AFFIDAVIT
 
            I, PCpl Edward Rey B Paggabao, of legal age, Filipino citizen, presently assigned at
Fairview Police Station, Quezon City Police District, after having been duly sworn to in accordance
with law, hereby depose and say:
 
1. That, I was directed to submit an answer before the Office of the Pre-Charge
Investigation Section, PS-5 on the alleged administrative complaint of Grave Neglect of
Duty filed against me for failure to attend court hearing as prosecution witness on May 5,
2016 at 8:30 in the morning in relation to Criminal Case No. R-QZN-15-10798 at RTC
Branch 98, Quezon City;

2. That, on April 22, 2016, I was confined at Far Eastern University-Nicanor Reyes Medical
Foundation (FEU-NRMF) Medical Center after sustaining gunshot wound in an armed
encounter while serving an Arrest Warrant to certain Robbery suspects reportedly
lurking in our area of responsibility;

3. That, I was confined at the above cited hospital for more than three (3) months or until
August 2, 2016 due to several surgical operations/procedures I have undergone
because of the severity of my condition which further developed serious complications in
the course of my medical treatment;

4. That, because of the plight I have endured for serving our country, I am still wearing a
medical pouch/bag commonly known as “colostomy bag” attached to my “stoma” or a
surgical opening in my abdomen to collect fecal matters from my digestive tract as a
result of Loop Ileostomy procedure;

5. That, the aforementioned circumstances which are purely service connected and
beyond my control are the very reason why I failed to attend such court duty;

6. That, it is also noteworthy that based on the hereto attached generated PNP Personnel
Data Sheet, I am now on my 14 th fruitful year in the police service and a recipient of
numerous awards and commendations especially the MEDALYA NG KAGALINGAN and
MEDALYA NG SUGATANG MAGITING conferred to me by our Higher Office for the
remarkable and exemplary performance of my duty in connection with the
aforementioned circumstances.

7. That, attached to form as an integral part hereof is a copy of SPOT REPORT from
Fairview Police Station dated April 22, 2016; CERTIFICATION for Special Financial
Assistance purposes issued by PMAJ ROMMEL Q. CRISTOBAL, Medical Officer, PE
Section of PNP General Hospital; Medical Certificates dated July 15, 2016 and August
2, 2016 issued by DR. RICHARD CONRAD VELARDE, Chief Resident of FEU-NRMF
Medical Center; and Statement of Account from FEU-NRMF Medical Center.

WHEREFORE, premises considered, it is most respectfully prayed unto your good office
that this instant case filed against me be DROPPED AND CLOSED for lack of probable cause.
