대한 참조권이 있을
경우에는 해당 신청자가 시험을 수행하지 않았다 하더라도 해당 신청은
505(b)(1)신청으로 간주된다.
2) 기 허가 받은 의약품에 대한 변경
기 허가 받은 의약품에 대한 변경일 경우, 신청은 허가된 제품의 변경사항을
뒷받침하는데 필요한 정보와 함께 기허가된 제품의 안전성 및 유효성에 대한
미국 식품의약품청의 검토결과에 좌우될 수 있다. 추가 정보는 신청자가
수행한 새로운 시험 결과 또는 출간된 자료일 수 있다.
2.2.3 505(b)(2) 신청 예시
1) 제형: 경구용 고형제제에서 피부 접착용 패치로 변경하는 등 제형 변경에 대한 신청
2) 함량: 보다 낮거나 높은 함량으로 변경하는 것에 대한 신청
3) 투여경로: 정맥에서 척수강내로 투여경로를 변경하는 등 투여경로에 대한 신청
4) 조성: 승인에 필요한 시험이 제네릭의약품 신청에 적절한 한정된 확증시험으로
여겨지는 시험을 넘어서는, 기허가와 다른 종류 및 다른 분량의 첨가제를
포함하는 완제의약품 신청
5) 용법: 하루 두 번에서 한 번으로 변경하는 등 새로운 투여요법에 대한 신청
6) 주성분: 동일한 주성분을 함유하는 기허가 의약품의 주성분의 다른 염, 에스테르,
콤플렉스, 킬레이트, 클라스레이트, 라세미체, 거울상 이성질체 등에 대한 변경 신청
7) 신분자물질: 일부의 경우, 신분자물질은 신청자가 아닌 그룹에 의해 시험되었고,
출간된 정보가 신규 신청에 적절할 수 있다. 이는 신분자물질이 허가된
의약품의 전구체(prodrug)이거나 허가된 의약품의 활성 대사산물(active
metabolite)일 때 특히 가능하다. 일부 경우, 유사한 약리효과를 가진 의약품의
승인에 중요하게 고려될 수 있다.

8) 복합 제품: 주성분이 개별적으로 승인된 신규 복합 제품에 대한 신청
2.2.4 절차

2.3 심사기간
『처방의약품 신청자 수수료 법(Prescription Drug User Fee Act, PDUFA)』
에 따라
의약품평가연구센터는 신청 접수 후 10개월의 기간까지 표준심사 의약품에 대한
신약 허가신청의 최소 90%에 대하여 심사 및 결정을 내려야 한다. 우선심사
의약품에 대한 심사 목표 기간은 6개월이다.
2.4 제출자료
2.4.1 제출 양식
신약 허가신청은 국제공통기술문서(Common Technical Document, CTD) 양식을
사용하여 종이 또는 전자 제출할 수 있다. 국제공통기술문서 양식에 대한 자세한

2.4.2 제출자료
신청서와 함께 신약 허가신청을 위한 제출 자료는 해당 의약품의 전체 내용을
설명해야 하는데, 이는 임상시험 중 발생한 내용, 의약품의 원료, 동물 시험 결과,
체내에서의 의약품의 작용에 대한 설명과 제조, 처리, 포장 방법 등을 포함한다.
또한 신청서에는 화학, 약리학, 의학, 생물약제학을 포함, 심사를 위한 특정한
전문적 관점에서의 자료를 반드시 포함하여야 한다.

원료의약품과 완제의약품 제조, 시험, 포장/보관에 사용되는 모든
시설은 실태조사 대상이며 반드시 허가 시점에 해당 기준을 준수해야만
한다. 실태조사 프로그램은 자료 무결성을 확인하는 목적이 있다. 자료
무결성이 의심스러울 경우, 모든 심사는 보류된다. 실사 유형에는 허가
전 실사, 허가 후 실사, 특별 실사가 있다.
(5) 제네릭의약품 허가신청 승인
심사 결과에 따라, 제네릭의약품 허가신청은 해당 의약품이 승인
가능하고, 관련 모든 시설이 요건에 부합하는지 결정하기 위한 심사 및
실사가 이루어진다. 제네릭의약품 허가신청 승인에는 두 가지 유형이 있다.

