SETTLEMENT OF ESTATE AMONG HEIRS

WITH DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This EXTRAJUDICIAL DECLARATION AND SETTLEMENT OF ES-

TATE AMONG HEIRS is made and entered into by and among the legal and
compulsory heirs of the late FELIPE BENLOT SR. namely:

CONCEPCION T. BENLOT, of legal age, widow, Filipino, residing at Alta

Tierra, Tiguma, Pagadian City, Zamboanga del Sur, Philippines;

VIRGINIA B. TOLEDO, of legal age, married, Filipino, residing at Sitio An-

ing, Poblacion Ward 4, Minglanilla, Cebu, Philippines;

FRISCA B. BUNSOCAN, of legal age, married, Filipino, residing at Alta

Tierra, Tiguma, Pagadian City, Zamboanga del Sur, Philippines;

FELIPE T. BENLOT, JR., deceased, represented by:

DENNIS L. BENLOT, of legal age, married, Filipino, residing at 62

Cluster N, Cogeo, Antipolo City, Philippines;

DAISY B. BURREROS, of legal age, married, Filipino, residing at

Anonang, Aurora, Zamboanga del Sur, Philippines;

DELMAR L. BENLOT, of legal age, married, Filipino, residing at Ta-

guitic, Kapatagan, Lanao del Norte, Philippines;

HAZEL L. BENLOT, of legal age, single, Filipino, residing at

Anonang, Aurora, Zamboanga del Sur, Philippines;

SYRA MARIE T. BENLOT, of legal age, single, Filipino, residing at

223 Sampaguita Street, Brgy, Payatas, Quezon City, Philippines;

ZENNY T. BENLOT, of legal age, single, Filipino, residing at 223

Sampaguita Street, Brgy, Payatas, Quezon City, Philippines; and

LORIANE T. BENLOT, of legal age, single, Filipino, residing at 223

Sampaguita Street, Brgy, Payatas, Quezon City, Philippines;

WITNESSETH:

WHEREAS, the above-named parties voluntarily declare that they are

sole heirs of the late FELIPE BENLOT SR. (deceased), who died on January
4,1991 at Pagadian City, Zamboanga del Sur (a copy of his death certificate is
hereto attached as Annex “A”);

 WHEREAS, FELIPE BENLOT SR., who at the time of his death, left no
will and no known any debts or accounts whatsoever which have not been set-
tled up to this time;

That the late FELIPE BENLOT SR., at the time of his death, left two
parcels of land situated in Barrio of Bulawan, City of Pagadian, Island of Min-
danao, and more particularly described as follows, to wit:

1. TRANSFER CERTIFICATE OF TITLE NO. T-16,305

Lot 4509-A, Psd-09-012061

“A parcel of land (Lot No. 4509-A) of the subdivision plan, Psd-09-

012061 being a portion of Lot 4509, Pls-119, Pagadian Public Land
Subdivision LRC Cad. Rec. No., situated in the Barrio of Bulawan, City
of Pagadian, Island of Mindanao. Bounded on the NE., line 6-14 by Lot
4509-B of the subdivision plan, on the line 1-2 by Lot 6580, on the SW.,
line 2-3 by Lot 4513, line 3-4 by Lot 4515, lune by Lot 4516, on the
NW., line 5-6 by Lot 4510, all of Pls-119, Pagadian Pubic Land Subdivi-
sion. Thence

S. 10-43’E., 83.16 m. to point 2; N. 66-45’W., 202-30 m. to point 3;

N. 67-49’W., 103.98 m. to point 4; N. 58-00’W., 107.05 m. to point 5;
N. 40-01’E., 11.05 m. to point 6; S. 73-41’E., 365.08 m. to point of be-
ginning, containing an area of EIGHTEEN THOUSAND ONE HUN-
DRED TWENTY-FIVE (18,125) SQUARE METERS.

2. A portion of OCT No. P-13.148 specifically lot 4516-A containing an

area of TWENTY-FOUR THOUSAND NINE HUNDRED THIRTY-TWO
(24,932) SQUARE METERS more or less by virtue of the Deed of Ab-
solute Sale executed by and between Spouses Gabino Amacanin and
Aurelia Bustamante and Felipe Benlot Sr. dated 29 June 1972 exe-
cuted before Clerk of Court JOSE V. CARRIAGA per Doc no. 127,
Page no. 23, Book no. III, Series of 1972.

WHEREAS, the above-named parties are the immediate and compulsory

heirs of FELIPE BENLOT SR. entitled to succeed to his estate, they being the
wife, his children, and grandchildren, respectively;

WHEREAS, no personal properties are involved in this extrajudicial settle-

ment;

WHEREAS, it is to the best interest of the parties hereto to divide and ad-
judicate among themselves the entire estate particularly the real properties
above described extrajudicially in the manner and form hereinafter set forth in
the following manner:

WHEREAS, the parties agree to publish this instrument in a newspaper of

general circulation in the City of Pagadian, Province of Zamboanga del Sur,
once a week for three consecutive weeks;

THEREFORE, for and in consideration of the foregoing premises, and in-

voking the provision of Section 1, Rule 74 of the Rules of Court, the parties
hereto have agreed as they hereby do so agree, to divide and adjudicate the
above estate among themselves in pro indiviso equal shares, subject, how-
ever, to contingent liabilities to creditors, heirs or other persons who might have
been deprived of lawful participation in the estate of the decedent, for a period
of two (2) years from and after the settlement and distribution thereof, in accor-
dance with the provision of Section 4, Rule 74 of the Rules of Court;

FURTHER, and for and in consideration of the sum of NINE HUNDRED

THOUSAND PESOS (PhP 900, 000.00), Philippine Currency, receipt of which
is hereby acknowledged by us to our full and complete satisfaction, we, CON-
CEPCION T. BENLOT and VIRGINIA B. TOLEDO, the “SELLERS”, as the

absolute owners of the above-mentioned parcels of land by virtue of the Extraju-
dicial Settlement herein mentioned, has agreed to SELL, CONVEY, and
TRANSFER by way of ABSOLUTE SALE to our co-heir/buyer, FRISCA B.
BUNSOCAN, her heirs, assigns and successors-in-interests, all our rights, inter-
ests and participation over our share with a total of THIRTY-TWO THOUSAND
TWO HUNDRED NINETY TWO POINT SEVETY-FIVE (32, 292. 75) SQUARE
METERS with all improvements existing thereon.

IN WITNESS WHEREOF, the parties hereto have hereunto set their
