CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:


That AGREEMENT, made and entered into by and between:
I, MAGDALENA P. FARON, of legal age, single, Filipino Citizen, and resident of Block 9 Lot
20 Hyacinth Street Don Juan Bayview Sucat, Muntinlupa, hereinafter referred to as the SELLER,
-AND-
I, FRANCIS AMPARO F. BORJA, of legal age, single, Filipino Citizen, and resident of #14 J.
Ocampo Street Poblacion Bacoor City, Cavite, hereinafter referred to as the BUYER.
W I T N E S S E T H:
WHEREAS, the SELLER is the registered owner of a property covered by Transfer
Certificate of Title No. T-1124729, situated at Barangay Mambog Bacoor City Cavite with
improvements and containing an area of One Hundred Fifty (150) Square Meters, identified as
Lot 21 Block 17, and more particularly described as follows:
Transfer Certificate of Title No. T-1124729
A parcel of land (Lot 21 Block 17 of the cons-subd. Plan Psd -04-014470 being a portion
of the cons of lot 4680-A, (LRC) Psd-154182 and lots 4671 and 4674. Imus Estate, LRC Rec. No. ),
situated in the Barangay Mambog Mun. of Bacoor, province of Cavite. Bounded on the NE.,
along line 1-2 by lot 12 x-x-x-x-x
WHEREAS, the SELLER had offered to sell the property covered by Transfer Certificate of
Title No. T-1124729, situated at Barangay Mambog Bacoor City Cavite with improvements and
containing an area of One Hundred Fifty (150) Square Meters, identified as Lot 21 Block 17, to
the BUYER and the BUYER acceded to buy in the amount of SIX MILLION PESOS ONLY
(6,000,000.00).
That for and in consideration of the sum of SIX MILLION PESOS ONLY (6,000,000.00).,
Philippine Currency, the SELLERS hereby conditionally SELLS, TRANFERS AND CONVEYS unto the
BUYER, her heirs, successors and assigns the above-described parcel of land with improvements
(residential house) thereon, under the following terms and conditions:
1. That the amount of FIVE HUNDRED THOUSAND PESOS (PHP 500,000.00) shall be
paid by the BUYER on 8th day of September, 2023 as earnest money. Hence, the
SELLER could no longer offer the said property to other buyers.
2. That the remaining balance of FIVE MILLION FIVE HUNDRED THOUSAND PESOS
(PHP 5,500,000.00) shall be applied by the BUYERS thru PAG IBIG HOUSING LOAN.
3. That the BUYER shall be given a minimum of three (3) months and a maximum of six
(6) months to apply the said loan. The BUYER hereby undertakes that they will
provide all documents which shall be needed by the Pag Ibig Housing Loan for the
approval of the loan, Likewise the SELLER shall provide all the documents which shall
be needed for the approval of the loan.
4. In case, the loan that will be approved by the Pag Ibig Housing Loan is lesser the
remaining balance the BUYER undertakes to cover the discrepancy of said loan in
CASH.
5. That the Capital Gains Tax, Documentary Stamps Tax, Registration Fee, Transfer Tax,
document expenses and other expenses in the transfer shall be for the account of
the BUYER.
6. That in case the buyer had withdrawn and/or back out, that the amount of FIFTY
THOUSAND (PHP 50,000.00) for every month of the delay shall commence starting
on September 8, 2023.
7. Incase the SELLER decides to cancel the transaction, or to withdraw from the
contract, the seller shall return whatever amount has been advanced by the buyer
amounting FIVE HUNDRED THOUSAND (PHP 500,000.00) in total with legal interest
rate of 6% per annum from the time the seller received the payment until actual
payment thereof.
8. Original Title to the above-described property subject of this contract remains with
the SELLER and shall pass to and be transferred to the BUYER upon the release of
letter of guarantee (LOG) to the SELLER. 
THAT SELLER shall DEFEND the ownership and title of the BUYER’s claimant, entity or agency
and that the property is free from all liens and encumbrances,
IN WITNESS WHEREOF both parties hereunto set their hands this day of September, 2023 at
Bacoor City, Cavite, Philippines.

That for and in consideration of the sum of FIVE MILLION PESOS ONLY (5,000,000.00).,

(6) months to apply the said loan. The BUYER hereby undertakes that they will
provide all documents which shall be needed by the Pag Ibig Housing Loan for the
