AGAINST WOMEN AND THEIR CHILDREN (VAWC) CASES IN THE PROVINCE OF
ILOCOS SUR.

1. On the MAIN TITLE OF THE ORDINANCE
1.1 For purposes of grammatical correction and clarity, change the words
“GENDER BASED AND VIOLENCE” to “GENDER-BASED VIOLENCE”,
to read:

WHEREAS, pursuant to Republic Act (RA) 9710, otherwise known as the “Magna Carta of
Women” is a comprehensive women’s human rights law that seeks to eliminate
discrimination against women by recognizing, protecting, fulfilling and promoting the rights
of Filipino women, especially those in the marginalized sectors. Section 12 D, Rule IV of the
Rules and Regulations Implementing the Magna Carta of Women provides for the
establishment of a VAW desk in every barangay to ensure that violence against women cases
are fully addressed in a gender-responsive manner;

3.1. Create a new WHEREAS to become the Second WHEREAS, starting with
the words “Section 12 D, Rule IV, enclose in open and close quotation marks the
words “Rules and Regulations Implementing the Magna Carta of Women insert
the words “Violence Against Women and their Children (VAWC)” after the word
“a” and remove the acronym VAW for purposes of grammatical correction,
clarity and precision- all to read:

WHEREAS, Section 12 D, Rule IV of the “Rules and Regulations Implementing the Magna
Carta of Women” provides for the establishment of a Violence Against Women and their
Children (VAWC) desk in every barangay to ensure that violence against women cases are
fully addressed in a gender-responsive manner;

4. On the THIRD WHEREAS (which now becomes the Fourth WHEREAS)


4.1 For purposes of grammatical correction and clarity, change the comma(,) into
a semi-colon (;) after the word “municipality”; change the word “Under” to

services to women, children, youth and other sectors is within the auspices of the City

and incidents as well as acts as a referral mechanism for complainants;

WHEREAS, R.A No. 10175 or the “Cybercrime Prevention Act” enjoins local
government units to support and participate in the creation of cybercrime prevention
programs;

7.1 For purposes of specificity, enclosed in open and close quotation marks (“”)
“Anti-Trafficking in Persons Act of 2003”, to read:

WHEREAS, R.A No. 9208 or the “Anti-Trafficking in Persons Act of 2003” mandates
local government units to establish and implement preventive, protective and
rehabilitative programs for trafficked persons, and to support initiatives which address
trafficking in persons;

8. On the SEVENTH WHEREAS (which is now becomes EIGHT WHEREAS)


8.1 For purposes of specificity, enclose in open and close quotation marks, “Anti-
Violence against Women and their Children Act of 2014”.
8.2 For purposes of consistency and parallelism with the Main Title of the
Ordinance, change the acronym “VAW” to “VAWC” (which means Violence
Against Women and Their Children)
8.3 For purposes of grammatical correction, change the word “who” to “which”
all to read:

WHEREAS, R.A No. 9262 or the “Anti-Violence Against Women and their Children
Act of 2004” provides that the barangay shall have a barangay VAWC desk who shall
coordinate a one-stop help desk, and that this shall be open to provide 24-hour response;

9. On the Tenth WHEREAS (which now become the ELEVENTH WHEREAS)


9.1 For purposes of consistency and parallelism with the Main Title of the Ordinance,
change the words “Violence against Women: to “Violence against Women and Their
Children” and the acronym (VAW) to (VAWC).

9.2 For the same reason, change the words “Violence Against Women” in the latter part
of the WHEREAS to “Violence Against Women and Their Children and place the
corresponding acronym VAWC thereafter; place the acronym (GBV) after the words
“Gender-Based Violence”.

9.3 For purposes of grammatical correction and precision, change the word “increase” to
“increases”- all to read:

WHEREAS, there is a need to adapt modalities of interventions forGender-Based Violence


(GBV) and Violence Against Women and their Children (VAWC) as women and girls
experience a distinct challenge as COVID-19 exacerbates already existing risks of Violence
Against Women and their Children (VAWC) and Gender-Based Violence(GBV) as
confinement increases risks of violence, as well as worsened socio-economic situation within
the household;

10. On the ELEVENTH (which is now becomes the TWELFTH and LAST WHEREAS)
10.1 For purposes of consistency and parallelism with the Main Title of the Ordinance
and the preceding WHEREAS, change the acronym VAW to VAWC, to read:

WHEREAS, the establishment of a response referral system provides for an intervention that
will ease reporting, expedite investigation, and provide instant response and information on
VAWCand GBV. It also raises the consciousness of the public in recognizing the dignity of
women, ensuring support for victims, bringing perpetrators to justice and making a long-term
plan to prevent violence in all forms;

