SANGGUNIANG BARANGAY OF LOS ARCOS, PROSPERIDAD, AGUSAN DEL
SUR HELD IN ITS SESSION HALL ON JANUARY 16, 2023 AT 9:00 O’CLOCK IN

Barangay Ordinance No.01

Series of 2023

“An Ordinance amending the provision of Ordinance No. 01 series of 2021 Section
1&2, An Ordinance requiring all vehicle passenger, delivery truck, peddlers, hauler of
Agricultural products, fish vendor, large cattle and small animals’ vendor, entering in
the vertical line or operating inside the jurisdiction of the Barangay must pay a toll fee
to the barangay toll fee collector as “ARCABALA”.

WHEREAS, Republic Act No. 7160 of Local Government Code of 1991 Section 134,
142, 151 and 152 allow barangays to impose and collect taxes, fees and charges on
business and occupation and on the practice of any profession and calling.

WHEREAS, Section 153 stipulates that LGUs may collect reasonable fees and
charges for services rendered.

WHEREAS, Section 132 stipulates that the power to impose a tax, fee or charge to
generate revenue under the LGC shall be exercised by the LGU concerned through
on appropriate ordinance.

WHEREAS, the collection of barangay revenue can provide additional income to the
barangay for construction and maintenance of barangay facilities and other public
works with in the barangay.
TO be ordained by the Barangay Council of Los Arcos, Prosperidad, Agusan del Sur
in its regular session, that;

Section 1. Title of Ordinance “An Ordinance amending the provision of

Ordinance No.01 series of 2021 section 1&2, An Ordinance requiring all vehicle
passenger, delivery truck, peddlers, hauler of Agricultural products, fish vendor,
large cattle and small animals’ vendor, entering in the vertical line or operating
inside the jurisdiction of the Barangay must pay a toll fee to the barangay toll fee
collector as “ARCABALA”.

Section 2. Barangay Toll Fee for:

Ten wheelers :200.00 per load with the issuance of O.R

Elf/Bonggo/Forward :100.00 per load with the issuance of O.R
Multicab :20.00 daily
Single motor/side car/bao-bao :10.00 daily
Peddlers :50.00 daily

Section 3. Failure to pay the barangay toll fee shall be ground for investigation for
the barangay council not with standing of appropriate charges maybe filed against
any violators.

Section 4. REPEALING CLAUSE- All ordinance No. 01 series of 2023 shall take
effect immediately upon the approval of Sangguniang Bayan of Prosperidad, Agusan
del Sur.

ADOPTED, this 16th day of January, 2023, upon the motion of Hon. Melchor D. De
Castro and duly seconded by Hon. Roquita Q. Almirol.