4.3.3 생물학적 동등성 시험44)
생물학적 동등성 자료 요건에 대한 미국 식품의약품청의 최종 규정은 제네릭의약품이
현재 생동성 기준에 부합한다고 증명하지 못한 시험을 포함하여 허가를 위해
제출된 완제의약품 배합에 대해 신청자가 수행한 모든 생물학적 동등성 시험들의
자료를 제네릭의약품 허가신청자가 제출하도록 요구하고 있다. 동일한 완제의약품
배합에 수행된 모든 생물학적 동등성 시험들은 반드시 생물학적 동등성 자료의 완전한
시험 보고서 또는 요약 보고서 형태로 미국 식품의약품안전청에 제출되어야 한다.
약동학 시험 및 약력학 시험 등 여러 in vivo 및 in vitro 시험들이 제네릭의약품과
대조약 간의 흡수율과 흡수 정도를 비교하는데 사용될 수 있다.
생물학적 동등성 자료 규정에서 개정 및 명확히 된 바와 같이 미국 식품의약품청
규정은 신청자가 허가를 위해 근거한 생물학적 동등성 시험에 대한 완전한
보고서를 제출하고, 동일한 완제의약품 배합에 수행된 각각의 추가 시험에 대한

4.4.2 허가-특허 연계
치료용 생물학적 제제를 제외한 신약 및 제네릭의약품과 같은 모든 기허가
완제의약품은 미국 식품의약품안전청의 오렌지북(치료학적 동등성 평가가
포함된 기허가 완제의약품)에 등재되어 있다.
각 특허의 경우, 신청자의 의견과 지식에 따라 신청하는 등재 대조약의 특허를
청구하거나, 신청자가 허가 받기 원하고 관련 정보를 제시해야 할 필요가 있는
등재 대조약의 사용을 청구하는 미국 특허청에서 발행한 각 특허와 관련된
증명서를 제출한다.
신청자가 관련 특허가 무효 또는 특허가 적용 불가하거나, 침해되지 않는다는
것을 증명하고, 특허권의 소유자나 그 대리인, 또는 독점 특허 허가 소지자가
법령 314.52 또는 314.95에 의거하며 신청자의 증명서 통지를 수령한지 45일 내에
특허 침해에 대해 소송을 제기할 경우, 법원에서 원고 또는 피고가 합리적으로
소송을 추진함에 있어 협조하지 않음으로 인해 해당 기간을 연장 또는 축소하지
않는 한, 허가는 특허 소유자 및 독점 허가 소지자(또는 대리인)가 증명서 통지를
수령한 일자에서 30개월 간 유효할 수 있다.
180일 독점권: 특정 상황에서는, 증명서(해당 특허가 무효하거나 제네릭의약품
허가신청이 제출된 완제의약품의 제조, 사용, 판매로 인해 침해되지 않는다는
기술서)를 포함하는 제네릭의약품 허가신청자는 최초 신청자의 의약품의
첫 판매 또는 증명서의 대상인 특허가 무효하거나 침해되지 않았다는
법원의 결정 후 180일 동안 동일한 완제의약품의 후속 제네릭의약품에 대해
경쟁에서 보호받는다.

5.1. 목적
신속심사의 목적은 해당 의약품이 특정 질환에 대해 최초의 이용 가능한
치료법이거나 기존의 치료보다 이점이 있을 경우, 중대한 질환을 치료하는
의약품을 신속하게 이용 가능하게 함에 있다.
미국 식품의약품청은 해당 의약품을 가능한 한 신속하게 이용 가능하도록 하는

5.2.3 신속 심사52)
신약 개발 시, 의약품이 실제로 환자의 생존, 감정 또는 기능에 어떻게 영향을
주는 지 여부를 아는 데 때로는 수년이 걸릴 수 있다. 주어진 질환에서 임상적으로
의미 있는 긍정적 치료 효과를 “임상적 유익성(Clinical benefit)”이라고 한다.
의약품의 의도된 임상적 유익성을 측정하는데 긴 시간이 걸릴 수도 있다는 사실을
고려하여, 1992년 미국 식품의약품청은 신속심사(Accelerated Approval) 규정을
마련하였다. 이 규정은 중대한 상태에 대해 미충족 의료수요를 채우는 의약품이
대리결과변수에 근거하여 허가되도록 허용한다. 대리결과변수의 사용은 미국
식품의약품청이 이러한 의약품을 보다 신속하게 허가하도록 한다.

