Barangay Ordinance Regulating Backyard Swine Raising in Barangay Sta. Irene,


Bayugan City and Providing penalty in Violation Thereof

WHEREAS, Barangay Sta. Irene is committed to the protection, preservation and


conservation of the ecosystem;

WHEREAS, Sections 15 and 16, Article II of the 1987 Philippine Constitution which
respectively provide that “The State shall protect and promote the right of the
people and instill health consciousness among them”, and that “The State
shall protect and advance the right of the people to a balanced and healthful
ecology in accord with the rhythm and harmony of nature”;

WHEREAS, Section 16 of Republic Act 7160, otherwise known as the Local


Government Code of 1991, provides that every local government unit shall exercise
the powers expressly granted, as well as powers necessary, appropriate, or
incidental for its effective and efficient governance, and those which are
essential to the promotion of the general welfare;

AN ORDINANCE REGULATING BACKYARD SWINE RAISING AND SMALL SCALE PIGGERY


IN BARANGAY STA. IRENE, BAYUGAN CITY AND PROVIDING PENALTY IN VIOLATION
THEREOF

BE IT ORDAINED BY THE SANGGUNIANG BARANGAY IN SESSION ASSEMBLED THAT:

Section 1. TITLE. This Ordinance shall be known as “AN ORDINANCE REGULATING


BACKYARD SWINE RAISING AND SMALL-SCALE PIGGERY IN BARANGAY STA.
IRENE, BAYUGAN CITY AND PROVIDING PENALTIES IN VIOLATION THEREOF”.

Section 2. AUTHORITY. This Ordinance is enacted pursuant to the intents and spirit of
PD 856 or the Sanitation Code of the Philippines, RA 9003 or the Ecological
Solid Waste Management Act, RA 8749 or the Clean Air Act, RA 9275 or the
Clean Water Act, RA 6969 or the Act to Control Toxic Substances and
hazardous and Nuclear Wastes, and Section 16 of Republic Act 7160,
otherwise known as the Local Government Code of 1991, which provides that
the local government units shall exercise the powers expressly granted, as well
as powers necessary, appropriate, or incidental for its effective and efficient
governance, and those which are essential to the promotion of the general
welfare.

Section 3. COVERAGE. This ordinance shall cover all the residential houses,
commercial establishments, farm dwellings, and agricultural areas situated
within the territorial jurisdiction of Barangay Sta. Irene, Bayugan City.

Section 4. PURPOSE. This ordinance is enacted for the following purposes:


a. to promote public health and welfare;
b. protect the integrity of the environment, and
c. prevent ground water and surface water contamination, air pollution
and disease.

Section 5. DEFINITION OF TERMS. Words and phrases used in this ordinance shall be
understood in the sense indicated hereunder:

1. Animal Wastes –means a material composed of excreta, with or


without bedding materials and/or animal drugs, collected from
poultry, ruminants or other animals except humans.
2. Backyard Swine Raising – refers to raising of swine in household
backyard. It involves 3 heads and no sow.
3. Heads – include weanings, growers and fatteners.
4. Pigpen – a pen or enclosure for a pig or pigs.
5. Small Scale Piggery – refers to raising of 2 sows or more than 2 but not
more than 20 heads.
6. Standard Septic Tank – a watertight, multi-chambered receptacle,
constructed within the set standards that receives sewage from
houses or other buildings and is designed to separate and store the
solids and partially digest the organic matter in the sewage.
7. Swine Raisers – individuals or persons engaging in raising swine.
8. Waste Discharge – Something that flows out or forth, especially an
outflow from a sewer or sewage system. It also refers to the sewage
or other liquid waste that is discharged, as into a body of water.
9. Body of Water – most often refers to large accumulations of water,
such as streams, rivers, and lakes, but it includes smaller pools of
water such as ponds, wetlands, or more rarely, puddles.

Section 6. REGULATED ACTS. The owners of backyard pig pens or backyard swine
raisers and small-scale piggeries must adhere to the following regulatory measures:

1. Backyard swine-raising shall be allowed for a maximum of 3 heads.


2. Sows are not allowed in densely populated areas or puroks in the
barangay.
3. A “standard septic tank” is strictly required. It should be watertight. It shall
be built of concrete, whether pre-cast or poured in place. Brick, concrete
blocks or adobe may be used.
4. It shall be unlawful to directly discharge animal wastes in any irrigation
canal, river/riverbanks, or any body of water.
5. It shall be the responsibility of swine raisers to regulate the odor/waste
discharge of their own pigpens.
6. Small-scale piggery must be at least 500 meters from densely populated
puroks/areas.

Section 7. REGULATORY COMMITTEE.

1. Composition of Barangay Swine Raising Regulatory Committee:

Co-Chairman: Barangay Kagawad-Chairman, Committee on
Health and Sanitation
Members: Barangay Kagawad-Chairman on Environment
and Natural Resources
Barangay Kagawad-Chairman on Housing and
Land Utilization
Barangay Kagawad-Chairman on Barangay
Affairs
Purok Presidents
Barangay Secretary
Barangay Treasurer
Chief Tanod
Chief BHW

2. Responsibilities of the Barangay Regulatory Committee:

1. The Committee shall have a regular quarterly meeting to discuss


topics regarding this ordinance.
2. The Committee shall require a comprehensive listing of swine raising
activities in all barangays in the barangay.
3. The Committee shall determine the imposition of penalties and/or
closure of backyard pigpens.
4. All complaints to be considered by the Barangay Swine Raising
Regulatory Committee shall be coursed through to the Office of the
Chairman which is the Barangay Captain.

Section 8. PENAL CLAUSE. Violators of this Ordinance shall be penalized with the
following:

1. 1st Offense – warning


2. 2nd Offense – Summon
3. 3rd Offense – Closure of pigpen and imprisonment of not
exceeding 6 months upon the discretion of the court.

Section 9. SEPARABILITY CLAUSE. In the event any part or portion of this ordinance is
declared to be illegal, unconstitutional or invalid, those parts or portions
thereof which are not affected thereby shall continue to be effective and
enforceable.

Section 10. REPEALING CLAUSE. Any prior ordinance in conflict or inconsistent with
this ordinance shall be deemed repealed or amended accordingly.

Section 11. EFFECTIVITY CLAUSE. This ordinance shall take effect after complying with
the requirements as to posting and publication as provided for under Section
59 of RA 7160.