11. On the Enactment Clause beginning with the words “Be it ordained”
11.1 For purposes of proper legislation format and procedure, let it be amended as
follows:

NOW, THEREFORE, upon motion of Hon. Maria Mikaela Karita S. Mendoza,


seconded, be it enacted by the SangguniangPanlalawigan, Province of Ilocos Sur, in
session assembled that:

12. On the short TITLE of the Ordinance (SECTION 1)


12.1 For purposes of specificity enclose the short TITLE or open and close quotation
marks and capitalize all important words, to read:

SECTION 1. TITLE - This Ordinance shall be known and cited as “An Ordinance
Establishing a Gender-Based Violence Response Mechanism and Protocol in Handling
Gender-Based and Violence Against Women and Their Children (VAWC) cases in the
Province of Ilocos Sur”.

13. On the DEFINITION OF TERMS (SECTION 2)


13.1 For purposes of specificity, change the word “ordinance” to “Ordinance”.
13.2. In order to be consistent and parallel with the heading of Section, change the Word
“apply” to “mean”- all to read:
SECTION 2. DEFINITION OF TERMS. - For the purpose of this Ordinance, the following

2.1 Gender-Based Violence (GBV)– refers to violence targeted towards a particular


person because of theirhis/her gender that causes or likely to cause another’shis/her
mental, emotional or psychological distress, and fear of personal safety, sexual
harassment acts including unwanted sexual remarks and comments.
13.4 On Item 2.2.3 (One connotation of Violence Against Women (VAW)

13.4.1 For purposes of specificity, enclose in open and close quotation marks (“”) the
Title “Magna Carta of Women”, to read:

2.2.1 Physical, sexual, and psychological violence perpetrated or condoned by the


State, wherever it occurs. It also includes acts of violence against women as
defined in R.A No. 9208 and R.A No. 9262. Under the “Magna Carta of
Women”, this term is used interchangeably with gender-based violence.

13.5 On the GBV/VAW Hotline (Item 2.4)


13.5.1 Place the acronym (VAWC) after the words “Violence Against Women
and their Children”.

14. On ESTABLISHMENT OF GBV/VAW DESK IN EVERY BARANGAY


(SECTION 4)
14.1 For purposes of consistency and parallelism with the Main Title of the Ordinance,
change the acronym VAW to VAWC (Violence Against Women and their Children)
14.2 On Setting up the GBV/VAW Desk (paragraph 4.1)
14.2.1 For purposes of consistency and parallelism with the Main Title of the

4.1. Setting up the GBV/VAW Desk – The Punong Barangay shall designate an
area within the barangay hall for the GBV/VAWC desk. He/Sheshall provide for the
necessary furniture and fixtures such as, but not limited to, table, chairs, separate filing
cabinet and log book for record-keeping of cases. Likewise, the Punong Barangay shall
ensure the confidentiality of the case and privacy and safety of the victim-survivor.

14.3 On Designation of VAW/GBV Desk person (par. 4.2)


14.3.1 For purposes of consistency and parallelism with the Main Title of the
Ordinance, SECTION 4 and paragraph 4.1 above, change the acronym VAW to VAWC.
14.3.2 For purposes of grammatical correction and clarity, change the word “the”
in the first statement to “The”; change the semi-colon to a comma (,) after the word “cases”, insert the
words “he shall” (referring to the Punong Barangay); place a hypen (-) after the word “gender”- all to

“4.2. Designation of VAWC/GBV Desk person – ThePunong Barangay shall


designate a VAWC Desk person who is trained in gender-sensitive handling of cases,
preferably a woman barangay kagawad or woman barangay tanod. In cases where there are no
trained personnel, he shall ensure that the person assigned shall undergo basic gender-
sensitivity training and orientation on anti-VAWC laws.

15. On FUNCTIONS OF THE BARANGAY VAW DESK (SECTION 5)


15.1 For purposes of consistency and parallelism with the Main Title. SECTION 5.2 and
4; change the acronym VAW to VAWC.
15.2 For purposes of consistency and parallelism with the rest of the Sections, place a
hypen(-) after the word “DESK”, all to read:

SECTION 5. FUNCTIONS OF THE BARANGAY VAWC DESK-The Barangay


VAWC-GBV Desk shall perform the following tasks:

GBV CASES- The following protocols shall be observed by the responding officer of the
VAWC desk when responding to GBV and VAWC.