1. 의약품 제조 및 품질관리기준
1.1 개요
완제의약품의 품질은 의약품 제조 및 품질관리기준(Current Good Manufacturing
Practice, cGMP) 규정에 따라 관리된다. 신약과 제네릭의약품 허가 신청
프로세스에서 완제의약품을 제조하는 시설, 장비, 기술에 대한 의약품 제조 및
품질관리기준 심사가 수행된다. 관련 규정 및 지침 문서는 미국 식품의약품청
홈페이지에서 이용 가능하다.55)
미국 식품의약품청 의약품품질실 뿐만 아니라 의약품평가연구센터 감시실, 규제
사업부(Office of Regulatory Affairs, ORA) 지역 사무소, 미국 식품의약품안전청
분석 연구실 모두 사전허가 의약품 제조 및 품질관리기준(GMP)에 대한 적합성
실사에 참여한다.
1.2.1 목적
1) 판매용 제조를 위한 준비: 제조소에 시설 및 판매용 제조 운영에 대한 충분한
관리를 수행할 품질 시스템이 갖춰져 있는지 여부를 결정한다.

2.1 개요57)
2.1.1 원료의약품등록
원료의약품등록(Drug Master File, DMF)은 시설, 공정 및 제조방법·공정·포장·
보관에 관한 자료에 대한 상세한 기밀정보를 미국 식품의약품청에 제출해야 한다.
원료의약품등록은 법이나 미국 식품의약품청의 규정에 의한 것은 아니며, 오직
원료의약품의 품목권자의 의사에 따라 제출된다. 원료의약품등록에 기재된 정보는
임상시험계획 승인신청(IND), 신약 허가신청(NDA), 제네릭의약품 허가신청
(ANDA), 다른 원료의약품등록 심사, 수출 신청 또는 변경 신청 시 입증자료로
활용한다.

6. 수수료
6.1.1 개요
『처방의약품 신청자 수수료 법(Prescription Drug User Fee Act, PDUFA)』은
1992년에 제정되었고 1997년(PDUFA II), 2002년(PDUFA III), 2007년(PDUFA IV),
2012년(PDUFA V)에 개정되었다. 이 법은 미국 식품의약품청이 특정 인체용
의약품 및 생물의약품을 생산하는 회사로부터 수수료를 징수하도록 권한을
부여한다.『처방의약품 신청자 수수료 법』제정 이래, 신청자 수수료는 의약품
허가 프로세스를 신속하게 하는 데에 있어 중요한 역할을 하였다.
55 미국 의약품허가제도
안전성 또는 유효성 관련 임상자료(생체이용률 또는 생동성시험 외)가
허가에 필요한 인체용 의약품 허가신청에 대한 변경신청은 신청 수수료
전액의 절반이 부과된다.
3) 처방의약품 품목 수수료
이 수수료는 인체용 의약품 허가신청서에서 신청자로 기재한 자와 인체용 의약품
허가신청의 신청자, 1992년 9월 1일 이후 인체용 의약품 허가신청 또는 변경신청이
보류된 자가 지불하여야 한다.
6.1.3 예외사항70)
미국 식품의약품청은『연방 식품·의약품·화장품법』의 736(d)조에 따라 신청자가
다음 중 하나의 적격 기준에 부합하는 경우 736(a)조에 의해 부과된 하나 이상의
신청자 수수료를 면제 또는 인하한다.
1) 공중보건 보호에 필요한 경우

2) 사용할 수 있는 자원이 한정되어 있거나, 여러 상황에 따라 수수료 부과가
개선에 상당한 장애가 되는 경우

또한 해당 법은 인체용 의약품 허가신청 심사 프로세스 수행 시 보건복지부에
발생하는 현재 예상 비용 및 향후 비용에 대한 수수료가 초과되는 경우, 해당
신청자 수수료를 면제 또는 인하할 수 있다.

