‫نظام الهيئة السعودية للمهندسين‬

‫�إن نظ��ام الهيئ��ة ال�س��عودية للمهند�س�نين ال�صادر باملر�س��وم امللكي رق��م م‪ 36/‬يف ‪1423 / 9 / 26‬هـ املبني على‬
‫قرار جمل�س الوزراء املوقر رقم ‪ 226‬يف ‪1423 / 9 /13‬هـ ‪ ،‬ين�ص على ما يلي ‪:‬‬
‫املادة األأوىل‬
‫الهيئة ال�سعودية للمهند�سني هيئة مهنية علمية ذات �شخ�صية اعتبارية وذمة مالية م�ستقلة تعمل حتت �إ�شراف‬
‫وزارة ال�ش���ؤون البلدية والقروية واإلإ�س��كان‪ ،‬مقرها مدينة الريا�ض‪ ،‬ويجوز لها �أن تن�ش��ئ فروع ًا داخل اململكة‪،‬‬
‫ويعرب عنها بالهيئة يف مواد هذا النظام‪.‬‬
‫املادة الثانية‬
‫ته��دف الهيئ��ة �إىل النهو�ض مبهنة الهند�س��ة وكل ما من �ش���أنه تطوير ورفع م�س��توى هذه املهن��ة والعاملني فيها‪،‬‬
‫ولها على األأخ�ص ما ي�أتي‪:‬‬
‫‪ )1‬و�ضع �أ�س�س ومعايري مزاولة املهنة وتطويرها مبا يف ذلك �شروط الرتخي�ص‪.‬‬
‫‪ )2‬و�ضع القواعد واالمتحانات الالزمة للح�صول على الدرجات املهنية‪.‬‬
‫‪� )3‬إعداد الدرا�سات والبحوث واإلإح�صاءات املتعلقة ب�شعب وفروع الهند�سة‪ ،‬ون�شرها‪ ،‬و�إ�صدار جمالت مهنية وعلمية‪.‬‬
‫‪ )4‬تنظيم الدورات و�إقامة امل�ؤمترات والندوات واملعار�ض ذات العالقة باملهنة‪ ،‬وامل�شاركة فيها‪.‬‬
‫‪� )5‬إبداء املقرتحات التي تراها منا�سبة للقرارات والتعليمات املتعلقة باملهنة‪.‬‬
‫‪ )6‬تقدمي امل�شورة الفنية يف جمال اخت�صا�صها وفق ًا لل�ضوابط التي يقرها جمل�س �إدارة الهيئة‪.‬‬
‫املادة الثالثة‬
‫تتكون ع�ضوية الهيئة من‪:‬‬
‫‪ )1‬ع�ضوية �أ�سا�سية‪:‬‬
‫وت�ش��مل جميع ال�س��عوديني احلا�صلني على �شهادة جامعية يف التخ�ص�صات الهند�سية �أو ما يعادلها‪ ،‬العاملني يف‬
‫هذه املهن‪.‬‬
‫‪ )2‬ع�ضوية انت�ساب وت�شمل‪:‬‬
‫‌�أ‪ .‬جميع املهند�س�نين غري ال�س��عوديني احلا�صلني على �ش��هادة جامعية �أو ما يعادلها يف �إحدى �ش��عب الهند�س��ة‪،‬‬
‫العاملني يف مهنة الهند�سة داخل اململكة‪.‬‬
‫‌ب‪ .‬من يتقدم بطلب الع�ضوية من الفنيني والطالب واملهتمني بعلوم الهند�سة‪.‬‬
‫‌ج‪ .‬املكاتب وال�شركات املهنية الهند�سية املرخ�ص لها مبزاولة مهنة الهند�سة يف اململكة‪.‬‬

