EXECUTIVE ORDER REORGANIZING THE CATBALOGAN CITY INCIDENT


COMMAND CENTER

WHEREAS, our 1987 Constitution mandates that the State shall protect and
promote the right to health of the people and instill health consciousness among
them. It also provides that the right of the people to travel maybe impaired in the
interest of x x x public health x x x.

WHEREAS, the Local Government Code of 1991 (RA 7160) mandates every
local government unit has to exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient and effective governance, and those which are essential to
the promotion of the general welfare;

WHEREAS, in the same law, City Mayors are mandated to carry out such
emergency measures as may be necessary during and in the aftermath of man-
made and natural disasters and calamities;

WHEREAS, Section 3 of Mandatory Reporting of Notifiable Diseases and


Health Events of Public Health Concern Act (RA 11332) expressly empowers the
public health authorities to declare quarantine, isolation, and rapid containment
measures for disease prevention and control;

WHEREAS, Republic Act No. 11469 (RA 11469) declared state of national
emergency over the entire the country and provides the LGUs are acting within the
letter and spirit of all the rules, regulations, and directives issued by the National
Government and that they are implementing standards of community quarantine
with what the National Government has laid down for the subject area, while
allowing LGUs to continue exercising their autonomy in matters undefined by the
National Government or are within the parameters it has set; and are fully
cooperating towards a unified, cohesive and orderly implementation of the national
policy to address COVID-19;

WHEREAS, Executive Order No. 168 s. 2014 created the Inter-Agency Task
Force for the Management of Emerging Infectious Diseases (IATF) to facilitate

intersectoral collaboration to establish preparedness and ensure efficient
government response to assess, monitor, contain, control, and prevent the spread
of any potential epidemic in the Philippines;

WHEREAS, in the said EO, IATF is mandated to prevent and/or minimize the
local spread of emerging infectious diseases in the country through the
establishment or reinforcement of a system in screening possible patients infected
with emerging infectious diseases, contact tracing, identification of the mode of
exposure to the virus, and implementation of effective quarantine and proper
isolation procedures;

WHEREAS, the emerging challenge related to COVID-19 faced by the City is


the management of returning Catbalogan residents, which are either, Locally
Stranded Catbalogan Residents (LSCR), referred to as Locally Stranded Individuals
(LSI) in national guidelines; and Overseas Filipino Workers residing in Catbalogan
(OFWC) or Returning Overseas Filipinos (ROF) as referred in national guidelines;

WHEREAS, the local government units (LGUs) as pronounced by the


National IATF were given authority to establish local health protocols in the
management of their returning residents to protect their respective areas of
jurisdiction and to complement the national government’s Balik and Hatid Probinsya
programs, which prompted this office to issue Executive Order No. 07-004 amending
Section 27 of Executive Order No. 05-005 which revises the guidelines on the
management of Locally Stranded Catbalogan Residents (LSCR), [LSI] and Overseas
Filipino Workers residing in Catbalogan (OFWC), [ROF].

WHEREAS, due to mediocre public health facilities and systems present in


the City to address possible outbreak of COVID-19 due to imported infections, there
is a need to step up precautionary measures in the management of returning
Catbaloganon residents such as mandatory facility quarantine and conduct of rapid
antibody tests (RAT);

WHEREAS, these proposed changes may entails repositioning of human


resources and shifts in the implemented systems and processes within the City’s
workforce, thus necessitating to reorganize the Incident Command Center of
Catbalogan City;

NOW THEREFORE, I, DEXTER M. UY, Mayor of Catbalogan City, by virtue of


the powers vested in me by law, do hereby promulgate this Executive Order
reorganizing the City’s Incident Command Center effective today until revoked or
superseded by subsequent issuances;

SECTION 1. Reorganization of Incident Command Center: To facilitate


prompt and efficient implementation of the guidelines and policies set by the City
IATF as approved by the City Mayor consistent with the existing national issuances,

or help facilitate in addressing pressing issues and concerns with regards to
combating COVID-19, the Incident Command Center is hereby reorganized and shall
be known as Catbalogan Incident Command-Emergency Operation Center:

SECTION 29. Repealing Clause. All executive orders, local rules and regulations
or parts thereof which are not consistent with this Executive Order particularly
Sections 3 of EO 05-005 are hereby repealed, amended or modified accordingly.

SECTION 30. Separability Clause. If, for any reason, any part or provision of
this order is declared invalid or unconstitutional, any part or provision not affected
thereby shall remain in full force and effect.

SECTION 31. Effectivity. This order shall take effect on July 23, 2020 at exactly
12:01 AM until revoked or superseded by subsequent issuances.