2012년『제네릭의약품 신청자 수수료 개정법(Generic Drug User Fee Amendments,
GDUFA)』
은 대중이 안전하고 유효성있는 의약품을 신속하게 이용할 수 있게
하고, 업계에 대한 비용을 절감하기 위해 수립되었다. 이 법은 제네릭의약품
허가신청 심사와 시설 실사에 대한 비용을 충당하기 위해 업계가 신청자 수수료를
지불하도록 요구한다. 추가 자원들은 미국 식품의약품청이 보류 중인 신청의 현재
미처리분과 안전성을 위한 제네릭의약품 허가신청을 심사하는데 필요한 평균

필드 2: 제출일자
신청서를 미국 식품의약품청에 제출한 일자를 기입한다. 기입한 일자는 제출용 표지

필드 5: 의약품명
의약품명에는 제네릭의약품명이 있을 경우 상품명을 기입한다. 또한 제형,

1. New drug
According to the『FD&C Act』Sec 321, the term “new drug” means:
1) Any drug (except a new animal drug or an animal feed bearing or containing
a new animal drug) the composition of which is such that such drug is not
generally recognized, among experts qualified by scientific training and
experience to evaluate the safety and effectiveness of drugs, as safe and
effective for use under the condition prescribed, recommended, or suggested
in the labeling thereof, or
2) Any drug (except a new animal drug or an animal feed bearing or containing
a new animal drug) the composition of which is such that such drug, as
a result of investigations to determine its safety and effectiveness for use
under such conditions, has become so recognized, but which has not,
otherwise than in such investigations, been used to a material extent or for
a material time under such conditions.

1.1 Orphan drug6), 7)
Orphan drug means “a drug intended for use in a rare disease or condition”
as defined in section 526 of the『FD&C Act』.
According to the『Orphan Drug Act』
, “rare disease or condition” means “any
disease or condition which (A) affects less than 200,000 persons in the United
States, or (B) affects more than 200,000 in the United States and for which there
is no reasonable expectation that the cost of developing and making available
in the United States a drug for such disease or condition will recovered from
sales in the United States of such drug.”
2. Generic drug
“Generic drug” is bioequivalent to a brand name drug in dosage form, safety, strength,
route of administration, quality, performance characteristics, and intended use.
Although generic drugs are chemically identical to their branded counterparts,
they are typically sold at substantial discounts from the branded price.8)
3. Over-the-Counter drug9)
Over-the-counter (OTC) drugs are defined as drugs that are safe and effective
for use by the general public without a prescription. More than 100,000 OTC
drug products are marketed, encompassing about 800 significant active
ingredients. There are more than 80 classes (therapeutic categories) of OTC
drugs, ranging from acne drug products to weight control drug products. As
with prescription drugs, the Center of Drug Evaluation and Research (CDER)
oversees OTC drugs to ensure that they are properly labeled and that their
benefits outweigh their risks.

treatment use under this section earlier than Phase 3, but ordinarily not
earlier than Phase 2.
1.2 Procedure12)
When submitting original IND applications, sponsors are expected to send their
applications in triplicate (one original and two copies). Electronic submissions
should be considered whenever possible.
Each application should be accompanied by:
1) FDA Form 1571 (IND application cover);
2) FDA Form 1572 (Investigator’s statement); and
3) FDA Form 3674 (Certification requirement & mandatory registration and
reporting of results for applicable clinical trials through ClinicalTrials.gov)
The current address for sending IND applications may be found at the FDA
website under Investigator-Initiated Investigational New Drug (IND)
Applications.13) When IND application is received, FDA will notify the sponsor
of the date it receives the application through an IND acknowledgment letter.
FDA is able to validate the data from the study through an onsite
inspection if the agency deems it necessary.
A sponsor or applicant who submits data from a foreign clinical study not
conducted under an IND as support for an IND or application for marketing
approval must submit to FDA, a description of the actions the sponsor or
applicant took to ensure that the research conformed to GCP. The description
is not required to duplicate information already submitted in the IND or
application for marketing approval. Instead, the description must provide either
the following information or a cross-reference to another section of the
submission where the information is located:
The investigator's qualifications;
A detailed summary of the protocol and results of the study and, should
FDA request, case records maintained by the investigator or additional
background data such as hospital or other institutional records;

