PROIDBITING
PROHIBITING FARMER-MEMBERS TO USE AND INSTALL TURN-OUTS OTHER
THAN THOSE THAT ARE SPECIFIED AND AUTHORIZED BY THE NATIONAL
IRRIGATION ADMINISTRATION (NIA) IN ANY IRRIGATION CANALS
PENALTIES
WITHIN THE CITY OF SANTIAGO AND PROVIDING PENAL TIES
FOR VIOLATION THEREOF

WHEREAS, Irrigators Associations (IA) are formedfonned to help and coordinate with the
National Irrigation Administration (NIA) in the operation and maintenance of irrigation systems
t serve the members of the association particularly in the regulation and distribution of
uitable water supply throughout the cropping season by way of disciplinary adherence of
odwill and trust among members;

WHEREAS, the existence of unauthorized turn-outs may cause damage to the irrigation
piles to the prejudice of other farmer-members who are religiously adhering to the system of the
association;

WHEREAS, the LIGA LIGAYAYA IA Inc. of Barangay Salvador, Santiago City, in its desire to
have equitable distribution of water, needs to have well maintained irrigation systems through
proper legislation for the benefit ofthe
benefit of the farmers in this city;

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod in its regular


session duly assembled that:

I. Title -— The title of this ordinance shall be "AN

IRRIGATION ADMINISTRATION (NIA) IN ANY IRRIGATION CANALS WITHIN THE
CITY OF SANTIAGO AND PROVIDING PENALTIES FOR VIOLATION THEREOF."
THEREOF.”

SECTION 2. Purpose -— Irrigation canals are essential towards efficient and effective
farming, thus, these should be well maintained, protected and taken cared of at all times and to

inculcate among farmers the proper use of irrigation facilities leading to a better and smooth
conveyance of irrigation water to rice lands.

SECTION 3. Prohibited acts- Any person or farmer-members are hereby prohibited to


use and install tum-outs other than those specified by the National Irrigation Administration in
any irrigation canals in the City of Santiago.

SECTION 4. Penalty- Any personls found violating the provisions of this ordinance shall
be penalized as follows:

a) First Offense -fine ofP 1,500.00


b) Second Offense -fme ofP 2,500.00
c) Third and succeeding offenses - fine of P3,500.00 and forfeiture of subsidy
or assistance from any agricultural program of the city government.

SECTION 5. Barangay officials and farmer-members of irrigators association in the City


of Santiago are hereby requested to disseminate within their respective areas the provisions of
this ordinance.

SECTION 6. This ordinance shall take effect fifteen (15) days after its approval and
publication in a news paper of general circulation.
