EXTRA-JUDICIAL SETTLEMENT OF ESTATE

WITH WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF EXTRAJUDICIAL SETTLEMENT WITH WAIVER

OF RIGHTS (“Deed”), executed by and between:

MYRA RICAMATA REGENCIA, single, of legal age, Filipino

citizen and a resident of 12 3-I Cambridge Village Eastbank
Rd. San Andres, Cainta Rizal;

-and-

RAFAEL VIZARRA REGENCIA, widow, of legal age, Filipino

citizen and a resident of 12 3-I Cambridge Village Eastbank
Rd. San Andres, Cainta Rizal

(hereinafter collectively referred to as the HEIRS).

WITNESSETH:

WHEREAS, the above-named HEIRS are the only surviving and

lawful heirs of deceased MARINA RICAMATA REGENCIA;

WHEREAS, the deceased MARINA RICAMATA REGENCIA died

intestate and without outstanding debts on June 25, 2022, at Tricity Medical
Center, C. Raymundo Ave. Maybunga, Pasig City;

WHEREAS, at the time of her death, the deceased left the following
real and personal properties:

a.) A certain real property, covered by Transfer Certificate of Title No.

T-123937, situated in Brgy. Kanlurang Mayao, Lucena City, with an
area of Two Hundred Forty (240) Square Meters.

b.) A certain real property, covered by Original Certificate of Title No.

P-23838, situated in Lusok, Sta. Cruz Marinduque, with an area of
Two Hundred Six (206) Square Meters.
 c.) A Thirty (30) Square Meters Condominium unit located in Cluster
12, Third Floor, Unit I in Cambridge Village, Cainta Rizal and a
Parking slot located at The Cambridge Village, Parking Building,
First level, Slot 103;

d.) Three (3) Motor Vehicles which are more particularly described as
follows:

(hereinafter collectively referred to as the “Subject Properties”).

WHEREAS, it is to the very best interest of the parties hereto to

adjudicate unto themselves the entire estate extra-judicially in the form
and manner hereinafter set forth;

NOW, THEREFORE, for and in consideration of the foregoing

premises and invoking the provision of Sec. 1 Rule 74 of the Rules of
Court, the said HEIRS above-named have agreed to settle the estate
extra-judicially and to this effect do hereby adjudicate the same solely
unto MYRA RICAMATA REGENCIA, subject however to the liabilities
imposed by Sec. 4, Rule 74 of the Rules of Court for a period of two years
 in favor of any other possible heirs, creditors or any other person deprived
of the lawful participation over the said estate of the deceased and
encumbrances;

In consideration of his affection for his co-heir, RAFAEL VIZARRA

REGENCIA (whose personal circumstances is mentioned above) hereby
WAIVES his share, right, interests and participation over the Subject
Properties unto his co-heir MYRA RICAMATA REGENCIA (whose
personal circumstances are mentioned above), her heirs and assigns the
full ownership and possession of the Subject Properties.
The parties agree to publish this instrument in a newspaper of
general circulation in the City and Province of __________ once a week
for three consecutive weeks;
In the remote event that any other property of the decedent should
ever be found which is not included hereinabove, the HEIRS hereto
further agree as they do so agree to settle and distribute the same in like
manner and proportion as herein established and disposed.
