15 Re: 20220428-Mr G. H. Schorel-Hlavka O.W.B. to R Kershaw Chief Commissioner of the Australian Federal Police
16 -Suppl- 64-war crimes, etc
17 COMPLAINT
18 Sir,
19 further to my original COMPLAINT of 6 August 2021 I provide a further supplement hereby.
20
21 Politicians have been in their Putin/Russia derangement syndrome claimed war crimes, etc,
22 against President Vladimir Putin and the Russian federation forces. As I did set out in my
23 “20220427-Mr G. H. Schorel-Hlavka O.W.B. to Mr Scott Morrison PM-Endangering Australias national
24 security” before the court on 19 July 2006 (successfully representing myself in both appeals)
25
26 Mr. John Howard unconstitutionally authorised the murderous invasions into Afghanistan and Iraq. How on
27 earth could anyone expect me to vote by preference voting for what I consider a mass murderer and one
28 who committed treachery, treason, sedition and committed crimes against humanity, and by this voting
29 for anyone who supported the war, such as members of his political party.
30
31 As the Court noted in its orders that the Commonwealth did not file any evidence then this
32 implies that the Commonwealth did not object or otherwise challenge this and by this
33 acknowledged that indeed the invasion into Iraq was unconstitutional (as the Governor-General
34 never published in the Gazette a DECLARATION OF WAR naming Iraq (or Afghanistan)
35 which is constitutionally required before Australian troops can be deployed into a foreign
36 country, unless the Commonwealth of Australia is itself under attack, as then such an attack by
37 enemy forces is deemed to be a DECLARATION OF WAR.
38
39 It should be noted that the email received at 5.04am on 27 April 2022 was hours after I already
40 had emails my 02.40 email “20220427-Mr G. H. Schorel-Hlavka O.W.B. to Mr Scott Morrison PM-
41 Endangering Australias national security” and as such my writings were not due to this 05.04 email
42 rather that this email seems to indicate to enforce what I wrote about politicians.
43
44 Obviously politicians are entitled to act as they deem appropriate in the circumstances, however
45 provided they are acting within the Rule of Law and not despite of it. Politicians generally will
46 not disclose any advice they were given by intelligence services unless it may be assisting them
47 as an excuse that they relied upon intelligence services, when they turn out to have been wrong.
1 However, unconstitutionally invading another sovereign county, committing war crimes, mass
2 murder, crimes against humanity never can be excused no matter what any intelligences services
3 (if they did at all) recommend.
4
5 In my view the Australian Federal Police has FAILED to investigate these issues regarding Iraq
6 despite my inclusion of those issues within my COMPLAINT. As such once I filed a
7 COMPLAINT then the Australian Federal Police is bound to acknowledge my complaint and to
8 investigate such serious matter. Failing to do so in my view makes the Australian Federal Police
9 an accessory to the crimes committed.
10
11 As I received this as an email I hold I am entitled to quote it in full to be considered as part of my
12 COMPLAINT!
13
14 Obviously where the Federal Government such as I understand Marise Payne seeks to have Big
15 Tech preventing Australians to publish about the Ukraine issue where it goes against the mantra
16 of the Federal Government, then this I view is a treasonous conduct as the legal principles
17 embedded in the constitution (and for this also see the Albert Langer High Court of Australia’s
18 decision) includes FREEDOM OF SPEECH, POLITICAL LIBERTY, etc.
19
20 Here we have the Federal Government unconstitutionally aiding and abetting in genocide
21 conducted by the Ukraine government against its own citizens (in Donbas, etc) and this I view
22 should be investigated extensively. Indeed, I view that those politicians (regardless of political
23 party association) who endorsed this kind of conduct all should be
24 Deemed to be in violation of s44 of the Commonwealth of Australia Constitution Act 1900
25 (UK). The politicians have now caused the Commonwealth of Australia to be involved in a war
26 without authorisation by the Governor-General as to my understanding no DECLARATION OF
27 WAR was published by the Gazette naming the Russian Federation. Neither can the government
28 override constitutional limitations, etc, as to apply sanctions against the Russian Federation
29 and/or others in violation to constitutional legal principles and/or laws of Australia.
30 Australia’s involvement in an unconstitutional invasion into Iraq, mass murder, war crimes,
31 crimes against humanity, etc, must be investigated as politicians now have placed themselves
32 above “the Rule of Law” and soon or later the Commonwealth of Australia and so its citizens
33 may discover to be harmed as result.
34
35 The email does give some insight into the Ukraine issue but doesn’t even touch the bioweapon
36 attacks upon the Russian federation and others, which I understand also involved Australia’s
37 Peter Doherty Institute to some extent.

1
2 It is essential to recall here that Minsk 1 (September 2014) and Minsk 2 (February 2015)
3 Agreements did not provide for the separation or independence of the Republics, but their
4 autonomy within the framework of Ukraine. Those who have read the Agreements (there
5 are very few who actually have) will note that it is written that the status of the Republics
6 was to be negotiated between Kiev and the representatives of the Republics, for an internal
7 solution within Ukraine.
8
9 That is why since 2014, Russia has systematically demanded the implementation of the
10 Minsk Agreements while refusing to be a party to the negotiations, because it was an
11 internal matter of Ukraine. On the other side, the West—led by France—systematically
12 tried to replace Minsk Agreements with the “Normandy format,” which put Russians and
13 Ukrainians face-to-face. However, let us remember that there were never any Russian
14 troops in the Donbass before 23-24 February 2022.
15
16 Moreover, OSCE observers have never observed the slightest trace of Russian units
17 operating in the Donbass before then. For example, the U.S. intelligence map published by
18 the Washington Post on December 3, 2021 does not show Russian troops in the Donbass.
19
20 In October 2015, Vasyl Hrytsak, director of the Ukrainian Security Service
21 (SBU), confessed that only 56 Russian fighters had been observed in the Donbass. This
22 was exactly comparable to the Swiss who went to fight in Bosnia on weekends, in the
23 1990s, or the French who go to fight in Ukraine today.
24
25 The Ukrainian army was then in a deplorable state. In October 2018, after four years of
26 war, the chief Ukrainian military prosecutor, Anatoly Matios, stated that Ukraine had lost
27 2,700 men in the Donbass: 891 from illnesses, 318 from road accidents, 177 from other
28 accidents, 175 from poisonings (alcohol, drugs), 172 from careless handling of weapons,
29 101 from breaches of security regulations, 228 from murders and 615 from suicides.
30
31 In fact, the Ukrainian army was undermined by the corruption of its cadres and no longer
32 enjoyed the support of the population. According to a British Home Office report, in the
33 March/April 2014 recall of reservists, 70 percent did not show up for the first session, 80
34 percent for the second, 90 percent for the third, and 95 percent for the fourth. In
35 October/November 2017, 70% of conscripts did not show up for the “Fall 2017” recall
36 campaign. This is not counting suicides and desertions (often over to the autonomists),
37 which reached up to 30 percent of the workforce in the ATO area. Young Ukrainians
38 refused to go and fight in the Donbass and preferred emigration, which also explains, at
39 least partially, the demographic deficit of the country.
40
41 The Ukrainian Ministry of Defense then turned to NATO to help make its armed forces
42 more “attractive.” Having already worked on similar projects within the framework of the
43 United Nations, I was asked by NATO to participate in a program to restore the image of
44 the Ukrainian armed forces. But this is a long-term process and the Ukrainians wanted to
45 move quickly.
46
47 So, to compensate for the lack of soldiers, the Ukrainian government resorted to
48 paramilitary militias…. In 2020, they constituted about 40 percent of the Ukrainian forces
49 and numbered about 102,000 men, according to Reuters. They were armed, financed and
50 trained by the United States, Great Britain, Canada and France. There were more than 19
51 nationalities.

