AN ORDINANCE APPROVING SUPPLEMENTAL BUDGET NO. 1

AMOUNTING FIFTY SEVEN THOUSAND SIX HUNDRED PESOS
(PhP 57,600.00) OF THE SPECIAL ACCOUNT FUND FOR FISCAL
YEAR 2011 OF THE CITY OF CABADBARAN, AGUSAN DEL
NORTE

WHEREAS, the Court of Appeals, Mindanao Station, Twenty Second

Division affirmed with modification the decision rendered by the Regional Trial
Court of Agusan del Norte and Butuan City, Branch 5 on the case titled Municipality
of Cabadbaran vs. Andres Atega;

WHEREAS, the Court of Appeals rendered a decision ordering plaintiff

Municipality of Cabadbaran to pay defendant Andres E. Atega the value of his
share from the 1,019.585 square-meter lot acquired for the public market
amounting Sixty-One Thousand One Hundred Seventy-Five Pesos and Ten
Centavos (P 61,175.10) less the amount deposited in the Office of the Clerk of
Court under Official Receipt No. 5125237;

WHEREAS, the City Accountant’s Office had coordinated with the Office
of the Clerk of Court of Branch 5 wherein it was found out that the LGU of
Cabadbaran should pay the net amount of Fifty-Seven Thousand One Hundred
Seventy-Five Pesos and Ten Centavos ( P57,175.10) to Dr. Andres Atega;

WHEREAS, the Honorable City Mayor submitted to this August Body for
approval the Supplemental Budget No. 1, Special Account Fund (LEAD-BC),
CY 2011 for this purpose.

BE IT ORDAINED, by the 2nd Sangguniang Panlungsod, in its 43rd

Regular Session assembled, that:

SECTION 1. The amount of Fifty Seven Thousand Six Hundred Pesos

(PHP 57,600.00) is hereby set aside in the Special Account Fund for Calendar
Year 2011.
