MR. CHAIRMAN:

The Committees on Agriculture and Cooperatives; and on Rules and Privileges to which
was referred a Proposed Ordinance No. 032-2023 (27 th SP), authored by Board
Member BENITO U. BAGUIO, 3rd Legislative District, co-authored by Board Member
JOSEPH D. PALMADA, 3rd Legislative District, this Province, entitled:

“ AN ORDINANCE PROVIDING FOR THE SUSTAINABLE DEVELOPMENT,

MANAGEMENT, UTILIZATION AND CONSERVATION OF FISHERIES
RESOURCES IN THE PROVINCE OF BUKIDNON, PENALIZING ACTS IN
VIOLATION THEREOF, PROVIDING FUNDS THEREFOR, AND FOR OTHER
PURPOSES – “

have considered the same and hereby submit their findings, comments, and
recommendations.

COMMENTS / FINDINGS:

Republic Act No. 8550 also known as The Philippine Fisheries Code of
1998 as amended by Republic Act No. 10654, entitled "An Act to Prevent,
Deter and Eliminate Illegal, Unreported and Unregulated Fishing aims to improve
the fishing activities while avoiding potential environmental damages and
preserving the natural fishing resources.

The passage of Proposed Ordinance No. 032-2023 (27th SP) seeks to

protect and advance the right of the people to a balanced and healthful ecology

 in accord with the rhythm and harmony of nature, and to achieve food security
as the overriding consideration in the utilization, management, development,
conservation and protection of fishery resources in order to provide the food
needs of the population.

Nevertheless, Fisheries Adminisrative Order No. 196, series of 2000,

provides the guidelines on the organization, creation and implementation of
Fisheries and Aquatic Resources Management Councils (FARMCs) where
it provides that before organizing the FARMCs, the Local Government Units
(LGUs), Non-government Units (NGOs), fisherfolk and other concerned Peoples
Organization (POs) shall undergo consultation and orientation on the formation
of FARMCs.

Furthermore, Section 9 of Fisheries Adminisrative Order No. 196

provides the functions of the FARMCs to recommend the enactment of
municipal fishery ordinances to the Sangguniang Bayan/Panglungsod
through its Committee on Fisheries, if such has been organized.

Thus, the passage of Proposed Ordinance No. 032-2023 (27 th SP)

shall be hold in abeyance up to the point in time that the Bureau of Fisheries
and Aquatic Resources of Bukidnon institutionalize the fisheries and aquatic
resources management council.

RECOMMENDATIONS:

Considering the foregoing, the Committees, after careful review, hereby

recommends to hold in abeyance of Proposed Ordinance No. 032-2023 (27th
SP), of the Sangguniang Panlalawigan of Bukidnon
