1. What is the difference between harassment and bullying?

 Harassment is unwanted behavior which you feel intimidated or humiliated.


 Bullying is the use of force, or coercion or threat, to abuse, aggressively dominate or
intimidate.

2. What is the impact of being bully to a person?

IMPACT ON STUDENT WHO ARE BULLIED


 Feel disconnected from school and not like school.
 Have lower academic outcomes.
 Miss school and not complete school year.
 Lack quality friendship at school.
 Be more vulnerable and have lower level of resilience.
 Have depression, anxiety, feelings of loneliness and isolation.
 Have low self-esteem.
 Not be accepted by peers, be socially withdrawn and avoid conflict.
 Have nightmares.
 Feel worry or suspicious of others.
 Have an increased risk of depression and substance abuse with high risk to commit suicide.

3. What are the causes that makes a crew member be physically and mentally
demotivated?

 Lack of interest in work.


 Lack of motivation.
 Short temper.
 Careless mistakes while doing work.
 Tendency to take short cuts to finish work

4. What causes the seafarer to be mentally and physically drained out?

 Shortage of man power because of less crew members.

 Unfriendly working environment.

5. What are the ways in which seafarers can adopt to be physically and mentally
motivated?

 Express the optimistic view of their chances of success.


 Inform them the compensation and benefit of being seafarer.
 Set themselves a realistic goals.
 Sought out opportunities that could give them the chance of success, wealth and
happiness.
 Use your time, it is elastic, stretch it so you can get more out of it, once you conquer time,
you will be more motivated because you can praise yourself for achieving it.

6. How important is it that a crew is well protected in his work?

UNDER INTERNATIONAL LABOUR CONFERENCE (ARTICLE IV)


 Every seafarer has the right to a safe and secure work place that complies with safety
standard.
 Every seafarer has a right to fair term of employment.
 Every seafarer has a right to decent working and leaving conditions on board ship.

7. What are the procedures for a seafarer to have a fair employment agreement?

TO ENSURE THAT SEAFARER HAVE FAIR EMPLOYMENT AGREEMENT.


 The term and conditions for employment of a seafarer shall be set out or referred to in a
clear written legally and enforceable agreement and shall be consistent with the standard
set out in the code.
 Seafarers employment agreements shall be agreed to by seafarer under conditions which
ensure that the seafarer has an opportunity to review and seek advice on the terms and
conditions in the agreement and freely accept them before signing.
 To the extend compatible with the member’s national law and practice, seafarers’
employment agreement shall understood to incorporate any applicable collective
bargaining agreement.

8. How important for a seafarer to know the safety working procedure onboard?

THE NEW CREW SHOULD BE AWARE OF THE IMPORTANT SAFETY WORKING PROCEDURES,
SECURITY PLAN AND SHIP EQUIPMENT.
 Instruction of SOLAS and MARPOL.
 Important features of muster list.
 Guidelines on how to tackle all kinds of emergency situation on ships.
 Important documents and publications of ships.
 Ships fire control plan.

9. What are the important procedure to follow when investigating disciplinary action?

DISCIPPLINARY ACTION CAN FEEL QUITE FORMAL AND TIME CONSUMING, BUT IT IS
IMPORTANT TO FOLLOW THE PROCEDURES CORRECTLY TO PROTECT YOURSELF FROM

LEGAL CLAIM.

 Get an initial understanding, establish facts as soon as you can, get the crew side of the
story before you can decide on your next steps.
 Investigate thoroughly- if the offence is more substantial, or it is not the crews first, you
may need to resort to formal procedure.
 Invite the crew to a disciplinary meeting- the crew to a formal disciplinary meeting in
writing, provide them with notice of the meeting, be sure to advise them their right to be
accompanied and provide copies of all the evidence you hold against them for their review.
 Conduct disciplinary meeting- in disciplinary meeting you’ll need to:
 Check that the crew is aware of their right to be accompanied.
 Run through the allegations you hold against them and invite them respond.
 Review the evidence you hold and offer the crew an opportunity to add any further
comments.
 Make sure notes are taken throughout the meeting.
 If you feel more investigation is needed before you make your decision, advise both
parties to a further meeting.
 Decide on the action to take- after the meeting, consider all evidence you now have and
whether it’s sufficient to prove the allegation of miss conduct.

