RESOLUTION RECOMMENDING NEGOTIATED PROCUREMENT UNDER BAYANIHAN ACT (GPPB

RESOLUTION NO. 06-2020 DATED APRIL 6, 2020 FOR THE PROCUREMENT OF RELIEF GOODS (830 BAGS
OF WELL-MILLED RICE @ 50 KILOS AND 8,400 KILOS LEGUME SEEDS) AMOUNTING TO TWO MILLION
ONE HUNDRED SIXTY NINE THOUSAND NINE HUNDRED SEVENTY NINE PESOS (P 2,169,979.00) TO BE
GIVEN AS RELIEF ASSISTANCE TO THE CONSTITUENTS AFFECTED BY THE ENHANCED COMMUNITY
QUARANTINE

WHEREAS, Republic Act No. 9184 otherwise known as Government Procurement Reform Act
provides for modernization, standardization and regulation of government procurement in all its
branches and instrumentalities regardless of funding;

WHEREAS, the Municipal Government of Gamu, Isabela thru its Municipal Bids and Awards
Committee (MBAC) will procure relief goods (830 bags of well-milled rice @ 50 kilos and 8,400 kilos
legume seeds) to be given as relief assistance to the constituents affected by the enhanced community
quarantine;

WHEREAS, Section 53.2 of the procurement law allows resort to Negotiated Procurement in
Emergency Cases provided that the conditions indicated therein has been met;

WHEREAS, on March 8, 2020, President Rodrigo Roa Duterte through Proclamation No. 922
declared a state of Public Health Emergency throughout the country ;

WHEREAS, the Government Procurement Policy Board through Resolution No. 03-2020 dated
March 9, 2020 has approved the adoption of efficient, effective and expedient procurement procedures
during a state of public health emergency;

WHEREAS, GPPB Resolution No. 06-2020 dated April 6, 2020 allows another procurement
modality which is Negotiated Procurement under Bayanihan Act;

WHEREAS, there is an immediate need for purchase of relief goods to be given to the

constituents affected by the enhanced community quarantine;

WHEREAS, the MBAC upon thorough deliberation, recommends to the Head of the Procuring
Entity (HOPE) to resort to NEGOTIATED PROCUREMENT UNDER BAYANIHAN ACT of GPPB Resolution
No. 06-2020 dated April 6, 2020;

NOW, THEREFORE, for the consideration of the foregoing, by the power vested in US by law,
WE, the members of the Municipal Bids and Awards Committee of the Municipal Government of Gamu,
Isabela, hereby RECOMMENDS, as we, hereby recommend to resort to NEGOTIATED PROCUREMENT
UNDER BAYANIHAN ACT of GPPB Resolution No. 06-2020 for the Procurement relief goods (830 bags
of well-milled rice @ 50 kilos and 8,400 kilos legume seeds) amounting to Two Million One Hundred
Sixty Nine Thousand Nine Hundred Seventy Nine Pesos (P 2,169,979.00) to be given as relief assistance
to the constituents affected by the enhanced community quarantine;

RESOLVED FURTHER, that the Office of the MGSO thru the Supply Officer shall directly negotiate
with a supplier with technical, legal and financial capability for the purchase of the needed quantity of
rice and legume seeds;

RESOLVED FINALLY, that copy hereof be forwarded to the Municipal Mayor for his information
and proper action, to the Audit Team Leader for his information and record;

RESOLVED at the Office of the Municipal Mayor, Municipal Hall, Gamu, Isabela this 14th day of
April 2020.
