ُ ‫َوالتَّا ِر ُك لِ ِدينِ ِه ا ْل ُمفَا ِر‬
‘Abdullāh ibn Mas'ud - ‫ رضي هللا عنه‬reported that the Messenger of Allah ‫ﷺ‬
said: "The blood of a Muslim is inviolable except by one of three: adultery by a married
person, a life for a life (homicide), and abandoning Islam and separating from the
Islamic body.'' 

Explanation of Hadith
The blood of the Muslim is inviolable except by one of the three things mentioned in this
Hadīth.
 First, a married person who already had sexual relation with his legitimate wife, yet
committed fornication.
 Second, a Muslim who intentionally kills another Muslim for no legitimate reason.
 Third, apostasy (a Muslim who abandons Islam and separates from the Islamic body).
It is not permissible to shed the blood of a Muslim, except in these three cases and
cases that fall under these categories although not mentioned explicitly in this Hadīth.
These include homosexuality and incest, both of which fall under the first category;
magic, which falls under the third category, and so on.

))‫ا ْلقِيَا َم ِة فِي ال ِّد َما ِء‬

Ibn Mas'ud - ‫ رضي هللا عنه‬reported:


The Messenger of Allah ‫ ﷺ‬said, "The first matter concerning which people will
be judged on the Day of Resurrection will be the matter of blood."

[Al-Bukhari and Muslim]

Explanation of the Hadith

On the Day of Judgment, Allah, the Almighty, shall call His slaves to account. Then, He
shall judge between them with His justice, starting with the most important grievances.
Homicide is the gravest and most dangerous grievance; therefore, it will be the first case
to be settled on that great Day. This is with regard to the injustices committed among
people. Regarding the slave's own deeds, however, the first deed to be judged upon will
be prayer

‫ق َع ْب ُد هَّللا ِ بْنُ َ‬ ‫عَنْ َ‬

‫س ْه ٍل ‪َ -‬و ُه َو َيتَش ََّحطُ ِفي َد ِم ِه قَتِيالً ‪ -‬فَ َد ْفنه ‪ ,‬ثُ َّم قَ ِد َم ا ْل َم ِدينَةَ ‪ ,‬فَا ْنطَلَ َ‬
‫ق َع ْب ُد‬ ‫ص ْل ٌح ‪ ,‬فَتَفَ َّرقَا ‪ ,‬فَأَتَى ُم َحيِّ َ‬
‫صةُ إلَى َع ْب ِد هَّللا ِ ْب ِن َ‬ ‫ُ‬

‫س ُعو ٍد إلَى النَّبِ ِّي ‪ -‬صلى هللا عليه وسلم ‪ -‬فَ َذه َ‬
‫َب َع ْب ُد ال َّر ْح َم ِن يَتَ َكلَّ ُم ‪ ,‬فَقَا َل النَّبِ ُّي‬ ‫صةُ ا ْبنَا َم ْ‬
‫صةُ َو ُح َويِّ َ‬
‫س ْه ٍل َو ُم َحيِّ َ‬
‫ال َّر ْح َم ِن بْنُ َ‬

‫ستَ ِحقُّونَ قَاتِلَ ُك ْم ‪ ,‬أَ ْو‬


‫س َكتَ ‪ ،‬فَتَ َكلَّ َما ‪ ,‬فَقَا َل‪ :‬أَت َْحلِفُونَ َوتَ ْ‬ ‫‪ -‬صلى هللا عليه وسلم ‪َ :-‬كبِّ ْر ‪َ ,‬كبِّ ْر ‪َ -‬و ُه َو أَ ْحد ُ‬
‫َث ا ْلقَ ْو ِم ‪ -‬فَ َ‬

‫سينَ يَ ِمينا ً قَالُوا‪َ :‬كيْفَ بِأ َ ْي َما ِن قَ ْو ِم ُكفَّا ٍر؟ فَ َعقَلَهُ‬