Welfare Department.

16.3. On Par. B of SECTION 6


16.3.1. For purposes of clarity and precision, place a colon (;) after the word “victim-

INCIDENTS.

18. OnSECTION 8. PRIMARY SERVICE RESPONDERS OF GBV HOTLINE


18.1 For purposes of consistency and parallelism with previous Sections, place a hypen(-) after
the word “HOTLINE”

18.2.1 For purposes of constancy and parallelism with the Main Title of the Ordinance

SECTION 8. PRIMARY SERVICE RESPONDERS OF GBV HOTLINE- The primary service


responders of the hotline shall be:
1. Philippine National Police - as the lead agency in providing police assistance in relation to public
safety and crime prevention;
2. Municipal Social Welfare Development Office - as a response agency tasked to facilitate the
access of victims to proper psychological counselling support services and other services. For this
purpose, the LGU may refer the survivors to other service providers;
3. Provincial Health Center - as a response agency tasked to attend to survivors and cases of VAWC
and GBV.
19. OnSECTION 9. PROTOCOLS FOR HOTLINE RESPONSE.
19.1 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “RESPONSE”, to read:

“SECTION 9. PROTOCOLS FOR HOTLINE RESPONSE-The following shall be the


standard protocols to be maintained for the hotline response.”
20. OnSECTION 10. INFORMATION DRIVE AND PROMOTION OF VAW HOTLINE

20.1 For purposes of consistency and parallelism with the Main Title of the Ordinance and
previous Sections, change the acronym VAW to VAWC; place a hypen (-) after the word “HOTLINE”.
20.2 On par. 1-4 of SECTION 10
20.2.1 For purposes of consistency and parallelism with the Main Title of the Ordinance

SECTION 10. INFORMATION DRIVE AND PROMOTION OF VAWC HOTLINE-The MSWDO


shall promote the services of the VAW hotline number. To aid public recall of the number, it shall:
1. In coordination with the Office of the Mayor, require all municipal/city government offices to
post the VAW hotline number in conspicuous areas;
2. In coordination with the Engineer’s Office, put up billboards in conspicuous places within the
province to promote the VAWC hotline number;
3. In coordination with the Business Permits and Licenses Office, provide promotional material and
require all existing establishments open to the public to post the VAWC hotline number in
conspicuous areas. Likewise, it shall, in coordination with the Business Permits and Licenses
(BPLO), provide promotional material and require all public conveyance vehicles such as
tricycles, public utility jeepneys, vans, and buses to post the VAWC hotline number, and to make
this a requirement in applying for a license to operate; and
4. In coordination with the Public Information Office (PIO), undertake an information campaign to
maximize recall of the VAWC hotline number among the public.

21. OnSECTION 11. MECHANISM FOR ENFORCEMENT


21.1 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “ENFORCEMENT”, to read:

SECTION 11. MECHANISM FOR ENFORCEMENT-Compliance with this ordinance shall


be a requirement for the granting of business licenses and permits. For this purpose, the Business
Permits and Licenses Office shall require all existing establishments to include information on the
provincial hotline to be displayed in conspicuous areas, making this a requirement for every
establishment applying for a new license to operate.

22. OnSECTION 12. REINFORCED STAFFING FOR VAW HOTLINE


22.2 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “HOTLINE”.
22.2 For purposes of consistency and parallelism with the Main Title of the Ordinance, change
the acronym VAW to VAWC.

SECTION 12. REINFORCED STAFFING FOR VAWC HOTLINE- Trained VAW Desk
Personnel shall also be trained to receive complaints made to the hotline Wherewhen they will be
able to respond to calls and requests and are able to link community focal points such as the
DSWD, PNP, or nearest public hospitals--whichever the incident may demand. The responder
shall be trained to ensure safe disclosure and referral of the survivor, preferably female personnel.

23. OnSECTION 13. ESTABLISHMENT OF PROVINCIAL PROTECTION CENTERS FOR


GBV VICTIM-SURVIVORS.
23.1. For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “VICTIM-SURVIVORS”
23.2 On Item II of SECTION 13
23.2.1 For purposes of grammatical correction and clarity, place a semi-colon (;) after
each item in ii.atoii.d, to read:

SECTION 13. ESTABLISHMENT OF PROVINCIAL PROTECTION CENTERS FOR GBV


VICTIM-SURVIVORS-The Center shall be created under the PSWDO, which shall also act as the
lead agency in its operations. The Center shall ensure that the needs of GBV victim-survivors are
fully addressed in a gender-responsive and non-judgmental manner.
I. The Center shall provide the following, as may be appropriate:
i.a complete intervention and protection services for victim-survivors and their
families, including medical, police, medico-legal, legal, and psychological services;
i.b ensure the safety and security of the victim-survivors;
i.c provide referrals to longer-term shelters for victim-survivors;
i.d provide referral for offenders and case management for rehabilitation of
perpetrators of violence, abuse, and exploitation; and
i.e serve as a resource center on information about GBV in the province.

