PETITION

Petitioner by counsel unto this Honorable Court , respectfully

states , That :

1. The petitioner is of legal age, married, Filipino citizen and residing at

Brgy. San Isidro, Baybay City, Leyte where he may be served with
summons, notices and other court processes of this Honorable Court;

2. The petitioner is one of the successors -in – interest of Julia Villocino -

the registered owner of a parcel of land located at Brgy. San Isidro
Baybay City, Leyte, original Affidavit of Heirship is hereby attached
and marked as Annex “A’ its contents are incorporated herein and
form part of this Petition by way of reference;

3. The Grand Mother of the Petitioner ( ESPERANZA VILLOCINO

ALKUINO) is the only child of the registered owner – JULIA
VILLOCINO, the Judicial Affidavit of Redentor G. Laguardia
attesting the line of heirship is hereby attached marked as Annex “B”;

4. The subject lot of this Petition is covered by Tax Declaration 05- 07-
0085-00720 a copy of the Tax Declaration is hereby attached and
marked as Annex “C’ its contents are incorporated herein and form
part of this Petition by way of reference;
5. The real property covered and embraced by OCT 8360 located in
Bry. San Isidro, Baybay City, Leyte is particularly described as
follows :

“ A parcel of irrigated agricultural land designated as Lot

8622. Bounded on the North by ASS. Lot 042, East by ASS. Lot
044, South by ASS Lot 070, West by Lot ASS.046 with an area
of Two Thousand Ninety Six Square Meters (2,096 sq.m. )
more or less in the name of Julia Villocino”

6. The owner’s duplicate copy of OCT No. 8360 is in the possession of

the petitioner , certified copy of the owner’s original copy of OCT
8340 is duly authenticated by the Clerk of Court of the Regional Trial
Court , Branch 14, Baybay City. Leyte - Atty. Sheila Riῇos, is hereby
attached and marked as Annex “D’ its contents are incorporated
herein and form part of this Petition by way of reference;

7. The said real property was sold to Mrs. BERBINA AMBONG, a copy
of the DEED OF SALE is hereby attached and marked as Annex “E’
its contents are incorporated herein and form part of this Petition by
way of reference;

8. The necessary Payments were made in the BIR like Documentary

Stamp Tax, Capital Gain Tax, Estate Tax were already made thus E-
CAR was being issued, a copy of the E -CAR is hereby attached and
marked as Annex “F” its contents are incorporated herein and form
part of this PETITION by way of reference;

9. After the issuance of the E- CAR , the subsequent transfer from the
sellers to the buyer was then made in the Office of the Registry of
Deeds in Tacloban City, Philippines, a copy of the receipt is hereby
attached marked as Annex “G” , its contents are incorporated herein
and form part of this Petition by way of reference;

10. Unfortunately the transfer from the seller to the buyer can not
proceed because the Register of Deed does not have the copy of its
Original Certificate of Title ;

11.The records in the office of the Register of Deeds for Leyte Province
were destroyed by fire that gutted the Office on December 29,1994 as
certified by the Land Registration Authority , a copy of the
CERTIFICATION is hereby attached and marked as Annex ”H” its
contents are incorporated herein and form part of this Petition by
way of reference;

WHEREFORE, it is respectfully prayed that the Register of Deeds

for Leyte Province shall issue a reconstituted original certificate of
title based on the owner’s duplicate certificate of title hereto attached
in the name in the name of the registered owner – JULIA
VILLOCINO .

Other just and equitable reliefs are likewise prayed for..