‫ش َه ْد ‪َ ,‬ولَ ْم نَ َر؟‪ ‬قَا َل‪ :‬فَتُ ْب ِرئُ ُك ْم يَ ُهو ُد بِ َخ ْم ِ‬

‫س ُم َخ ْمسُونَ ِم ْن ُك ْم َعلَى َر ُج ٍل ِم ْن ُه ْم ‪ ,‬فَيُ ْدفَ ُع‬ ‫ث َح َّما ِد ْب ِن َز ْي ٍد‪(( :‬فَقَا َل َر ُ‬


‫سو ُل هَّللا ِ ‪ -‬صلى هللا عليه وسلم ‪ :-‬يُ ْق ِ‬ ‫َوفِي َح ِدي ِ‬

‫سو َل هَّللا ِ ‪ ,‬قَ ْو ٌم‬ ‫ش َه ْدهُ َكيْفَ نَ ْحلِفُ ؟‪ ‬قَالُوا‪ :‬فَتُ ْب ِرئُ ُك ْم يَ ُهو ُد بِأ َ ْي َما ِن َخ ْم ِ‬
‫سينَ ِم ْن ُه ْم؟‪ ‬قَالُوا‪ -]235[- :‬يَا َر ُ‬ ‫بِ ُر َّمتِ ِه ‪ ,‬قَالُوا‪ :‬أَ ْم ٌر لَ ْم نَ ْ‬

‫َث ا ْلقَ ْو ِم‪ :‬أَصغرهم‬

‫الحب ُل‪ .‬أَي أَسيراً مقيداً بحبله‬

Hadith 346

- , ٌ‫فُالن‬ :‫فَقِي َل َمنْ فَ َع َل َه َذا بِك‬ , ‫ضوضا ً بَيْنَ َح َج َر ْي ِن‬ ُ ‫((أَنَّ َجا ِريَةً ُو ِج َد َر ْأ‬ :- ‫ رضي هللا عنه‬- ‫س ْب ِن َمالِ ٍك‬
ُ ‫س َها َم ْر‬ ِ َ‫عَنْ أَن‬

َ ‫ض َر ْأ‬
ُ ‫سه‬ َّ ‫ أَنْ يُ َر‬- ‫ صلى هللا عليه وسلم‬- ‫ فَأ َ َم َر النَّبِ ُّي‬, َ‫ي فَا ْعتَ َرف‬ ِ ‫ فَأ َ ْو َمأَتْ بِ َر ْأ‬, ‫ي‬
ُّ ‫ فَأ ُ ِخ َذ ا ْليَ ُهو ِد‬, ‫س َها‬ ٌّ ‫فُالنٌ ؟ َحتَّى ُذ ِك َر يَ ُهو ِد‬

))‫ بَيْنَ َح َج َر ْي ِن‬.


Anas ibn Mālik - ‫ رضي هللا عنه‬reported: A girl was found with her head crushed between
two stones. They asked her: "Who did that to you? Is it so-and-so, or so-and-so?" They
kept mentioning names until they mentioned the name of a Jew, whereupon she nodded
her head. The Jew was captured, and he confessed. Thereupon, the Messenger of Allah
‫ ﷺ‬ordered that his head be crushed between two stones. In another
narration by Muslim and An-Nasā'i: "A Jew killed a girl for her jewelry, so the
Messenger of Allah ‫ ﷺ‬killed him in retaliation for her."

Explanation of the Hadith


During the time of the Messenger of Allah ‫ ﷺ‬, a girl whose head was crushed
between two stones was found while she was still alive. They asked her about the perpetrator
by mentioning some names of those who could have done that to her. When the name of a
Jewish man was mentioned, she nodded her head, meaning that he was the perpetrator. He
was thus accused of killing her. They captured him, and he confessed that he had killed her in
order to steal silver jewelry which she was wearing. The Messenger of Allah ‫ﷺ‬
ordered that he should be killed in exactly the same manner in which he killed that girl in
retaliation for her. Thus, his head was crushed between two stones.