1
2 These militias had been operating in the Donbass since 2014, with Western support. Even
3 if one can argue about the term “Nazi,” the fact remains that these militias are violent,
4 convey a nauseating ideology and are virulently anti-Semitic…[and] are composed of
5 fanatical and brutal individuals. The best known of these is the Azov Regiment, whose
6 emblem is reminiscent of the 2nd SS Das Reich Panzer Division, which is revered in the
7 Ukraine for liberating Kharkov from the Soviets in 1943, before carrying out the 1944
8 Oradour-sur-Glane massacre in France. [….]
9
10 The characterization of the Ukrainian paramilitaries as “Nazis” or “neo-Nazis”
11 is considered Russian propaganda. But that’s not the view of the Times of Israel, or
12 the West Point Academy’s Center for Counterterrorism. In
13 2014, Newsweek magazine seemed to associate them more with… the Islamic State. Take
14 your pick!
15 So, the West supported and continued to arm militias that have been guilty of
16 numerous crimes against civilian populations since 2014: rape, torture and
17 massacres….
18 The integration of these paramilitary forces into the Ukrainian National Guard was not at
19 all accompanied by a “denazification,” as some claim.
20
21 Among the many examples, that of the Azov Regiment’s insignia is instructive:
22
23 In 2022, very schematically, the Ukrainian armed forces fighting the Russian offensive
24 were organized as:
25
26 The Army, subordinated to the Ministry of Defense. It is organized into 3 army
27 corps and composed of maneuver formations (tanks, heavy artillery, missiles, etc.).
28 The National Guard, which depends on the Ministry of the Interior and is
29 organized into 5 territorial commands.
30
31 The National Guard is therefore a territorial defense force that is not part of the Ukrainian
32 army. It includes paramilitary militias, called “volunteer battalions” (добровольчі
33 батальйоні), also known by the evocative name of “reprisal battalions,” and composed of
34 infantry. Primarily trained for urban combat, they now defend cities such as Kharkov,
35 Mariupol, Odessa, Kiev, etc.
36
37 Part Two: The War
38
39 As a former head of analysis of Warsaw Pact forces in the Swiss strategic intelligence
40 service, I observe with sadness—but not astonishment—that our services are no longer
41 able to understand the military situation in Ukraine. The self-proclaimed “experts” who
1 parade on our TV screens tirelessly relay the same information modulated by the claim that
2 Russia—and Vladimir Putin—is irrational.
3 Let’s take a step back.
4
5 The Outbreak Of War
6
7 Since November 2021, the Americans have been constantly threatening a Russian invasion
8 of Ukraine. However, the Ukrainians at first did not seem to agree. Why not?
9
10 We have to go back to March 24, 2021. On that day, Volodymyr Zelensky issued a
11 decree for the recapture of the Crimea, and began to deploy his forces to the south of the
12 country. At the same time, several NATO exercises were conducted between the Black Sea
13 and the Baltic Sea, accompanied by a significant increase in reconnaissance flights along
14 the Russian border. Russia then conducted several exercises to test the operational
15 readiness of its troops and to show that it was following the evolution of the situation.
16
17 Things calmed down until October-November with the end of the ZAPAD 21 exercises,
18 whose troop movements were interpreted as a reinforcement for an offensive against
19 Ukraine. However, even the Ukrainian authorities refuted the idea of Russian preparations
20 for a war, and Oleksiy Reznikov, Ukrainian Minister of Defense, states that there had been
21 no change on its border since the spring.
22
23 In violation of the Minsk Agreements, Ukraine was conducting air operations in Donbass
24 using drones, including at least one strike against a fuel depot in Donetsk in October 2021.
25 The American press noted this, but not the Europeans; and no one condemned these
26 violations.
27
28 In February 2022, events came to a head. On February 7, during his visit to Moscow,
29 Emmanuel Macron reaffirmed to Vladimir Putin his commitment to the Minsk
30 Agreements, a commitment he would repeat after his meeting with Volodymyr Zelensky
31 the next day. But on February 11, in Berlin, after nine hours of work, the meeting of
32 political advisors to the leaders of the “Normandy format” ended without any concrete
33 result: the Ukrainians still refused to apply the Minsk Agreements, apparently under
34 pressure from the United States. Vladimir Putin noted that Macron had made empty
35 promises and that the West was not ready to enforce the agreements, the same opposition
36 to a settlement it had exhibited for eight years.
37
38 Ukrainian preparations in the contact zone continued. The Russian Parliament became
39 alarmed; and on February 15 it asked Vladimir Putin to recognize the independence of the
40 Republics, which he initially refused to do.
41
42 On 17 February, President Joe Biden announced that Russia would attack Ukraine in the
43 next few days. How did he know this? It is a mystery. But since the 16th, the artillery
44 shelling of the population of Donbass had increased dramatically, as the daily reports of
45 the OSCE observers show. Naturally, neither the media, nor the European Union, nor
46 NATO, nor any Western government reacted or intervened. It would be said later that this
47 was Russian disinformation. In fact, it seems that the European Union and some countries
48 have deliberately kept silent about the massacre of the Donbass population, knowing that
49 this would provoke a Russian intervention.
50
1 At the same time, there were reports of sabotage in the Donbass. On 18 January, Donbass
2 fighters intercepted saboteurs, who spoke Polish and were equipped with Western
3 equipment and who were seeking to create chemical incidents in Gorlivka. They could
4 have been CIA mercenaries, led or “advised” by Americans and composed of Ukrainian or
5 European fighters, to carry out sabotage actions in the Donbass Republics.
6
7 In fact, as early as February 16, Joe Biden knew that the Ukrainians had begun intense
8 shelling the civilian population of Donbass, forcing Vladimir Putin to make a difficult
9 choice: to help Donbass militarily and create an international problem, or to stand by and
10 watch the Russian-speaking people of Donbass being crushed.
11
12 If he decided to intervene, Putin could invoke the international obligation of
13 “Responsibility To Protect” (R2P). But he knew that whatever its nature or scale, the
14 intervention would trigger a storm of sanctions. Therefore, whether Russian intervention
15 were limited to the Donbass or went further to put pressure on the West over the status of
16 the Ukraine, the price to pay would be the same. This is what he explained in his speech on
17 February 21. On that day, he agreed to the request of the Duma and recognized the
18 independence of the two Donbass Republics and, at the same time, he signed friendship
19 and assistance treaties with them.
20
21 The Ukrainian artillery bombardment of the Donbass population continued, and, on 23
22 February, the two Republics asked for military assistance from Russia. On 24 February,
23 Vladimir Putin invoked Article 51 of the United Nations Charter, which provides for
24 mutual military assistance in the framework of a defensive alliance.
25
26 In order to make the Russian intervention seem totally illegal in the eyes of the public,
27 Western powers deliberately hid the fact that the war actually started on February 16. The
28 Ukrainian army was preparing to attack the Donbass as early as 2021, as some Russian and
29 European intelligence services were well aware.
30
31 In his speech of February 24, Vladimir Putin stated the two objectives of his operation:
32 “demilitarize” and “denazify” the Ukraine. So, it was not a question of taking over
33 Ukraine, nor even, presumably, of occupying it; and certainly not of destroying it.
34 From then on, our knowledge of the course of the operation is limited: the Russians have
35 excellent security for their operations (OPSEC) and the details of their planning are not
36 known. But fairly quickly, the course of the operation allows us to understand how the
37 strategic objectives were translated on the operational level.
38
39 Demilitarization:
40
41 ground destruction of Ukrainian aviation, air defense systems and reconnaissance
42 assets;
43 neutralization of command and intelligence structures (C3I), as well as the main
44 logistical routes in the depth of the territory;
45 encirclement of the bulk of the Ukrainian army massed in the southeast of the
46 country.
47
48 Denazification:
49
50 destruction or neutralization of volunteer battalions operating in the cities of
51 Odessa, Kharkov, and Mariupol, as well as in various facilities in the territory.