including a description of the components, formulation, specifications,
and, if available, bioavailability of the specific drug product used in the
clinical study;

2.1.2 Procedure
New Drug Application (NDA) - This is the formal step a drug sponsor takes
to ask that FDA consider approving a new drug for marketing in the United
States. An NDA includes all animal and human data and analyses of the data,
as well as information about how the drug behaves in the body and how it
is manufactured.23)
NDA processes follow steps as below:
1) Pre-NDA Meeting24)
When an NDA comes in, FDA has 60 days to decide whether to file it
so that it can be reviewed. FDA can refuse to file an application that
is incomplete.
The review team analyzes study results and looks for possible issues with
the application, such as weaknesses of the study design or analyses.
Reviewers determine whether they agree with the sponsor’s results and
conclusions, or whether they need any additional information to make
a decision.

2.2.2 Subjects to 505(b)(2) application
The following types of drugs or drug application is subjected to 505(b)(2)
application:
New chemical entity/new molecular entity (NCE/NME):
A 505(b)(2) application may be submitted for an NCE when some part
of the data necessary for approval is derived from studies not conducted
by or for the applicant and to which the applicant has not obtained a
right of reference. For an NCE, this data is likely to be derived from
published studies, rather than FDA's previous finding of safety and
effectiveness of a drug. If the applicant had a right of reference to all
of the information necessary for approval, even if the applicant had not
conducted the studies, the application would be considered a 505(b)(1)
application.
7) New molecular entity: In some cases a new molecular entity may have been
studied by parties other than the applicant and published information may
be pertinent to the new application. This is particularly likely if the NME
is the prodrug of an approved drug or the active metabolite of an approved
drug. In some cases, data on a drug with similar pharmacologic effects could
be considered critical to approval.
11) OTC monograph: An application for a drug product that differs from a
product described in an OTC monograph (21 CFR 330.11), such as a
non-monograph indication or a new dosage form.

With the application form, the related documentation required in an NDA is
supposed to tell the drug's whole story, including what happened during the

6) If there is a listed drug that is the pharmaceutical equivalent of the drug
proposed in the 505(b)(2) application, the 505(b)(2) applicant should provide

3.2 Required dossiers34)
For orphan drug designation, a sponsor shall submit two copies of a completed,
dated, and signed request for designation that contains the following:
1) A statement that the sponsor requests orphan-drug designation for a rare
disease or condition, which shall be identified with specificity.
2) A description of the rare disease or condition for which the drug is being
or will be investigated, the proposed use of the drug, and the reasons why
such therapy is needed.
3) Where the sponsor of a drug that is otherwise the same drug as an already
approved drug seeks orphan-drug designation for the subsequent drug for
the same rare disease or condition, an explanation of why the proposed
variation may be clinically superior to the first drug.
4) Where a sponsor requests orphan-drug designation for a drug for only a
subset of persons with a particular disease or condition that otherwise affects
200,000 or more people (“orphan subset”), a demonstration that, due to one
or more properties of the drug, the remaining persons with such disease
or condition would not be appropriate candidates for use of the drug.
5) A summary of the regulatory status and marketing history of the drug in
the United States and in foreign countries, e.g., IND and marketing
application status and dispositions, what uses are under investigation and
in what countries; for what indication is the drug approved in foreign
countries; what adverse regulatory actions have been taken against the drug
in any country.
The disease or condition for which the drug is intended affects fewer
than 200,000 people in the United States or, if the drug is a vaccine,
diagnostic drug, or preventive drug, the persons to whom the drug will
be administered in the United States are fewer than 200,000 per year or