 ‫‪ )3‬ع�ضوية فخرية‪:‬‬
‫ومينحه��ا جمل���س �إدارة الهيئ��ة مل��ن يق��دم �إ�س��هامات متميزة تخ��دم الهيئة‪ ،‬ويعف��ى الع�ضو الفخري من ر�س��وم‬
‫اال�شرتاك‪.‬‬
‫املادة الرابعة‬
‫يكون للهيئة جمعية عمومية تتكون من األأع�ضاء األأ�سا�سيني الذين �سددوا ا�شرتاكاتهم ال�سنوية‪ ،‬وتعقد اجلمعية‬
‫العمومية اجتماعاتها العادية مرة كل �سنة‪ ،‬وتعقد اجتماعاتها اال�ستثنائية وفق ما حتدده الالئحة التنفيذية‪.‬‬
‫وتوج��ه الدع��وة الجتماعات اجلمعية العمومية قبل ع�ش��رين يوم ًا على األأقل من تاريخ انعقادها‪ ،‬وحتدد الدعوة‬
‫م��كان االجتم��اع وزمان��ه‪ ،‬ويك��ون االجتم��اع �صحيح�� ًا مهم��ا كان ع��دد احلا�ضري��ن‪ ،‬وت�ص��در ق��رارات اجلمعية‬
‫العمومية ب�أغلبية �أ�صوات احلا�ضرين‪ ،‬ويف حالة الت�ساوي يرجح اجلانب الذي �صوت معه الرئي�س‪.‬‬
‫املادة اخلام�سة‬
‫تخت�ص اجلمعية العمومية مبا ي�أتي‪:‬‬
‫‪� )1‬إ�صدار التنظيم الداخلي للهيئة‪.‬‬
‫‪� )2‬إقرار اللوائح التنفيذية لنظام الهيئة‪.‬‬
‫‪� )3‬إقرار ا�شرتاكات األأع�ضاء‪.‬‬
‫‪ )4‬املوافقة على احل�س��ابات اخلتامية للهيئة‪ ،‬وتعيني مراقب حل�س��اباتها وحتديد مكاف�آته‪ ،‬وا�س��تثناء من ذلك‬
‫يعيني جمل�س اإلإدارة مراقب احل�سابات للمدة األأوىل ويحدد مكاف�آته‪.‬‬
‫‪� )5‬إقرار خطة العمل التي يقدمها جمل�س �إدارة الهيئة‪ ،‬واعتماد التقرير ال�سنوي عن ن�شاطها‪.‬‬
‫‪ )6‬انتخاب ممثلي اجلمعية العمومية يف جمل�س اإلإدارة‪.‬‬
‫املادة ال�ساد�سة‬
‫يتكون جمل���س �إدارة الهيئة من ع�ش��رة من األأع�ضاء األأ�سا�س��يني‪ ،‬تنتخبهم اجلمعية العمومية‪ ،‬وحتدد الالئحة‬
‫التنفيذية اإلإجراءات الالزمة لذلك وما ي�ش�رترط يف املر�ش��حني‪ ،‬ويتوىل جمل���س اإلإدارة املنتخب اختيار رئي���س‬
‫املجل�س ونائبه من بني �أع�ضائه باالقرتاع ال�سري‪.‬‬
‫‪ )1‬تكون مدة الع�ضوية ثالث �سنوات قابلة للتجديد مرة واحدة‪.‬‬
‫‪ )2‬يعقد جمل�س اإلإدارة جل�سة على األأقل كل ثالثة �أ�شهر‪ ،‬كما يعقد عندما يطلب ذلك رئي�س املجل�س‪� ،‬أو �أربعة‬
‫من �أع�ضائه‪.‬‬
‫‪ )3‬تعقد االجتماعات بح�ضور �أغلبية األأع�ضاء‪ ،‬على �أن يكون من بينهم الرئي�س‪� ،‬أو نائبه‪.‬‬

‫‪ )4‬ت�صدر قرارات املجل���س ب�أغلبية �أ�صوات احلا�ضرين‪ ،‬ف�إذا ت�س��اوت األأ�صوات يرجح اجلانب الذي �صوت معه‬
‫الرئي�س‪.‬‬
‫‪ )5‬يح�ضر األأمني العام االجتماع دون �أن يكون له حق الت�صويت‪.‬‬
‫املادة ال�سابعة‬
‫يقوم جمل�س اإلإدارة مبمار�سة ال�صالحيات الالزمة لت�صريف �ش�ؤونها وحتقيق �أهداف الهيئة املن�صو�ص عليها‬
‫يف املادة (الثانية) من النظام‪ ،‬وله على األأخ�ص ما ي�أتي‪:‬‬
‫‪ )1‬دعوة اجلمعية العمومية لالنعقاد‪.‬‬
‫‪ )2‬اقرتاح التنظيم الداخلي للهيئة‪.‬‬
‫‪ )3‬اقرتاح اللوائح التنفيذية لنظام الهيئة‪.‬‬
‫‪ )4‬اقرتاح قيمة ا�شرتاكات األأع�ضاء‪.‬‬
‫‪� )5‬إعداد احل�سابات اخلتامية للهيئة‪.‬‬
‫‪� )6‬إعداد التقرير ال�سنوي عن ن�شاط الهيئة‪ ،‬واقرتاح خطة عمل لها‪.‬‬
‫‪� )7‬إقرار امليزانية ال�سنوية للهيئة‪.‬‬
‫‪ )8‬ت�شكيل اللجان الفنية والعلمية وال�شعب الهند�سية‪ ،‬وو�ضع قواعد ممار�سة مهماتها‪.‬‬
‫‪ )9‬تعيني األأمني العام للهيئة ونائبه‪ ،‬وحتديد واجباتهما وم�س�ؤولياتهما وحقوقهما‪.‬‬
‫‪ )10‬قبول الهبات والتربعات‪.‬‬
‫‪� )11‬إقرار �سيا�سة ا�ستثمار �أموال الهيئة‪.‬‬
‫املادة الثامنة‬
‫تتكون موارد الهيئة املالية من‪:‬‬
‫‪ )1‬ا�شرتاكات األأع�ضاء‪.‬‬
‫‪ )2‬الهبات والتربعات‪.‬‬
‫‪� )3‬إيراد ما تقدمه الهيئة من خدمات‪.‬‬
‫‪ )4‬عائد ا�ستثمار �أموال الهيئة‪.‬‬
‫املادة التا�سعة‬
‫ً‬
‫ين�ش��ر هذا النظام يف اجلريدة الر�س��مية‪ ،‬ويعمل به بعد �س��تني يوما من تاريخ ن�ش��ره‪ ،‬ويلغي كل ما يتعار�ض معه‬
‫من �أحكام‪.‬‬