2 Demilitarization
3
4 The Russian offensive was carried out in a very “classic” manner. Initially—as the Israelis
5 had done in 1967—with the destruction on the ground of the air force in the very first
6 hours. Then, we witnessed a simultaneous progression along several axes according to the
7 principle of “flowing water”: advance everywhere where resistance was weak and leave
8 the cities (very demanding in terms of troops) for later. In the north, the Chernobyl power
9 plant was occupied immediately to prevent acts of sabotage. The images of Ukrainian and
10 Russian soldiers guarding the plant together are of course not shown.
11
12 The idea that Russia is trying to take over Kiev, the capital, to eliminate Zelensky, comes
13 typically from the West…. But Vladimir Putin never intended to shoot or topple Zelensky.
14 Instead, Russia seeks to keep him in power by pushing him to negotiate, by surrounding
15 Kiev. The Russians want to obtain the neutrality of Ukraine.
16
17 Many Western commentators were surprised that the Russians continued to seek a
18 negotiated solution while conducting military operations. The explanation lies in the
19 Russian strategic outlook since the Soviet era. For the West, war begins when politics
20 ends. However, the Russian approach follows a Clausewitzian inspiration:
21 war is the continuity of politics and one can move fluidly from one to the other, even
22 during combat. This allows one to create pressure on the adversary and push him to
23 negotiate.
24
25 From an operational point of view, the Russian offensive was an example of previous
26 military action and planning: in six days, the Russians seized a territory as large as the
27 United Kingdom, with a speed of advance greater than what the Wehrmacht had achieved
28 in 1940.
29
30 The bulk of the Ukrainian army was deployed in the south of the country in preparation for
31 a major operation against the Donbass. This is why Russian forces were able to encircle it
32 from the beginning of March in the “cauldron” between Slavyansk, Kramatorsk and
33 Severodonetsk, with a thrust from the East through Kharkov and another from the South
34 from Crimea. Troops from the Donetsk (DPR) and Lugansk (LPR) Republics are
35 complementing the Russian forces with a push from the East.
36 At this stage, Russian forces are slowly tightening the noose, but are no longer under any
37 time pressure or schedule. Their demilitarization goal is all but achieved and the remaining
38 Ukrainian forces no longer have an operational and strategic command structure.
39
40 The “slowdown” that our “experts” attribute to poor logistics is only the consequence of
41 having achieved their objectives. Russia does not want to engage in an occupation of the
42 entire Ukrainian territory. In fact, it appears that Russia is trying to limit its advance to the
43 linguistic border of the country.
44
45 Our media speak of indiscriminate bombardments against the civilian population,
46 especially in Kharkov, and horrific images are widely broadcast. However, Gonzalo Lira, a
47 Latin American correspondent who lives there, presents us with a calm city on March
48 10 and March 11. It is true that it is a large city and we do not see everything—but this
49 seems to indicate that we are not in the total war that we are served continuously on our
50 TV screens. As for the Donbass Republics, they have “liberated” their own territories and
51 are fighting in the city of Mariupol.

2 Denazification
3
4 In cities like Kharkov, Mariupol and Odessa, the Ukrainian defense is provided by the
5 paramilitary militias. They know that the objective of “denazification” is aimed primarily
6 at them. For an attacker in an urbanized area, civilians are a problem. This is why Russia is
7 seeking to create humanitarian corridors to empty cities of civilians and leave only the
8 militias, to fight them more easily.
9 Conversely, these militias seek to keep civilians in the cities from evacuating in order to
10 dissuade the Russian army from fighting there. This is why they are reluctant to implement
11 these corridors and do everything to ensure that Russian efforts are unsuccessful—they use
12 the civilian population as “human shields.” Videos showing civilians trying to leave
13 Mariupol and beaten up by fighters of the Azov regiment are of course carefully censored
14 by the Western media.
15
16 On Facebook, the Azov group was considered in the same category as the Islamic State
17 [ISIS] and subject to the platform’s “policy on dangerous individuals and organizations.” It
18 was therefore forbidden to glorify its activities, and “posts” that were favorable to it were
19 systematically banned. But on February 24, Facebook changed its policy and allowed posts
20 favorable to the militia. In the same spirit, in March, the platform authorized, in the former
21 Eastern countries, calls for the murder of Russian soldiers and leaders. So much for the
22 values that inspire our leaders.
23
24 Our media propagate a romantic image of popular resistance by the Ukrainian people. It is
25 this image that led the European Union to finance the distribution of arms to the civilian
26 population. In my capacity as head of peacekeeping at the UN, I worked on the issue of
27 civilian protection. We found that violence against civilians occurred in very specific
28 contexts. In particular, when weapons are abundant and there are no command structures.
29
30 These command structures are the essence of armies: their function is to channel the use of
31 force towards an objective. By arming citizens in a haphazard manner, as is currently the
32 case, the EU is turning them into combatants, with the consequential effect of making them
33 potential targets. Moreover, without command, without operational goals, the distribution
34 of arms leads inevitably to settling of scores, banditry and actions that are more deadly
35 than effective. War becomes a matter of emotions. Force becomes violence. This is what
36 happened in Tawarga (Libya) from 11 to 13 August 2011, where 30,000 black Africans
37 were massacred with weapons parachuted (illegally) by France. By the way, the British
38 Royal Institute for Strategic Studies (RUSI) does not see any added value in these arms
39 deliveries.
40 Moreover, by delivering arms to a country at war, one exposes oneself to being considered
41 a belligerent. The Russian strikes of March 13, 2022, against the Mykolayev air base
42 follow Russian warnings that arms shipments would be treated as hostile targets.
43
44 The EU is repeating the disastrous experience of the Third Reich in the final hours of the
45 Battle of Berlin. War must be left to the military and when one side has lost, it must be
46 admitted. And if there is to be resistance, it must be led and structured. But we are doing
47 exactly the opposite—we are pushing citizens to go and fight, and at the same time,
48 Facebook authorizes calls for the murder of Russian soldiers and leaders. So much for the
49 values that inspire us.
50
1 Some intelligence services see this irresponsible decision as a way to use the Ukrainian
2 population as cannon fodder to fight Vladimir Putin’s Russia…. It would have been better
3 to engage in negotiations and thus obtain guarantees for the civilian population than to add
4 fuel to the fire. It is easy to be combative with the blood of others.
5
6 The Maternity Hospital At Mariupol
7
8 It is important to understand beforehand that it is not the Ukrainian army that is defending
9 Mariupol, but the Azov militia, composed of foreign mercenaries.
10
11 In its March 7, 2022 summary of the situation, the Russian UN mission in New York stated
12 that “Residents report that Ukrainian armed forces expelled staff from the Mariupol city
13 birth hospital No. 1 and set up a firing post inside the facility.” On March 8,
14 the independent Russian media Lenta.ru, published the testimony of civilians from
15 Mariupol who told that the maternity hospital was taken over by the militia of the Azov
16 regiment, and who drove out the civilian occupants by threatening them with their
17 weapons. They confirmed the statements of the Russian ambassador a few hours earlier.
18 The hospital in Mariupol occupies a dominant position, perfectly suited for the installation
19 of anti-tank weapons and for observation. On 9 March, Russian forces struck the
20 building. According to CNN, 17 people were wounded, but the images do not show any
21 casualties in the building and there is no evidence that the victims mentioned are related to
22 this strike. There is talk of children, but in reality, there is nothing. This does not prevent
23 the leaders of the EU from seeing this as a war crime. And this allows Zelensky to call for
24 a no-fly zone over Ukraine.
25
26 In reality, we do not know exactly what happened. But the sequence of events tends to
27 confirm that Russian forces struck a position of the Azov regiment and that the maternity
28 ward was then free of civilians.
29
30 The problem is that the paramilitary militias that defend the cities are encouraged by the
31 international community not to respect the rules of war. It seems that the Ukrainians have
32 replayed the scenario of the Kuwait City maternity hospital in 1990, which was totally
33 staged by the firm Hill & Knowlton for $10.7 million in order to convince the United
34 Nations Security Council to intervene in Iraq for Operation Desert Shield/Storm.
35
36 Western politicians have accepted civilian strikes in the Donbass for eight years without
37 adopting any sanctions against the Ukrainian government. We have long since entered a
38 dynamic where Western politicians have agreed to sacrifice international law towards
39 their goal of weakening Russia.
40
41 Part Three: Conclusions
42
43 As an ex-intelligence professional, the first thing that strikes me is the total absence of
44 Western intelligence services in accurately representing the situation over the past
45 year…. In fact, it seems that throughout the Western world intelligence services have
46 been overwhelmed by the politicians. The problem is that it is the politicians who
47 decide—the best intelligence service in the world is useless if the decision-maker does
48 not listen. This is what has happened during this crisis.
49
50 That said, while a few intelligence services had a very accurate and rational picture of
51 the situation, others clearly had the same picture as that propagated by our media…