3.3 Data submission or fee exemptions of orphan drug35), 36), 37), 38)
A supplement proposing to include a new indication for a rare disease or
condition in a human drug application shall not be subject to the fee, if the
drug has been designated as a drug for a rare disease or condition with regard
to the indication proposed in such supplement.
A drug designated and approved for a rare disease or condition shall be exempt
from product and establishment fees, if the drug meets all of the following
conditions:
(A) The drug meets the public health requirements contained in the Public
Health Service Act as such requirements are applied to requests for waivers
for product and establishment fees.
(B) The drug is owned or licensed and is marketed by a company that had

4. Generic drug application
2) Filing review
Filing review is conducted to determine whether the application is
sufficiently complete to permit a substantive review. Acceptance/Refuse to
Receive (RTR) letter is issued based on completeness of the Abbreviated New
Drug Application (ANDA). The regulatory filing checklist is updated on a
quarterly basis (calendar year) and on an as needed basis.
3) Review process
Bioequivalence review39)
The evaluation of bioequivalence (BE) in the generic drug context is used to
support a determination that a generic product may be substituted for its
reference listed drug, and involves consideration of different types of data
permitted in an ANDA. Bioequivalence study evaluates the following areas:
- Clinical area (treatment)
- Analysis (biological fluid analysis)
- Statistics (bioequivalence)
Several in vivo and in vitro methods can be used to measure BA and establish
BE. These include, in general order of preference, pharmacokinetic (PK)
studies, in vitro tests predictive of human in vivo BA (in vitro-in vivo
correlation), pharmacodynamic (PD) studies, studies with clinical benefit
endpoints, and other in vitro studies. Complete study data also contains the
following:
- comparative BA and BE study reports (e.g., fasting studies, fed studies)

Fast Track designation must be requested by the drug company. The request
can be initiated at any time during the drug development process. FDA will
review the request and make a decision within 60 days based on whether the
drug fills an unmet medical need in a serious condition.
Once a drug receives Fast Track designation, early and frequent communication
between FDA and a drug company is encouraged throughout the entire drug
development and review process. The frequency of communication assures that
questions and issues are resolved quickly, often leading to earlier drug approval
and access by patients.

context of a given disease is known as “clinical benefit”. Mindful of the fact
that it may take an extended period of time to measure a drug’s intended clinical
benefit, in 1992 FDA instituted the Accelerated Approval regulations. These
regulations allowed drugs for serious conditions that filled an unmet medical
need to be approved based on a surrogate endpoint. Using a surrogate endpoint
enabled FDA to approve these drugs faster.
A surrogate endpoint used for accelerated approval is a marker - a laboratory
measurement, radiographic image, physical sign or other measure that is
thought to predict clinical benefit, but is not itself a measure of clinical benefit.
Likewise, an intermediate clinical endpoint is a measure of a therapeutic effect
that is considered reasonably likely to predict the clinical benefit of a drug,
such as an effect on irreversible morbidity and mortality (IMM).
FDA bases its decision on whether to accept the proposed surrogate or
intermediate clinical endpoint on the scientific support for that endpoint. Studies
that demonstrate a drug’s effect on a surrogate or intermediate clinical endpoint
must be “adequate and well controlled” as required by the『FD&C Act』
.
Using surrogate or intermediate clinical endpoints can save valuable time in
the drug approval process. For example, instead of having to wait to learn if
a drug actually extends survival for cancer patients, FDA may approve a drug
based on evidence that the drug shrinks tumors, because tumor shrinkage is
considered reasonably likely to predict a real clinical benefit. In this example,
an approval based upon tumor shrinkage can occur far sooner than waiting
to learn whether patients actually lived longer. The drug company will still
need to conduct studies to confirm that tumor shrinkage actually predicts that
patients will live longer. These studies are known as phase 4 confirmatory trials.
Where confirmatory trials verify clinical benefit, FDA will generally terminate
the requirement. Approval of a drug may be withdrawn or the labeled
indication of the drug changed if trials fail to verify clinical benefit or do not
demonstrate sufficient clinical benefit to justify the risks associated with the
drug (e.g., show a significantly smaller magnitude or duration of benefit than
was anticipated based on the observed effect on the surrogate).