4. Meetings will be held with the attendance of a majority of members, including
the chairman or his deputy.
5. Resolutions will be issued by the majority of votes of those present. In case the
votes are equal, the chairman's casting vote will decide the issue.
6. Secretary General of the Council shall attend the meetings, but with no right to vote.
Article VII:
The Board of Directors shall exercise its powers for conducting its affairs
and realizing the Council’s objectives contained in Article two of the
statutes, specifically the following:
1. Convening the General Assembly;
2. Proposing Council’s internal organization;
3. Proposing bylaws of the Council’s statutes;
4. Proposing member subscription fees;
5. Preparing Council’s final statement of accounts;
6. Preparing annual reports of the Council’s activities and proposing an action
plan for it;
7. Passing Council’s annual budget;
8. Formation of technical and scientific committees, and engineering divisions,
and setting out principles for practicing their mission;
9. Appointing Council’s Secretary General and his deputy, determining their
duties, responsibilities and rights;
10. Accepting grants and donations;
11. Approving Council’s funds investment policy.
Article VIII:
The financial resources of the Council consist of:
1. Member subscriptions;
2. Grants and donations;
3. Revenues from the services provided by the Council;
4. Proceeds from the Council’s invested funds.
Article IX:
These statutes shall be published in the official gazette and come into force sixty
days from the date of publication. Thereafter, any provisions in contradiction with
these statutes shall be abolished.

c. Professional engineering offices and companies authorized to practice
engineering profession in the Kingdom of Saudi Arabia.
3. Honorary membership: It is awarded by the Council’s Board of Directors to
those who make distinguished contributions to serve the Council. Honorary
members are exempted from the subscription fee.
Article IV:
The Council shall have its general assembly comprising primary members who
have settled their annual subscription fees. The general assembly shall hold its
ordinary meetings once a year, whereas extraordinary meetings will be held as
specified in the bylaws.
The notice for convening a general assembly meeting shall be issued 20 days
before the actual date of the meeting, giving the place and date of such meeting.
The meeting will be legal irrespective of number of attendees. The decisions
in the general assembly will be taken by majority of votes. In case of a tie, the
presiding officer’s casting vote will decide the issue.
Article V:
The responsibilities of the general assembly will be as follows:
1. Setting up of the Council’s internal organization;
2. Approval of the bylaws of the Council’s statutes;
3. Approval of members’ subscription;
4. Approval of the Council’s final statement of accounts, appointment of an
auditor and determining his remuneration (there will be an exception for the
first term when the Board of Directors will appoint the auditor and determine his
remuneration.);
5. Adoption of the work plan presented by the Council’s Board of Directors and
approval of the annual report of its activities;
6. Election of the general assembly representatives to the Board of Directors.
Article VI:
1. The Board of Directors consists of ten basic members who are elected by
the General Assembly as per the terms and regulations stated in the executive
bylaw. The elected board members will then choose the chairman and his deputy
from them by secret ballot.
2. The term of Board membership shall be three years, renewable only for one
more term.
3. The Board shall meet at least once every three months, or upon a request by
Chairman of the Board or upon a request by at least four members.

 Statute of Saudi Council of Engineers
(Issued under Royal Decree No. M/36 dated 26 / 9 / 1423 H in accordance
with Council of Ministers’ Decree No. 226 on 13 / 9 / 1423 H.)
Article I:
Saudi Council of Engineers is a scientific professional body independently
handling its financial obligations, and operating under the supervision of the
Ministry of Municipal, Rural Affairs and Housing with headquarters in Riyadh.
Saudi Council of Engineers hereinafter referred to as “Council” may establish
branches in the Kingdom of Saudi Arabia.
Article II:
The objectives of this Council are to promote the engineering profession
and do whatever may be necessary to develop and upgrade its standards
and those practicing it.
The main responsibilities of the Council are as follows:
1. Setting criteria and standards of practicing and developing this profession,
including licensure terms and conditions;
2. Prescribing necessary rules, regulations, and examinations for obtaining
professional degrees;
3. Preparation and publication of studies, researches, and statistics related to
engineering divisions and branches, and issuance of professional and scientific
magazines;
4. Organization of courses, conferences, symposia, and exhibitions relating to
the profession and participation therein;
5. Expression of suggestions that it deems appropriate for decisions and
instructions relating to the profession; and
6. Submission of technical advice in its area of specialization in accordance with
regulations to be approved by the Council’s Board of Directors.
Article III:
The membership of the Council of Engineers consists of:
1. Primary membership: It comprises all Saudi graduates in engineering
disciplines or equivalent, practicing this profession.
2. Affiliate membership includes:
a. All non-Saudi engineers holding a university degree or equivalent in any
engineering discipline, and working in the engineering field in the Kingdom;
b. Technicians, students, and those interested in engineering science and apply
for membership;