1 The problem is that, from experience, I have found them to be extremely bad at the
2 analytical level—doctrinaire, they lack the intellectual and political independence
3 necessary to assess a situation with military “quality.”
4
5 Second, it seems that in some European countries, politicians have deliberately responded
6 ideologically to the situation. That is why this crisis has been irrational from the beginning.
7 It should be noted that all the documents that were presented to the public during this crisis
8 were presented by politicians based on commercial sources.
9 Some Western politicians obviously wanted there to be a conflict. In the United States, the
10 attack scenarios presented by Anthony Blinken to the UN Security Council were only the
11 product of the imagination of a Tiger Team working for him—he did exactly as Donald
12 Rumsfeld did in 2002, who “bypassed” the CIA and other intelligence services that were
13 much less assertive about Iraqi chemical weapons.
14
15 The dramatic developments we are witnessing today have causes that we knew about but
16 refused to see:
17
18 on the strategic level, the expansion of NATO (which we have not dealt with
19 here);
20 on the political level, the Western refusal to implement the Minsk Agreements;
21 and operationally, the continuous and repeated attacks on the civilian population
22 of the Donbass over the past years and the dramatic increase in late February 2022.
23
24 In other words, we can naturally deplore and condemn the Russian attack. But WE (that is:
25 the United States, France and the European Union in the lead) have created the conditions
26 for a conflict to break out. We show compassion for the Ukrainian people and the two
27 million refugees. That is fine. But if we had had a modicum of compassion for the
28 same number of refugees from the Ukrainian populations of Donbass massacred by
29 their own government and who sought refuge in Russia for eight years, none of this
30 would probably have happened.
31
32 [….]
33 Whether the term “genocide” applies to the abuses suffered by the people of Donbass
34 is an open question. The term is generally reserved for cases of greater magnitude
35 (Holocaust, etc.). But the definition given by the Genocide Convention is probably
36 broad enough to apply to this case.
37
38 Clearly, this conflict has led us into hysteria. Sanctions seem to have become the
39 preferred tool of our foreign policies. If we had insisted that Ukraine abide by the
40 Minsk Agreements, which we had negotiated and endorsed, none of this would have
41 happened. Vladimir Putin’s condemnation is also ours. There is no point in whining
42 afterwards—we should have acted earlier. However, neither Emmanuel Macron (as
43 guarantor and member of the UN Security Council), nor Olaf Scholz, nor Volodymyr
44 Zelensky have respected their commitments. In the end, the real defeat is that of those who
45 have no voice.
46
47 The European Union was unable to promote the implementation of the Minsk
48 agreements—on the contrary, it did not react when Ukraine was bombing its own
49 population in the Donbass. Had it done so, Vladimir Putin would not have needed to
50 react. Absent from the diplomatic phase, the EU distinguished itself by fueling the
51 conflict. On February 27, the Ukrainian government agreed to enter into negotiations with

1 Russia. But a few hours later, the European Union voted a budget of 450 million euros to
2 supply arms to the Ukraine, adding fuel to the fire. From then on, the Ukrainians felt that
3 they did not need to reach an agreement. The resistance of the Azov militia in Mariupol
4 even led to a boost of 500 million euros for weapons.
5
6 In Ukraine, with the blessing of the Western countries, those who are in favor of a
7 negotiation have been eliminated. This is the case of Denis Kireyev, one of the Ukrainian
8 negotiators, assassinated on March 5 by the Ukrainian secret service (SBU) because he was
9 too favorable to Russia and was considered a traitor. The same fate befell Dmitry
10 Demyanenko, former deputy head of the SBU’s main directorate for Kiev and its region,
11 who was assassinated on March 10 because he was too favorable to an agreement with
12 Russia—he was shot by the Mirotvorets (“Peacemaker”) militia. This militia is associated
13 with the Mirotvorets website, which lists the “enemies of Ukraine,” with their personal
14 data, addresses and telephone numbers, so that they can be harassed or even eliminated; a
15 practice that is punishable in many countries, but not in the Ukraine. The UN and some
16 European countries have demanded the closure of this site—but that demand was refused
17 by the Rada [Ukrainian parliament].
18
19 In the end, the price will be high, but Vladimir Putin will likely achieve the goals he set for
20 himself. We have pushed him into the arms of China. His ties with Beijing have solidified.
21 China is emerging as a mediator in the conflict…. The Americans have to ask Venezuela
22 and Iran for oil to get out of the energy impasse they have put themselves in—and the
23 United States has to piteously backtrack on the sanctions imposed on its enemies.
24
25 Western ministers who seek to collapse the Russian economy and make the Russian people
26 suffer, or even call for the assassination of Putin, show (even if they have partially reversed
27 the form of their words, but not the substance!) that our leaders are no better than those we
28 hate—sanctioning Russian athletes in the Para-Olympic Games or Russian artists has
29 nothing to do with fighting Putin. [….]
30 What makes the conflict in Ukraine more blameworthy than our wars in Iraq, Afghanistan
31 or Libya? What sanctions have we adopted against those who deliberately lied to the
32 international community in order to wage unjust, unjustified and murderous wars?….Have
33 we adopted a single sanction against the countries, companies or politicians who are
34 supplying weapons to the conflict in Yemen, considered to be the “worst humanitarian
35 disaster in the world?”
36
37 To ask the question is to answer it… and the answer is not pretty.

3 In my view the soil of the empty graves seems to be heaped onto the already used graves hence
4 the pill of soil rather than a near flat surface after burial. The digging appears to me to have been
5 done using some backhoe with being about 1 metre (width) or less bucket. No large mass graves
6 sizes as the workers also make clear. This means that as with Bucha and other “propaganda”
7 governments have gone about to claim genocide, mass murder, etc, against the Russian

24 Satellite imagery has revealed what Ukrainian officials say appears to be another mass
25 grave in Ukraine.
26 The site was spotted outside the port city of Mariupol, in the eastern part of the country,
27 which has seen some of the worst fighting since Russia invaded.
28 The grave is located just 12 miles west of Mariupol, along the northwestern edge of
29 Manhush. And it may be 20 times larger than the mass grave in Bucha, according to a
30 Telegram post by the Mariupol City Council, and could hold up to 9,000 bodies.
31 "The occupiers dug new trenches and filled them with corpses every day throughout
32 April," the post said. "Our sources report that in such graves the bodies are placed in
33 several layers."
34 Maxar Technologies, a provider of satellite imagery, said in a statement that the size of the
35 mass grave has gradually expanded over the past month as Russian forces continue to
36 transport Ukrainian bodies out of Mariupol. It's larger than three football fields, spanning
37 approximately 340 meters — over 1,000 feet — in length.