10.What are the procedure when investigating harassment and bullying under the national
law?

PROCESS OF INVESTIGATING COMPLAINT OF HARASSMENT AND BULLYING OF CREW


MEMBER UNDER NATIONAL LAW Investigation should be prompt and objective,
recognizing that seafarer do not normally make an accusation unless they feel seriously
aggrieved.
 In formal process- in formal discussion to both parties often lead to a greater
understanding and an agreement for the behavior to cease.
 Normal process- when a formal process has been made, an investigation should take place
in accordance with company procedures to determine whether action should be taken.
 Confidentiality- investigate every complaint in a way appropriate to the circumstances and
in accordance with company policy and procedures.
 Hearing- the principle of fair treatment should be applied to all disciplinary grievance
hearings, any result in a disciplinary hearing are held in confidence.
 Resolution of case/action- upon resolution, the company should ensure the appropriate

11.What are the requirements in handling crew wages, advances and allotment of
management level officers on board ship?

ALL SEAFARER SHALL BE PAID FOR THEIR WORK REGULARLY IN ACCORDANCE WITH THEIR
EMPLOYMENT AGREEMENT.
 Each member shall require that payment due to seafarers working on ship at no greater
than monthly intervals.
 Seafarer shall be given monthly account of the payment due, wages, overtime and the
exchange rate used where payment has been made in currency

12.What are different drills being implemented on board ship?

Onboard training is supported by drills and exercises are the following:


o Lifeboat drill
o Fire drill
o Enclosed space entry
o Search and rescue drills
o Oil spill drill
o Anti-piracy drills

13.How important is the Drills being done on board ship?

The purpose of carrying out any kind of drill on the ships is to make the crew acquainted
with various procedures to be followed during emergency situations. To prepare the crew
in dealing with an emergency situation that may arise.

14.What are the effective training method to be used for training?

METHODS FOR ENSURING THAT CREW ARE MOTIVATED TO PARTICIPATE FULLY IN


TRAINING
 Provide them financial and incentive- give them the proper payment which they desired.
 Provide a pleasant place of training- everyone wants to work in a conducive environment
which is clean and pleasant.
 Offer opportunities for self-development- provide your team with the training they need to
advance in their career.
 Foster collaboration within the team- encourage the member of your team to fully

participate by inviting their input and suggestion on how to things better.

 Set a clear goals- make sure everyone knows exactly what those goals are, what their

PART 2. EXTEND

1. As a student, do you think bullying is the right attitude towards a person?

No, I thought that this attitude seemly not appropriate toward another person. It may
feel bad to itself someone who are bullied and may lead to have suicide thoughts. The bully
wants you to react. Their goal is to take away your power, make you sad and scared. And if
you show them you are not sad and scared, they will often lose interest and they cannot
take away your power. Remember they want to upset you constantly so you get angry. If
you don’t get angry, the bully will lose their own power.

2. As a ship owner, is it only right that a seafarer should be safe, well-motivated and
inspired when they go on board ship? Why?

This is for the seafarer to work accurately when they know that the working
environment are safe, When they well motivated and inspired to work the comfortability of
the workers to each other are good also. All of this will bring to the workers a good
condition for the ship.

3. As a ship owner, do you think that the present salary rate being provided by sip owner to
the crew is fully enough compensation? Why?

No, As I know the flexibility work of the Filipino workers makes the ship owners
advantage of it. They perform their duties that are not part of their contract and also the
excessive working hours are not paying enough for them. I may say that for us being a
seafarer has a good salary amount and it give us a good of life and provide a good
comfortable well-being.