Hadith 349

- - ‫ش ِهدْت النَّبِ َّي‬ َ ‫فَقَا َل ا ْل ُم ِغ‬ ،‫ص ا ْل َم ْرأَ ِة‬
ُ ُ‫يرةُ بْن‬ ْ ‫ أَنَّهُ ا‬- ‫ رضي هللا عنه‬- ‫ب‬

ِ ‫اس فِي إ ْمال‬ ِ ‫عَنْ ُع َم َر ْب ِن ا ْل َخطَّا‬

))َ‫سلَ َمة‬ ْ ‫لَتَأْتِيَنَّ بِ َمنْ َي‬ :‫فَقَا َل‬ - ‫ َع ْب ٍد أَ ْو أَ َم ٍة‬- ‫ضى فِي ِه بِ ُغ َّر ٍة‬

‫ أهـ‬.ً‫ أَنْ تُ ْلق َي جنينَها َم ْيتا‬:‫الص ا ْل َم ْرأَ ِة‬


ُ ‫إ ْم‬

‫هو أن تض َع المرأَةُ ولدَها قب َل أَوانِ ِه‬ :‫الص ا ْل َم ْرأَ ِة‬


ُ ‫إ ْم‬.

ُ‫ال َعب ُد واألَمة‬ :‫ِب ُغ َّر ٍة‬

Umar ibn al-Khattāb - ‫ رضي هللا عنه‬consulted the people about a woman who was caused to

miscarry. Al-Mughīrah ibn Shu'bah said: "I witness the Messenger of Allah

‫ﷺ‬ passed a rule that a slave, male or female, be given as blood

money." 'Umar - ‫ رضي هللا عنه‬said: "Bring me someone to testify along with you." So, he

brought Muhammad ibn Maslamah- ‫رضي هللا عنه‬, who testified with him.  

Explanation of the Hadith

A woman gave birth to a dead child prematurely, as a result of a felony.

It was the custom of the just Caliph Omar Ibn Al-Khattab - ‫ رضــي هللا عنه‬- to consult his

companions and scholars in his affairs and issues. When this woman miscarried a still,

incomplete fetus, the ruling on his blood money was confused, so he consulted the

Companions - may God be pleased with them - in that. Al-Mughirah bin Shubah- ‫رضي هللا عنه‬

told him that he had witnessed the Messenger of Allah ‫ ﷺ‬- spent the birth of the

fetus "by surprise", a slave or a female slave. Omar - ‫ رضي هللا عنه‬wanted to confirm this ruling,

which will be general legislation until the Day of Resurrection. So he assured al-Mughirah-

‫ رضي هللا عنه‬that he would bring someone who would testify to the truthfulness of his saying and

the correctness of his transmission, so Muhammad bin Maslamah al-Ansari - ‫رضــي هللا عنه‬

testified to the truthfulness of what he said, - may God be pleased with them all -.

 The blood money for the fetus if he aborted dead, as a result of the felony, is a slave

or a female slave.

 Consult the people of knowledge and reason in the tasks and developments of matters,

to seek the truth and the truth.

 Verify the issues and request the correctness of the news.

 Evidence that private knowledge may be hidden from the great and taught to those

who are less than them.

 In the hadith is evidence that there is no diligence with the text.

‫ضى َر ُ‬ ‫َو َما فِي بَ ْطنِ َها فَ ْ‬

‫ضى ِب ِديَ ِة ا ْل َم ْرأَ ِة َعلَى عَاقِلَتِ َها ‪َ ,‬و َو َّرثَ َها َولَ َدهَا َو َمنْ َم َع ُه ْم ‪ ,‬فَقَا َم َح َم ُل بْنُ النَّابِ َغ ِة‬
‫ُغ َّرةٌ ‪َ -‬ع ْب ٌد ‪ ,‬أَ ْو َولِي َدةٌ ‪َ -‬وقَ َ‬