II. The Center shall have the following facilities:

ii.b Counselling / psychotherapy room;
ii.c Medical / examination room;
ii.d Records / database room;
ii.e Rest and recreation area..

24. OnSECTION 14. MONITORING AND REPORTING


24.1 For purposes of consistency and parallelism with previous Sections, plae a hypen (-) after
the word “REPORTING”, change the acronym VAW to VAWC.
24.2 In the body of the Section, change the acronym V AW to VAWC, for the same purpose as
above.
24.3 For purposes of grammatical correction and clarity, place a hypen(-).

SECTION 14. MONITORING AND REPORTING- (a)All VAWC Desk Person-in-Charge


within one month after the passage of the Ordinance shall submit a report on the establishment of
Barangay VAWC Desk in their respective Barangay to the Office of the Sangguniang Bayan, to
the Office of SangguniangPanlalawigan under the Committee on Family and Women Affairs and
Provincial Social Welfare and Development Office (PSWDO).
a) Furthermore, all designated VAWC Desk personnel in charge shall record and file all VAWC
Cases in their respective Barangay and Municipality/City and a Quarterly Report be likewise
submitted to the above-mentioned office including the Action Taken and Status for each case.
VAWC case records should be treated with utmost confidentiality and security, and ensure that
only authorized personnel can have access to it.
b) The Business Permits and Licensing Office(BPLO)are authorized to conduct regular visitation
and inspection of business establishments to ensure that the information dissemination component
of this Ordinance is met.

25. OnSECTION 15. APPROPRIATIONS


25.1 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “APPROPRIATIONS”
25.2 For purposes of clarity and disinfection, divide the body of the Section into paragraphs (a)
and (b).
25.3 On the second paragraph of SECTION 15 which is now par. (b)
25.3.1 For purposes of specificity, change the words “provincial government” to
“Provincial Government”- all to read:

SECTION 15. APPROPRIATIONS-


a) The appropriations for the implementation of this Ordinance shall be sourced and
appropriated from the institutions’ respective Gender and Development Budget
(GAD Budget) such as for repairs, maintenance and materials acquisition. Respective
agencies designated to provide service shall also allocate corresponding budget
sourced from their agency programs.
b) The Provincial Government shall ensure the sustainability of the operation of the
hotline and shall appropriate necessary funds for the operations of the VAWC hotline
which includes but is not limited to the operation of the hotline, salaries and training
of personnel. The budget shall be disbursed only according to usual accounting and
auditing procedures.
c)
26. OnSECTION 16. REPEALING CLAUSE.
26.1 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “CLAUSE”, to read:

SECTION 16. REPEALING CLAUSE- All provisions of local ordinances, orders,circulars and
resolution, rules and regulations and the like inconsistent herewith are hereby repealed and/or
modified accordingly.

27. OnSECTION 16. REPEALING CLAUSE


27.1 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “CLAUSE”.
27.2 For purposes of specificity, change the word “ordinance” to “Ordinance”,to read:
SECTION 17. SEPARABILITY CLAUSE- If for any reason any part of this Ordinance shall be held
unconstitutional or invalid, other parts hereof which are not affected thereby shall continue to be in full
force and effect.

28. OnSECTION 18. EFFECTIVITY.


28.1 For purposes of consistency and parallelism with previous Sections, place a hypen (-) after
the word “EFFECTIVITY”.
28.2 Add the Phrase “fifteen (15) days after its publication in a newspaper of general circulation
in the Province”, because under the law and existing jurisprudence, a statute or law (such as an
Ordinance, in this case) takes effect only after such publication to give a chance to the people to know
about the Ordinance to satisfy the principle that “Ignorance of the law excuses no one”.
28.3 For purposes of specificity, change the word “ordinance” to “Ordinance”, to read:
SECTION 18. EFFECTIVITY- This Ordinance shall take effect upon its approval, fifteen (15) days
after its publication in a newspaper of general circulation in the Province.

II. RECOMMENDATION/S
1. It is highly recommended that subject Ordinance be re-written, considering and incorporating all
the insertions, recommendations and amendments as above stated and discussed.