2 A former senior colonel in China’s People’s Liberation Army has laughed off suggestions
3 that Beijing takes Australia’s concerns about its new pact with the Solomon Islands
4 seriously.
5 China and the Solomon Islands recently signed a security pact, and Australia and the US
6 now fear Beijing will use the deal as an opportunity to expand its military presence in the
7 Pacific.
8 Prime Minister Scott Morrison said any attempt by China to build a naval base on the
9 Solomons would cross a “red line”.
10 “We won’t be having Chinese military naval bases in our region on our doorstep,” Mr
11 Morrison said on Sunday, without elaborating on how he would respond if China built one.
12 But Chinese military expert Zhou Bo said it was “ridiculous” to think that President Xi
13 Jinping would think twice about a warning from Canberra.
14 “I don’t believe the Australian government is in any capacity to lay such things like a red
15 line for China. It is ridiculous. It is laughable for me,” he told the ABC’s China Tonight.
16 “When you talk about a ‘red line’, that is extremely ridiculous. Could you lay a red line in
17 a sovereign state like Solomon Islands? It’s not in any part of Australia.
18 “I don’t believe the Australian government is in any capacity to lay any red line for
19 China’s cooperation with Solomon Islands.
20 “Besides, we two are sovereign states, and we certainly are fully entitled to have whatever
21 cooperation we want. So, this has nothing to do with Australia.”
22 Mr Zhou also claimed Australia only had itself to blame for the Solomon Islands choosing
23 to align itself closer to China, whereas in recent years it had leaned on Canberra for
24 support.
25 “I believe you are not doing good enough,” the international security expert said.
26 “Otherwise, why would the Solomon Islands government ask the Chinese to help, since
27 you are much closer? So, why don’t you search your own self to find out why the situation
28 has actually happened?”
29 END QUOTE
30
31 Here we have that the Russian federation is concerned about Ukraine involvement with weapons
32 on its doorstep and rightly so and somehow the incompetent federal government is claiming
33 some “red line” where possibly a Chinese base would be created in Solomon’s Island, a massive
34 2,000 kilometres away, while having no qualms about USA & NATO being right at the Russian
35 federation doorstep and using bio-laboratories to create pathogens to harm Russian citizens

11 It is important to understand that when all kind of claims are made in a war environment
12 one needs to be careful as to what is “PROPAGANDA”, and I will later address this
13 further. However, in my view the Bucha killings appears to have been by the Ukraine army
14 and its NAZI groups. The same with the “Kramatorsk train station attack” by the Ukraine
15 army. Obviously one has to ask why on earth do we spend hundreds of millions on ASIO
16 and other intelligence services if in the end they merely parrot whatever the Ukraine NAZI
17 government and the USA and NATO are claiming rather than investigating facts.
18 With MH17 it was claimed that a Buk was used to destroy MH17. Well, why are there no
19 records used by any investigative team as to the so called “passport” of each Buk missile?
20 After all, the paperwork that goes with each missile (so called “passport”) should show
21 which Buk was used and who possessed it. What we now seem to have is a warmongering
22 Coalition who couldn’t care less about the FACTS but merely uses Australians taxes as to
23 provide further weapons and monies to the Ukraine NAZI Government to continue its
24 ongoing genocide since 2014 against Ukrainians.
25 My challenge to Scott Morrison PM and Marise Payne is prove to the Australian electors
26 that Bucha killings beyond any shred of doubt was committed by the Russian army. Prove
27 that the “Kramatorsk train station attack” was done by the Russian army, where the missile
28 appears to be of the Ukraine army?
29 Obviously the same goes to the ALP Anthony Albanese that if he cannot prove either of
30 them then he too is in my view a miserable failure and should neither remain in the
31 parliament.
32 We do not need politicians claiming to be “shadow” Ministers when not doing any job but
33 simply claiming pay for a job they cannot manage to do. In my view Anthony Albanese
34 should have demanded from the federal government that it proved the Ukraine NAZI
35 government to be beyond question to be done by the Russian army and not merely go
36 along to assume it was so when in fact as I understand it the Ukraine NAZI army was
37 doing the mass killings.
38 Remember “for the children” as the Ukraine NAZI army specifically is targeting the killing
39 of children as I have written about previously.
40
41 The Australian government in my view should never financially or otherwise support any
42 Ukraine NAZI government.
43
44 And for those who may question the legitimacy of the Russian federation entering Ukraine
45 then why not read the following article (there are many more on this subject):

3 Daniel Kovalik: Why Russia's intervention in Ukraine is legal under international law
4
5 This is an excellent article. We must neither ignore that the USA, NATO, Ukraine and
6 Georgia were pursuing the Caucasian Russian DNA for pathogen research to harm (kill)
7 Russians for many years. Which itself was a direct attack upon Russian sovereignty when
8 drones were send in Russia with mosquitoes to harm Russian citizens.
9
10 Unlike the unconstitutional and unlawfuli9nvasion by Australia into Iraq committing mass
11 murder, crimes against humanity, war crimes, etc, the Russian federation in my view had
12 genuine and legitimate rights to enter Ukraine.
13 Remember when so called terrorist were in Indonesia the then Government (with John
14 Howard) made clear it had the right to eliminate the treat by going into Indonesia. Well
15 with Russian Federation it was not merely a treat but actual killings were eventuating!
16 If Scott Morrison PM, Marise Payne and others do not grasp what the situation involving
17 Ukraine is about and yet are sending more than $100 million to Ukraine and also
18 Bushmasters, even so already the USA makes clear they do not know if any of the
19 weapons supplied will end up on the black market, then soon or later they too might end up
20 as a boomerang onto Australian shores.
21 Australia in my view has sided with the enemy Ukraine in a proxy war between the
22 USA/NATO vs the Russian Federation and my view is that PINE GAP and even Canberra
23 could be a target of retribution to provide support to Ukraine NAZI government.
24 As I indicated the giveaway by Scott Morrison PM to the Ukraine NAZI Government
25 without parliament approval by way of Appropriation bills I view is fraud committed
26 against all Australian taxpayers and Opposition leader Anthony Albanese appears to me to
27 be grossly incompetent as to have opposed this elaborate fraud.
28 Didn’t they go after pensioners who without their fault were overpaid or allegedly overpaid
29 to even pursue debt collectors and court litigation? Well, let us hold politicians equally
30 legally accountable.
31 For what it is worth, if you do vote (as I exercise my constitutional right NOT to vote for
32 those I consider criminals, etc and supporting any NAZI government and genocide) then
33 perhaps select those who opposed the fraud of Consolidated Revenue Funds/incompetence
34 to give your vote.
35 See attachment
1 I recall many years ago that you wrote to me about Human Rights, etc. well that was
2 before you became a Minister.
3 Now if you were using those words than your mouth should disintegrate for daring to misuse
4 and abuse this term.
5
6 Let me explain some of it.
7
8 As you appears to have a record:
9
10 The Minister holds a Bachelor of Laws and a Bachelor of Arts from the
11 University of NSW.
12
13 A Senator for NSW since 1997, she has more than two decades’ parliamentary
14 experience including 12 years’ membership of the Joint Standing Committee
15 on Foreign Affairs, Defence and Trade.
16
17 It seems to me you ought to understand legal issues. And as a Minister you ought to
18 understand to be a “constitutional adviser” to the Governor-General1
19
20 HANSARD 4-3-1891 Constitution Convention Debates
21 QUOTE Sir HENRY PARKES:
22 The resolutions conclude:
23 An executive, consisting of a governor-general, and such persons as may from time to time be
24 appointed as his advisers, such persons sitting in Parliament, and whose term of office shall depend
25 upon their possessing the confidence of the house of representatives expressed by the support of the
26 majority.
27 What is meant by that is simply to call into existence a ministry to conduct the affairs of the new nation as
28 similar as it can be to the ministry of England-a body of constitutional advisers who shall stand as nearly as
29 possible in the same relation to the representative of the Crown here [start page 27] a her Majesty's imperial
30 advisers stand is relation to the Crown directly. These, then, are the principles which my resolutions seek to
31 lay down as a foundation, as I have already stated, for the new super structure, my object being to invite other
32 gentlemen to work upon this foundation so as to best advance the ends we have in view.
33 END QUOTE
34
35 We also have certain conditions as to when the Commonwealth can use Consolidated
36 Revenue Funds pending the Parliament’s approval of Appropriation Bills.
37
38 Hansard 8-3-1898 Constitution Convention Debates
39 QUOTE
40 Mr. ISAACS.-I should hope that the expenditure caused by a bush fire would not be part of an
41 annual service.
44 Mr. MCMILLAN.-The annual services of the Government are those which we distinguish from
45 special grants and from loan services. The difficulty is that we have got rid of the phraseology to which
46 we are accustomed, and instead of the words Appropriation Bill, we are using the word law.
47 Mr. ISAACS.-A difficulty arises in connexion with the honorable members proposal to place
48 expenditure incurred for bush fires in the ordinary, it would not be annual, and it would not be a
49 service.

