AMENDMENT TO THE EXTRA-JUDICIAL SETTLEMENT

OF THE ESTATE OF THE LATE CALIXTO VILLANUEVA

AND DOLORES ANASTACIO BAYBAY

KNOW ALL MEN BY THESE PRESENTS:

WITNESSETH; That

WHEREAS, this addendum is in reference to duly notarized Extra Judicial Settlement of the
Estate of the Late Calixto Villanueva and Dolores Anastacio Baybay adjudicating two (2) of their real
property, both situated at Barangay Maitim 2nd East, Tagaytay City, Province of Cavite, Island of Luzon,
containing an area of THREE HUNDRED EIGHTY-SEVEN SQUARE METERS (387 m 2), only,
covered by Tax Declaration No. 2001-019-00488; and, the other containing an area of FIFTY-SIX
SQUARE METERS and EIGHTY DECIMETERS (56.80 m 2), only, covered by Tax Declaration No.
2001-019-00476, which registered under the name of CALIXTO VILLANUEVA and DOLORES
ANASTACIO BAYBAY, executed by ARSENIO ANASTACIO BAYBAY, GUILLERMO
ANASTACIO BAYBAY, FRANCISCO ANASTACIO BAYBAY, ALBERTO ANASTACIO
BAYBAY, RICHARD BAYBAY GALORPORT, MARY JOY GALORPORT CHAVEZ, and,
KIRBY BAYBAY GALORPORT;

WHEREAS, the said Extra Judicial Settlement under Docket No. 260; Page No. 187; Book
No. II; Series of 2023. before Atty. Elpidio M. Paligutan, a notary public for and in City of Trece
Martires, was insufficient of information as to the other heirs of the respective real property/s of the
late CALIXTO VILLANUEVA and DOLORES ANASTACIO BAYBAY; further, the civil status of
ALBERTO ANASTACIO BAYBAY was erroneously entered;

NOW, THEREFORE, for and in consideration of the foregoing premises, the undersigned
parties, for good consideration, do hereby agree to make the following changes and / or additions
that are outlined below, in order to rectify and supplant the material information sought by the
undersigned parties to reflect in the said Extra-Judicial Settlement of Estate, are as follows, to wit:

1. Considering that the herein real property is subjected under the rules and laws set by
Section 4, Rule 74 of the Revised Rules of Court, all in-interest heirs should be
included in the Extra-Judicial Settlement of Estate for the above deceased;

2. To rectify the uninvolved/excluded heirs and the civil status of Alberto Anastacio
Baybay as set forth in the above Extra-Judicial Settlement of Estate, the names of the
heirs, VICTOR BAYBAY married to CRISPINA BAYBAY, of legal ages, Filipino
citizens, and with residence and postal address at Brgy, Maitim 2 nd East, Tagaytay
City, Cavite; and, JUSTINA BAYBAY, of legal age, widow, Filipino citizen, and
with residence and postal address at Brgy, Maitim 2 nd East, Tagaytay City, Cavite.
Further, the civil status of ALBERTO ANASTACIO BAYBAY should be correctly
written and entered as “widower”.

3. That these additions shall be made valid as if they are included in the original stated
Extra-Judicial Settlement of Estate.