6.1.1 Overview
The『Prescription Drug User Fee Act (PDUFA)』was enacted in 1992 and
renewed in 1997 (PDUFA II), 2002 (PDUFA III), 2007 (PDUFA IV), and 2012
(PDUFA V). It authorizes the FDA to collect fees from companies that produce
certain human drug and biological products. Since the passage of the PDUFA,
user fees have played an important role in expediting the drug approval process.
There are three types of PDUFA fees - Human drug application and supplement
fee, Prescription drug establishment fee, and Prescription drug product fee, and
the PDUFA68) are as follows:

This fee is required by the person who is named as the applicant in a human
drug application, and who, is the applicant of the human drug application,
and had a human drug application or supplement pending after September
1, 1992.
6.1.3 Exceptions70)
According to section 736(d) of the Act, FDA will grant a waiver of or reduction
in one or more user fees assessed under section 736(a) of the Act where it finds
that an applicant meets the eligibility criteria under one of the following
provisions:
1) A waiver or reduction is necessary to protect the public health.
2) The assessment of the fee would present a significant barrier to innovation
because of limited resources available to the person or other circumstances.
3) The applicant is a small business submitting its first human drug application
to the Secretary for review.

The Act also provides for waiver or reduction of user fees if the fees would
exceed the anticipated present and future costs incurred by the Secretary in
conducting the process for the review of human drug applications for the person.

There are other exceptions for each type of PDUFA fees as follows:
Human drug application and supplement fee
(1) Exception for previously filed application or supplement
If a human drug application or supplement was submitted by a person
that paid the fee for such application or supplement, was accepted
for filing, and was not approved or was withdrawn (without a
waiver), the submission of a human drug application or a supplement
for the same product by the same person (or the person's licensee,
assignee, or successor) shall not be subject to a fee mentioned above.
(2) Exception for designated orphan drug or indication
A human drug application for a prescription drug product that has
been designated as an orphan drug shall not be subject to a fee
mentioned above, unless the human drug application includes an
indication for other than a rare disease or condition. A supplement
proposing to include a new indication for a rare disease or condition
in a human drug application shall not be subject to a fee
Prescription drug establishment fee
If, during the fiscal year, an applicant initiates or causes to be initiated
the manufacture of a prescription drug product at an establishment listed
in its human drug application:
(1) that did not manufacture the product in the previous fiscal year; and
(2) for which the full establishment fee has been assessed in the fiscal
year at a time before manufacture of the prescription drug product
was begun; the applicant will not be assessed a share of the
establishment for the fiscal year in which the manufacture of the
product began.

the reference listed drug (ANDA) or listed drug(s) (505(b)(2) NDA) that is/are
the basis for the application, the application number(s) for the listed drug(s), and
indicate what type(s) of patent certification or statement described under 21 CFR
314.50(i) is provided within the application.
Field 21: Select one of the submission types listed or specify the type of submission
under “Other” if otherwise not listed.
- Original: An application for which FDA has never issued an approval letter;
- Labeling Supplement: A supplemental application for labeling changes to
an approved product as described under 21 CFR 314.70 and 21 CFR 601.12

data from both adult and pediatric studies, select ‘No’.
Field 25: This section should contain a brief explanation of the contents of, or
rationale for, the submission (e.g., “manufacturing change from roller bottle to
cell factory” or “response to Information Request Letter of mm/dd/yy” or
“pediatric exclusivity determination request” or “to fulfill a Subpart H postmarketing
requirement”).
Field 27: Indicate whether the submission contains only Paper, both Paper and
Electronic, or only Electronic Media (e.g., electronic media or electronic
submissions sent via the Electronic Submissions Gateway (ESG)).
Field 28: Enter the number of volumes, including electronic media, contained in
the archival copy of this submission.

Field 31: This section contains items 1 through 20 which is a checklist that should
be used to indicate the types of information contained within a particular