2 This means that as Minister for Foreign Affairs you will need special approval of the federal
3 Parliament to use monies from the consolidated revenue funds for any matters not ordinary
4 within the expenditure of the Department of Foreign Affairs.
5
6 Kindly provide me with details as to when the Commonwealth of Australia Parliament
7 approved the financing of bushmasters and other monies provided to the NAZI Government
8 of Ukraine? If no such special Appropriation Bills were passed and enacted by the Governor-
9 General then I view you are complicit to defrauding the Consolidated Revenue Funds.

17 While Mr Scott Morrison might be a Prime Minister this however doesn’t at all give him any
18 authority to override or otherwise interfere any decision you may make within your authority
19 as Minister for foreign affairs. Actually, cabinet can make suggestions to you but cannot
20 override you as Minister for foreign affairs as ultimately you are legally responsible and
21 accountable for Foreign Affairs issues.
22 This means that unless there were special Appropriation Bills passed and enacted to allow the
23 Commonwealth of Australia to provide financial and other support to the NAZI Ukraine
24 Government I hold the position that all and any such alleged aid is and remains to be
25 unconstitutional and so unlawful and so to say your head is on the block for it. Hence, you
26 need to immediately stop any delivery of monies and other so called aid (including the
27 bushmasters) to the NAZI Ukraine Government.

32
33 Remember the Iraq alleged WMD (Weapons of Mass Destruction)? Well it is now clear that
34 this was a deliberate disinformation by the USA and Australians intelligence services and
35 government took it then also hook, line and sinker.
1
2 Meaning Australia participated in war crimes, crimes against humanity, etc, without any shred
3 of evidence that the WMD actually existed. Yet, despite my ongoing request for a ROYAL
4 COMMISSION to investigate matters this never eventuated.
5
6 And your “Human rights” comments to me proved to be nothing more than being hollow
7 claims as in reality you seem to me to pursue the opposite.
8
9 Take Russian Federation vs Ukraine issue.
10
11 I am not aware that Mr Scott Morrison PM has any legal authority to willy nilly provide tens
12 of millions of dollars to a NAZI Ukraine government also in the aid to continue its
13 GENOCIDE of Ukrainians in the Donbass area as they have done since 2014, then reportedly
14 killing about 14,000 Ukrainians.
15
16 Remember the wording “FOR THE CHILDREN” on the rocket? Well, as I have outlined to
17 the Australian Federal Police that the Ukraine NAZI army was deliberately murdering
18 children.
19
20 I view that the Chris Smith Tonight (SkyNews) publishing claims from a Ukraine MP is very
21 concerning where the Ukraine army and its fanatic groups are known themselves for atrocities, and as
22 such a warning not to be parroting Ukraine Government deceptive/unverified claims.
23 With the demise of the U.S.A. Australia may end up being very vulnerable to have failed to remain
24 neutral in the Russian Federation vs Ukraine conflict as unlikely too many countries would come to its
25 aid when that is needed.

27
28 I on 7 March 2022 for example exposed the destruction of building in the Donbass area (by
29 the Ukraine NAZI army) and then on 13 April 2022 discovered that azFOX10 was claiming
30 that this was actually in KIEV.
31
32 Scott Morrison PM would do well to avoid getting drawn into a war, as if he is
33 desperate to join NAZI’s and other murderous groups then let him move to Ukraine,
34 but avoid getting Australian lives placed at risk merely for a political federal election

10 Now the azFOX10 video presented on 13 April 2022:
11 “Russia-Ukraine war Video shows destruction near Kyiv”
12
13
14
15
16 It should be very clear that where I already provided the images to Mr Scott Morrison PM on
17 7 March 2022 then this was well before the Russian federation was involved near KIEV let
18 alone in KIEV.
19 It would be impossible that the precise same line of buildings were existing in both Donbass
20 and Kiev and suffered identical damages.
21
22 Blackwater Are in Donbass Fighting With Ukraine's Azov Battalion and Getting Their
23 'Ass' Kicked
2
3
4 Well this building in Donbass (destroyed by the Ukraine NAZI army) later also was
5 falsely claimed to be elsewhere destroyed by the Russian Federation army
6
7 The Ukraine NAZI government and its collaborators are using fake news claims time and
8 time again. I have extensively canvassed this in my complaint to the Australian Federal
9 Police.
10 With the article:
11
12 https://www.globalresearch.ca/fakes-anti-russian-propaganda/5777833
13 Ukraine: The Fakes of Anti-Russian Propaganda
14
15 This article expose the fabricated claims regarding mass murder in Bucha, Ukraine claimed to
16 be against the Russian federation but actually was the handy work of the Ukraine NAZI army.

20 Evidence that the Missile that Caused the Massacre in Kramatorsk Is Not
21 Russian but Ukrainian
22
23 It seems to me that you and the Australian Intelligence services (ASIO, etc) are grossly
24 incompetent to establish the FACTS while I can do so without any large team of investigators.
25
26 If Scott Morrison PM doesn’t comes clean to the electors (as to MH17, COVID, etc)
27 then I view his right to be a candidate should be challenged, the same with Anthony
28 Albanese and other major party leaders.
29

2 B-to-R-Kershaw-Chief-Commissioner-of-the-Australian-Federal-Police-Suppl-63-MH17-
3 Etc
4
5 Again, the same FAKE NEWS regarding MH17 which I concluded was actually downed by
6 the Ukraine army. The mere fact that the Ukraine Government released an alleged audio
7 recording as to the Donbass defenders to admit they shot down a plane, where it turns out this
8 tape was created from various different tapes and put together many hours before MH17 was
9 shot down, this would to me indicate to me that the Ukraine army contemplated to shoot
10 down any passenger plane, and for this purpose had created this fake tape beforehand.
11
12 I understand that Boris Johnson PM now somehow wants t5o become more involved in the
13 Russian Federation vs Ukraine dispute. Well, considering how the UK was involved in the
14 fabrication of President Assad using chemical weapons which I obtained videos that it were
15 actually crisis actors, then one cannot rely upon what he claims.
16
17 Much is argued that the Russian Federation should not have entered into Ukraine, however in
18 my view and understanding the Russian Federation had no choice but to act. For years it was
19 known that the US, NATO, Georgia and Ukraine were working on creating bioweapons
20 against Caucasian Russians and for this specifically pursued Caucasian Russian DNA. I
21 understand that then mosquitos were transported using drones and then released within the
22 Russian Federation causing considerable harm to Russian Federation citizens. I have written
23 about this in my COMPLAINT to the Australian Federal Police also.
24
25 I also warned that (Australian) Aboriginals could be at danger also because they mostly
26 originate for what is now the Russian Federation and so their DNA may have similarities and
27 could decimate if not wipe out all together Australians of Aboriginal descent.
28 While Jackie Lambie appears to be pursing the unconstitutional drive for jabbing regarding
29 the claimed COVID reality might be that she could by this pursue the mass killings of
30 Aboriginals.

