COUNTER AFFIDAVIT

I, kiri Marko an Adult,Christian and resident of Dar es Salaam do hereby take an oath and
state as follows:-

1. That I am the Principle Officer of the Respondent hence conversant with the facts
I am going to depone hereunder.

2. That I have read the Certificate of Urgency, Chamber Summons and Affidavit of
one Georgina Mapesa filed in support of this application and understood its
contents.

3. That the contents of paragraphs 1, of the Affidavit are admitted saved for the
purpose of this suit.

4. The First Respondent denies the contents of paragraph 2 of the affidavit. In reply
the Respondent reiterates and maintains that the applicant was not shocked with
the said announcement made by Vunja bei Auctioneers as she was very aware of
the loan agreement between the First and 2nd Respondent.

5. With regard to the contents of paragraphs 4 the Applicant maliciously denied to

have participated in borrowing the loan from the First Respondent but she is
forgetting that she consented herself by signing the Legal and binding Document
concerning to Loan Agreement with the First Respondent and she even submitted
her passport size to the First Respondent, thus this therefore shows she accepted
the terms and conditions concerning to Loan Agreement. Thus the Applicant’s
rights were properly observed in passing the Loan, therefore Respondents does
not breach any law as alleged or at all.
 VERIFICATION CLAUSE
All what I have stated under paragraph 1, 2, 3, 4, and 5 is true to the best of my
knowledge.
