EXTRA-JUDICIAL SETTLEMENT OF ESTATE

OF THE SPOUSES VICENTE AND MAXIMA OCAMPO

KNOW ALL MEN BY THESE PRESENTS:

This DEED is executed by and among:

THE FIRST PARTY, ERLINDA O. VELASCO, of legal age,


Filipino, married to Edmundo C. Velasco, with residence at 9707 Pililia
Street, Santiago Village, Makati City;
THE SECOND PARTY, RENATO M. OCAMPO, of legal age,
Filipino, married to Ma. Fe B. Ocampo, with residence at Phase I,
Block II, Lot 15, Stanford Street, Golden Meadow Subdivision, San
Antonio, Biñan, Laguna; and
THE THIRD PARTY, consisting of VINCE E. OCAMPO,
MELINDA CARLA E. OCAMPO and LEONARDO E. OCAMPO, Jr.,
all of whom are Filipino, of legal age, single, with residence at Block 3,
Lot 43, Homonhon Street, Southpoint Subdivision, Pulo, Cabuyao,
Laguna;

- WITNESSETH, THAT –
The parties are the only heirs of the Spouses VICENTE and
MAXIMA M. OCAMPO, the FIRST PARTY and SECOND PARTY
being their surviving children, and the THIRD PARTY being their
grandchildren by their son, LEONARDO M. OCAMPO, Sr., who died
intestate on January 23, 2004.
The SPOUSES VICENTE and MAXIMA OCAMPO died on
December 19, 1972 and February 19, 1996, both without any will and
without any debt;

The Spouses left estates consisting of the following properties:
A. ESTATE OF VICENTE OCAMPO:

A.1 His conjugal share of one-half (½) of that parcel of land


identified as Lot No. 2352-M of Biñan Estate covered by and described
in Transfer Certificate of Title No. (25964) T-13093 as follows:
“A parcel of land (Lot 2352-M of the subdivision plan
Psd-66147, being a portion of Lot 2352 of Biñan Estate,
L.R.C. Record No. 8374), situated in the Municipality of
Biñan, Province of Laguna. Bounded on the NE., along
line 1-2 by Lot 2352-N of the subdivision plan; on the
SE., along line 2-3, by Creek,(10-15 m. wide); on the S.,
along line 3-4, by Creek (10-15 m. wide); on the SW.,
along line 4-5, by Lot 2440 of Biñan Estate; and on the
NW., along line 5-1, by Lot 2352-L of the subdivision
plan. Beginning at a point marked “1” on plan, being S.
37 deg. 39’E., 289.44 m. from Loc. Mon. 9, Biñan
Estate; thence…. S.39 deg. 44’E., 41.32 m. to point 2;
S.63 deg.11’W., 36.01 m to point 3; N.86 deg. 38’W.,
47.31 m. to point 4; N 35 deg.05’W.,2.64 m to point 5;
N.51 deg. 40’E., 69.45 m. to point of beginning;
containing an area of ONE THOUSAND NINE
HUNDRED FIFTY SIX SQUARE METERS AND
FORTY FOUR SQUARE DECIMETERS (1,956.44)

A.2 His one-half conjugal share of that parcel of land covered by


and described as Lot No. 5 of Biñan Estate in Transfer Certificate of
Title No. T-5827as follows:
“Lot No. 5 of the “Biñan Estate Subdivision”,
Province of Laguna, P.1., with a house of strong
materials existing thereon. Containing an area of 285
square meters, according to subdivision plan No. A-16.”

He was survived by his wife MAXIMA M. OCAMPO and


children, THE FIRST PARTY, THE SECOND PARTY and
LEONARDO M. OCAMPO, Sr., (father of THE THIRD PARTY)
succeeded to this estate in pro-indiviso equal shares:

B. ESTATE OF MAXIMA M. OCAMPO:
B.1 5/8 of Lot No. 2352-M described in paragraph A.1;
consisting of 4/8 (or ½) conjugal share in the lot and 1/8 inherited from
the estate of Vicente Ocampo;
B.2 5/8 of Lot No. 5 described in paragraph A.2; consisting of
her 4/8 (or ½) conjugal share in the lot and 1/8 inheritance from the
estate of Vicente Ocampo;
B.3 That parcel of land identified as Lot 30-A of Binan Estate,
covered by and described in Transfer Certificate of Title No. T-283298
as follows:
“A Parcel of land (Lot 30-A, of subd. Plan Psd-04-
051139, being a portion of Lot 30, Biñan Estate;
LRC Rec. No.8374), Situated in Bo. Poblacion, Mun. of
Biñan , Province of Laguna. Bounded on the km
along line 1-2by J. Gonzales St. (10.00m. wide); on the SE.
and NE; along lines 2-3-4 by lot 30-B; on the
NE., along lines 2-3-4 by lot 30-B; on the NE.; along line
4-5 by Lot 30-C; on the SE., along line 5-6 by Lot
30-D, all of subd., plan; on the SW.,& NW.; along lines 6-
7-8-9-1 by Lot 24, Biñan Estate ,; Beginning at a
point marked 1 on plan, being S.,4 oeg.39’E., 407.70 sqm
from Mon 4,Biñan Estate.

B.4 That parcel of land identified as Lot No. 112 of Biñan


Estate, covered by and described in Transfer Certificate of Title No. T-
81707 as follows:
“A parcel of land (Lot 112 of Biñan Estate, L.R.C.
Record No. 8374), situated in the Municipality of Biñan,
Province of Laguna, Island of Luzon. Bounded on the
SW., along line 1-2 by Road; on the NW., along line 2-3,
by Lot 111, Biñan Estate; on the NE., along line 3-4, by
River; and on the SE., along line 4-1, by Lot 113 Biñan
Estate. Beginning at a point marked “1” on plan, being
8.9 deg. 43’E., 443.8 m. from Mon. 4, Binan Estate;
Thence ….. N.34 deg. 15’W., 34.1 m. to point 2; N. 62
deg. 30’W., 44.0 m. to point of beginning; containing an

area of ONE THOUSAND FIVE HUNDRED THIRTY
NINE (1,539) SQUARE METERS.

She was survived by the parties.


The PARTIES have agreed to adjudicate among themselves the
estate of the spouses extra-judicially, in accordance with Section 1,
Rule 70 of the Rules of Court;
NOW, THEREFORE, the PARTIES invoking Section 1, Rule 70
of the Rules of Court, do hereby settle extra-judicially the ESTATE OF
SPOUSES VICENTE AND MAXIMA M. OCAMPO among themselves
in equal shares of ONE-THIRD each.