10 In the event you may hold that I am some ALP supporter, reality is that I view that Opposition
11 Leader Anthony Albanese is grossly incompetent as he should have been checking the
12 Federal Government regarding its unconstitutional conduct regarding supporting the Ukraine
13 NAZI government in particular its conduct to continue genocide against Ukrainians of
14 Russian ethic origins.
15 It appears to me that WWIII has been going on for more than a decade against the Russian
16 federation but that President Vladimir Putin had to build up gold reserves, etc, in case
17 sanctions were to be applied. This is was.
18 The Commonwealth of Australia may now discover it could be targeted due to ignoring the
19 warning of President Vladimir Putin not to get involved in the conflict between the Russian
20 Federation vs Ukraine. Well, the Commonwealth of Australia decided to act in a manner I
21 view should not have done and this may very well end up with future problems for the
22 Commonwealth of Australia. Perhaps it getting away with war crimes, crimes against
23 humanity, etc, invading Iraq may have resulted in a false security to set itself above the rule of
24 law. In my view the alleged involvement by the Peter Doherty Institute in regard of
25 bioweapon research in Ukraine/Georgia should have been properly investigated as after all
26 there are bioweapons legislative provisions and likewise the bioweapon usage of so called
27 COVID vaccines should have been properly investigated, well before it is too late!

8 In my appeals AEC v Schorel-Hlavka on 19 July 2006 I (representing myself) stated:
9
10 Mr. John Howard unconstitutionally authorised the murderous invasions into Afghanistan
11 and Iraq. How on earth could anyone expect me to vote by preference voting for what I
12 consider a mass murderer and one who committed treachery, treason, sedition and
13 committed crimes against humanity, and by this voting for anyone who supported the
14 war, such as members of his political party.
15
16 The court upheld both appeals and noted that the Commonwealth did not file any evidence. By
17 this the court enforced the 4 August 2005 order that the Commonwealth could not use
18 “averment” as I had successfully opposed. Moreover, by the Commonwealth not challenging any
19 submission I made in support of the appeals the Commonwealth by this was deemed to have
20 conceded that my submissions were not being challenged and were true and correct.
21
22 Despite that the Commonwealth conceded that my submissions were true and correct (as after
23 hall had they not been it could have challenged my submissions) then the question is why was
24 not ROYAL COMMISSION held into the unconstitutional Afghanistan/Iraq unconstitutional
25 invasion.
26
27 In my view any elector who opposes the Australian Government financial and other support for
28 the Ukraine NAZI government may have this also as an addition to decline to vote.
29
30 ADDRESS TO THE COURT
31 County Court of Victoria, Case numbers T01567737 & Q10897630
32 QUOTE
33 The Defendant submits, that even so he does not require to state his religion and neither
34 which part of his religion is relevant for a religious objection as it can be a secular
35 objection, he has religious objections and one is that “THOU SHALL NOT KILL” where
36 Mr. John Howard unconstitutionally authorised the murderous invasions into Afghanistan
37 and Iraq. How on earth could anyone expect me to vote by preference voting for what I
38 consider a mass murderer and one who committed treachery, treason, sedition and
39 committed crimes against humanity, and by this voting for anyone who supported the war,
40 such as members of his political party.
41 My right to abstain from voting could not be denied, neither be punished.
42 Likewise, in regard of the 2001 election where unconstitutionally, against International
43 obligations, such as the maritime report in regard of the sinking of the Titanic it is
44 unlawful to allow or to send any boat or ship away that is unseaworthy. Yet, we had the
45 Government using the navy to do so and refugees drowning in the process. We had the
46 Australian Federal Police, a law enforcement agency, being involved in what was claimed
47 to be conduct to discourage people smuggling, but it was being to prevent refugees to come
48 to the Commonwealth of Australia, and in the process we had the sinking of SIEV X, with
49 363 people aboard of which 146 children, on 19 October 2001.

1 and as I understand it claiming the application was not according to the Rules of the Court,
2 even so it was prepared as directed by the Registrar’s format. Gummow J upheld the ruling
3 of Haynes J subsequently.
4 On 18 March 2003 I then lodged in the High Court of Australia a new application that
5 basically pursued those three above issues, and left off other applications, albeit now
6 supported by about 800 pages of supportive documentation addressed in the various points
7 and backed up by relevant Authorities and Hansard quotations. Haynes J on 19 March
8 2003 (The day the armed invasion commenced into the sovereign nation Iraq) again
9 refused the application to be accepted for filing, and Gummow J later upheld this decision
10 also. Yet, I understand Kirby J then, so to say, put a call out to lawyers that they should
11 seek to challenge the validity of the “citizenship” legislation.
12 Still, the fact that I opposed the unconstitutional armed invasion into a sovereign nation
13 (Iraq) is therefore on Court file. I can do no more but to lodge applications and if any Court
14 refuses to hear and determine applications upon their merits then that is something that is
15 beyond my powers to overrule, other then that I can expose this. Constitutionally however,
16 there is no power for the High Court of Australia to refuse to hear and determine upon its
17 merits any application involving the interpretation of the Constitution as the Framers made
18 clear that an application “must be heard”.
19 END QUOTE
20 And
21 QUOTE
22 When then the Prosecutor, having relied upon the averment rule failed to present witnesses
23 that could, so to say, shed a light upon matters then this must be deemed FATAL to the
24 charges and no charges could be legitimately upheld.
25 Therefore, any evidence of by the Defendant during cross examination, if he gave such
26 evidence., that he did not receive any ballot papers, after attending to the polling station is
27 not of any standard of criminal proof by the Prosecutor that the Defendant therefore is
28 guilty of failing to vote.
29 In the proceedings before the Magistrates Court of Victoria at Heidelberg on 16 and 17
30 November 2005 the Prosecutor at no time did cross examine the Defendant in that case,
31 when advised the staff of the Australian Electoral Commission did not issue any ballot
32 papers, if this was because of having been made or being aware of any religious objection.
33 The Prosecutor neither cross examined if the Defendant had not been issued with ballot
34 papers because of having declared perhaps that he had already submitted a postal voting or
35 was to do so that day. And I raised this with the magistrate that the Prosecutor had failed to
36 address this!
37 As such, what we had was a conviction where even if all issues regarding validity of
38 citizenship, writs, proclamation, the appointment of Governor-Generals, etc were all
39 overcome somehow by the Prosecutor, something I view is beyond his capacity to get
40 around, then in the end his own usage of the averment rule is FATAL to his case as he
41 could not now in cross examination call witness , such as staff members of the Australian
42 Electoral Commission to give evidence that either they denied any religious objection
43 having been made or otherwise any postal voting or pre voting was recorded.
44 For example, in regard of the 2004 purported federal election, standing as a candidate, I
45 was known to refuse to indicate a preference vote as I opposed the murderous
46 unconstitutional invasion into the sovereign nations Afghanistan and Iraq and did not wish
47 to be seen to support this by giving preference vote indications which may be seen that
48 somehow I supported this humanitarian disaster and warmongering. Hence, it was
49 therefore critical to the Prosecutors case if perhaps the staff member sitting at the table
50 when my wife and I attended at the polling station may have been aware or have been
51 made aware that I opposed any kind of involvement as to the murderous invasions and as
52 such was not issued any ballot papers on that basis.