‫ستَ َه َّل ‪ ,‬فَ ِم ْث ُل َذلِ َك يُطَ ُّل؟ فَقَا َل َر ُ‬


‫سو ُل هَّللا ِ ‪-‬‬ ‫ش ِر َب َوال أَ َك َل ‪َ ,‬وال نَطَ َ‬

Hadith 351

- ‫َص َما إلَى‬


َ ‫اخت‬ َّ ‫((أَنَّ َر ُجالً ع‬ - ‫ رضي هللا عنه‬- ‫ص ْي ٍن‬
ْ َ‫ ف‬, ُ‫ فَ َوقَ َعتْ ثَنِيَّتُه‬, ‫ فَنَ َز َع يَ َدهُ ِمنْ فِي ِه‬, ‫َض يَ َد َر ُج ٍل‬ َ ‫عَنْ ِع ْم َرانَ ْب ِن ُح‬
))‫ ال ِديَةَ لَك‬, ‫ض ا ْلفَ ْح ُل‬ ُّ ‫ض أَ َح ُد ُك ْم أَ َخاهُ َك َما يَ َع‬
ُّ ‫ َي َع‬ :‫فَقَا َل‬ - ‫ صلى هللا عليه وسلم‬- ‫ النَّبِ ِّي‬.
'Imrān ibn Husayn - ‫ رضي هللا عنه‬reported: A man bit another man's hand, so the latter
pulled his hand out of his mouth by force, causing two of the former's incisors to fall
out. They referred their dispute to the Messenger of Allah ‫ ﷺ‬who said: "One of
you bites his brother like a male camel does! There is no blood money for you."  

Explanation of the Hadith


One man attacked another and bit his hand; The biter snatched his hand out of the biter's
mouth; His folds fell off; So they concluded with the Messenger of Allah ‫ﷺ‬
. The biter demands compensation for his fallen folds, and the bitten one defends himself that
he wants to save his hand from his teeth.
The Messenger of Allah ‫ ﷺ‬- denounced the biting pretender, how can he do the
same as the harsh animals do? And he said: One of you bites his brother, then after this he
comes to demand the exchange of his offending teeth?! You do not have a friend; The Badi is
the aggressor.

Benefits of the Hadith

 The legality of raising a felony to the ruler for dismissal.


 Whoever bites a person's hand and snatches it away from him; His teeth, or some of
them, fell out, and he did not have to pay him a fuel or blood money.
 This ruling is general for anyone who has been insulted by a person or animal. So he
defended himself, his honour, his sanctity, or his money; If the assailant is injured or
killed, he does not have to do anything. Because he defends what he must protect, and
that is the oppressive aggressor.
 The scholars restricted the ruling on this hadith and its like, that he defends himself
with the easiest, then the easiest of the means of defence.

‫قَا َل هَّللا ُ َع َّز‬ . َ‫ فَ َما َرقَأ َ ال َّد ُم َحتَّى َمات‬, ُ‫س ِّكينا ً فَ َح َّز بِ َها يَ َده‬
ِ ‫ فَأ َ َخ َذ‬, ‫(( َكانَ فِي َمنْ َكانَ قَ ْبلَ ُك ْم َر ُج ٌل بِ ِه ُج ْر ٌح فَ َج ِز َع‬ :- ‫وسلم‬

]241[- . ))َ‫ َح َّر ْمت َعلَ ْي ِه ا ْل َجنَّة‬, ‫س ِه‬


ِ ‫ َع ْب ِدي بَا َد َرنِي بِنَ ْف‬ :‫ َو َج َّل‬-

‫قطعها‬ :ُ‫فَ َح َّز يَ َده‬.

‫أَي ماانقط َع د ُمهُ حتى مات‬ :‫فَ َما َرقَأ َ ال َّد ُم‬


Jundub ibn ‘Abdullāh al-Bajali - ‫ رضـــي هللا عنه‬reported that the Messenger of Allah
‫ ﷺ‬said: "Among those who were before you, there was a man who was
injured. He was impatient so he took a knife and made a cut in his hand and bled to
death. Allah, the Exalted, said: 'My servant hastened to bring about his demise; I have
forbidden Paradise to him.'" 

Explanation of the Hadith


The Messenger of Allah ‫ ﷺ‬told his companions about a man from the past
nations who had an injury that caused him much pain. He lost hope in Allah's mercy and
healing and did not bear the pain in hope for Allah's reward, because he had weak faith and
certainty. Therefore, he took a knife, cut his hand, and bled to death. So, Allah, the Exalted,
said (what means): My servant did not wait for my mercy and healing, and could not endure
the affliction that I tested him with, so he committed the sinful crime of taking his own life
ahead of the time I appointed for him. Therefore, I made Paradise forbidden for him. Anyone
who is forbidden Paradise will end up in Hellfire. There is no doubt that the action of that
man was already known to Allah, the Exalted, as part of His prior knowledge, His will, and
His decree.