1 I was well aware during the proceedings that it didn’t matter for me to give whatever
2 evidence as ultimately having made a NO CASE TO ANSWER the magistrate was bound
3 by this to reconsider then if in light of the subsequent evidence his earlier ruling to dismiss
4 my submission of NO CASE TO ANSWER was found to be proven where I presented a
5 reasonable excuse that I had attended to the polling station and as such it was not for the
6 Court to try to score some conviction where the Prosecutor himself had elected not to call
7 witnesses who could have clarified what occurred that day.
8 Again, it was not for the magistrate to assume what may have occurred that day where the
9 Prosecutor himself refused to call witnesses whom could have elaborated on what had
10 occurred on that day! The Defendant was denied the option to cross witnesses in that
11 regard as there were none who could have shed light on this and as such the Prosecutor
12 taking the gamble to prevent the defendant to question any staff of the Australian Electoral
13 Commission by this had overplayed his hand, so to say.
14 END QUOTE
15 And
16 QUOTE
17 It is a very serious issue, indeed undermining the entire democratic system where those put
18 in charge of holding FAIR and PROPER elections are the very one who are abusing and
19 misusing their position and by this causing untold harm to the general community.
20 At the time I objected to the incorrect time tables being used, there was the great “children
21 overboard” issue going on and any delay in holding the election could have made a
22 considerable difference as to which candidates would have been elected and which
23 political party would have been successful in the election (purported election) hence, I
24 view, so to say, all stops were pulled out as to ensure that no matter how unconstitutional
25 and/or illegal the election process was the election had to proceed, even if it was meaning
26 to deceive the Courts as to its jurisdiction. As Mr Perter Hanks QC appearing for
27 Australian Electoral Commission was involved in by making false and misleading
28 statements to the Court (Marshall J) even to have purportedly quoting an authority having
29 substituted some words of the quotation without making this known to the trial judge, as I
30 have well documented in my material filed in past litigation.
31 It is my view that this seriousness of election fraud, as I view it to be, demands a ROYAL
32 COMMISSION as after all, where elections can be tempered with as to seek to ensure that
33 certain paries may retain power of government then this is a very serious matter that cannot
34 be ignored.
35 No judicial officer should accept that even those kind of allegations are left unattended
36 and ought to ensure that one way or another they are properly investigated, as after all
37 judges are not just judicial officers but have sworn to uphold the law and remain
38 themselves OFFICERS OF THE COURT.
39 The risk any judicial officer may take is to ignore matters to be reported to be properly
40 investigated may risk to be himself/herself failing to adhere to sworn duties toward the
41 Crown to uphold the law, etc.
42 This ADDRESS OF THE COURT could not possibly detail all matters in full detail, and
43 is neither intended to do so, as it would take thousands of pages to do so, but already ought
44 to give ample of indications that the purported elections were never constitutionally and
45 legally valid.
46 Thereby, I am aggrieved also that I am, as like other Australians, robbed of having a duly
47 elected government, both in 2001 and in 2004.
48 We may never have had the murderous armed invasion into the sovereign nation Iraq, had
49 an election in 2001 been rescheduled to be held according to constitutional and other
50 relevant legal provisions as this may have resulted to a different political party being in
51 power who would not have been, so to say been warmongering.
1 Neither would likely many unconstitutional legislative provisions have been enacted and as
2 such the conduct of the Australian Electoral Commission, so its lawyers, to prevent a valid
3 election to be held is a very serious matter then cannot and neither must be ignored.
4
5 The Commonwealth Director of Public Prosecutions has placed before the Court matters as
6 to seemingly enforce Commonwealth law, and so this court then is placed in a position to
7 address matters in a appropriate judicial manner, even so this might not particularly be
8 what the Commonwealth Director of Public Prosecutions had anticipated, or had in mind.

13 As for sanctions, also in Australia laws must be uniform and cannot be violated merely because
14 some idiotic mentally retarded federal government decides to get involved in a mar supporting
15 some Ukrainian NAZI government to continue genocide against its own citizens and others.

2 Again:
3 QUOTE: Wed, 27 Apr at 5:04 am email The Military Situation in the Ukraine
4 As an ex-intelligence professional, the first thing that strikes me is the total absence of Western
5 intelligence services in accurately representing the situation over the past year…. In fact, it seems that
6 throughout the Western world intelligence services have been overwhelmed by the politicians. The
7 problem is that it is the politicians who decide—the best intelligence service in the world is useless if the
8 decision-maker does not listen. This is what has happened during this crisis.
9
10 That said, while a few intelligence services had a very accurate and rational picture of the situation,
11 others clearly had the same picture as that propagated by our media… The problem is that, from
12 experience, I have found them to be extremely bad at the analytical level—doctrinaire, they lack the
13 intellectual and political independence necessary to assess a situation with military “quality.”

15
16 With reportedly the USA having used up one third of its munition by sending it to Ukraine and
17 due to transport issues it may not be able to obtain electronics needed to be used for
18 replacements the defence of the USA itself is reportedly a critical issue. It seems to me that the
19 Ukraine Oligards and others were enriching themselves instead of ensuring a sustainable armed
20 forces. In my view it is not Australians duty/obligation to provide at taxpayers cost weapons and
21 other financial support to Ukraine where it has absolutely nothing to do with the Commonwealth
22 of Australia.
23 Obviously our TREASONOUS Federal Government is more interested to continue its goal of a
24 New World Order and obviously President Vladimir Putin is an obstruction as he opposes a
25 unipolar world government.
26 If China were to decide to overrun the Commonwealth of Australia then the order of nuclear
27 submarines in 30 years or so (if ever) would not be some deterrent. Neither the USA assistance
28 when reportedly it is already struggling to be able to protect itself. The USA has bases around
29 the world and in that regard I view that China or any other country is entitled to do the same.
30
31 While unlikely as politicians often couldn’t care less about “collateral damage” involving
32 civilians, the Federal Government in my view should abort any support for Ukraine and make
33 clear it will remain neutral and any candidate standing in the federal election should pledge to
34 pursue such neutrality or face electors to not vote for them. It is now critical that electors show
35 their stand as if nuclear weapons start being used it might be too late to change the course of
36 Australia’s security. This is why as a matter of urgency the Australian Federal Police should
37 investigate matters so that where it is concluded that indeed politicians acted unconstitutionally/
38 unlawfully they be held legally accountable and this may avoid being the target of missiles. That
39 is if time is not squandered by not doing any investigation.
40
41 Let us be clear about it that Marise Payne as Foreign Affairs Minister is in my view grossly
42 incompetent and/or simply couldn’t give a darn about human rights.
43 After all she can go on about human rights and about war crimes but when she is supportive of
44 the very Ukraine NAZI regime that specifically target to kill school children, etc, and who
45 physically nail a Christian to a cross and then burn him to death then I view no competent
46 Foreign Minister would condone this or provide any support to such Ukraine NAZI regime.
47 Many Australians fled from warn torn countries and now have to endure a Federal Government
48 that seems to support a Ukraine NAZI regime with weapons, etc.
49 Just ask how much of the “aid” to Ukraine was destined no not for NAZI president Zelenskyy
50 but for the people in war torn Donbas. Or does the Federal Government hold that more than
51 14,000 murders of Ukrainians by their government is not enough to worry about?
52
1 Well, now that we have a Federal Government crying out about “war crimes”, we’ll that is as
2 long as the Russian Federation forces can be blamed regardless if they are innocent, but if the
3 FACTS shows that the killings were executions, etc. by the NAZI Ukraine government then
4 unlikely will you find those hypocrites to pursue charges of war crimes, crimes against
5 humanity, etc. After all by providing weapons and finances to a murderous NAZI government
6 they are by this implicated in it all.
7 Let us have every politician and official who were/are in anyway supportive of this Ukraine
8 NAZI government to conduct and continue its genocide against Ukraine civilians, in blatant
9 violation of their constitutional rights to be send over to Donbas to stand trial for their complicity
10 in it all. As I understand it the Nuremburg trials went by newly created laws that didn’t exist
11 previously, and so those convicted and sentenced to death were so on basis of laws that were
12 designed after WWII. Donbas might just follow this example, and create new laws to deal with
13 Australian politicians and officials whom are deemed to have aided and abetted in the genocide
14 inflicted upon them over about 8 years. Let it be clear that politicians/officials who were/are
15 acting in violation of our constitution have absolutely no legal protection from the position they
16 held as they are acting as civilians accountable like anyone else.

18 Scheuer v Thodes, 416 US 232 94S Ct 1683, 1687 (1974) states:
19 “when a state officer (which includes Judges) acts under a state law in a manner violative
20 of the US Constitution, he comes into conflict with the superior authority of that
21 Constitution, and he is in that case stripped of his official or representative character and is
22 subjected in his person to the consequences of his individual conduct.
23 The State has no power to impart to him any immunity from responsibility to the supreme
24 authority of the United States”.
